Terms and Conditions
Springwell daycare nurseryUKltd., hereinafter referredto the nursery., Offer a definite /provisional place to the child
referredto overleafwhois to jointhe nursery on the followingterms . These terms andconditions relate to the contract
betweenthe nursery/guardian. The headings in thisagreement are insertedonlyfor convenience and shall not affect its
construction.
1. Registration
Registrationfee as referred to onthe fee sheet shall be paidbythe parent/guardianto the nurseryon submission of the
completedregistration form andthat fee shallnot be returnable ifsuchacceptance is later withdrawn byparent /guardian.
2. Acceptance
A deposit as referredto on the fee sheet shall be paid by the parent/guardianto the nurseryon the acceptance of the offer
and that deposit shallnot be returnable unless 2 full month’s notice in writing is provided to the nursery manger .the
deposit is not deductible from the first monthfeesbut can(apon discretion fromthe proprietor) be used for fees due to
the nursery the last month that child attends.
3 Payment of nursery fees
A payment ofnurseryfees to the nurseryfor the child’s attendance at the nursery shall be made bythe parent/guardian
monthly, in advance, onthe first of each month(the due date)bydirect debit. Bif the payment of fees referred to in A,
above shall be outstanding for more than 14 working days then the nursery may serve 14 days notice in writing to
terminate this contract. Upon termination ofthis contract the childshallcease forthwith to be admitted to the nursery,
and the nursery’s notice to soterminate shall regard as a formal demand for all outstanding monies. C the nursery
reserves the right to increase the saidfees at anytime upongiving28 days notice inwriting the proposedincrease to the
parent/guardian. A late payment charge of £35 shall applyif fees are not received by the 1st of every of every month a
further £35 will be added to the late charge for everyweek fees that are outstandingfrom thereon. It is therefore advised
that fees are paid the 1st of the month(dependant on the day it shall fall on) to enable funds to be clear by the 1st
springwell day care ukltdnurseryaccepts not liabilityfor problems with banks, chequesect that cause fees to be late and
a late fee of £35 will still apply .
4 Calculation of fees
A. The nursery is open for 52 weeks of the year and closed for 1 week over Christmas.
b. the fees payable bythe parents/guardianare calculated bytaking the child’s weekly attendance fee, multiplying
the same bybeingthe number of weeks the nurseryis openanddividingby12 to give a monthly payment which is
required in accordance with clause 3a.
The nurserydoes not permit the payment of fees ona dailyor weeklybasis. Anypayments bya parent /guardianuponthis
basismaybe regarded bythe nurseryas a breachof the parent/guardian payment obligations andthe nurseryreserves the
right to terminate this agreement upon serving a 14 day notice of the parent/ guardian payment default. Upon the
expiration ofthe said 14 days notice and the parent /guardianhaving failedto remedytheir payments default, then the
nurseryshall be entitledto treat this agreement as terminaland provisionof clause 3b shallapply. Cthe nurserydoes not
permit the pro-rata reduction ofpayment offeesifthe childis absent from the nurserydue to illness or holidays whist the
nurseryis open. The parent/ guardian are therefore obligedto make full payment. Inthe event of payment not beingmade
then the nursery reserves it rights to terminate the agreement in accordance with clause3b.
2. 5. Cancellation/termination
A. after anoffer hasbeen made bythe nurserybut before acceptance bythe parent/guardianeither partymaycancel the
offer by serving 7 days written notice
B. after acceptance of the offer bythe parent/guardianeither partymayterminate this agreement by the service of two
calendar months notice inwriting. Duringthat saidtwo months period the nurseryundertakes to continue to admit the
childandthe parents /guardian undertakesto payall fees due. Inthe event of parent/guardianfailingto paythe said fees
the child’s place shallbe immediatelywithdrawandthe nurseryshall be entailed to serve a formal demandfor payment of
such monies.
C. In the event ofparent/guardiangiving notice of the withdrawal of the child and immediatelywithdrawing the saidchild
there shallbe due to the nurseryon two calendar months feesinlieu ofnotice. Failure bythe parent/guardian to provide
two months notice at all shall render the parent/guardian liable two month’s fees.
D. Notice must be in writing and sent to the nursery manger.
E. If in reasonable opinionof the nurserymanger or person of similar standing or authority it is considered that the
continuedpresence ofthe childreferredto herein is detrimental to health, safety or well being of the child or other
children of the said nursery or teachers or other staff so employed then the nursery may serve notice to the
parent/guardianor a request for the childto be immediately removed from the nursery and provision of two months
notice referred to in sub clause b. Herein before stated shall not apply.
6. Variation
A. There shall be novariationof thisagreement unless it is inwritingandmade between a dulyauthorisedrepresentative
of the nursery and the parent/guardian, any such agreement being in writing from director of the company.
B. it is hereby recognised that the nursery is owned by springwell day care nursery UK ltd (hereafter called the
company.)And the members of staff at the nursery are employees of the company.
C.Employeesof the companyat the saidnurseryare not authorised to bind the company in respect of the following
matters:
C1.The variation of any of the terms of this agreement except attendance schedule
C2. The enteringinto ofthe agreement be theyoral or writtenwithinthe parent/guardianas payment schedule of current
fees or arrears.
C3. The acceptance of any offer as to payment of fees or arrears of fees other than in accordance with clause 3.
C4. Any representation as to rights of the company to take legal or other proceedings
7. Acceptance
The above terms andconditions are considered to be fair andreasonable. In the event of anyterm foundbya court law to
be unreasonable that the clause shall be removedbut the agreement shall remainin force and effect. The parent/guardian
has read and understood the terms and conditions contained herein and undertake to be bound by the same
