The execution of the innocent believed guilty is a miscarriage of justice that must be opposed whenever detected.
But such miscarriage of justice cannot warrant abolition at the death penalty. The advantages outweigh the disadvantages, human activities including the penal system with all its punishments are morally justified. It is necessary to protect the rights of a group of people, death penalty is vital to protect a person’s right to live. If not so, then is the arresting someone same as kidnapping someone?

Should Capital Punishment be removed from the existing Indian Law or not?
The topic itself is quite 'debatable'.
However, I managed to substantiate it a bit with some information collected from the Internet, still was not satisfied with the outcome. So, I made a survey on the common people of Bhubaneswar to know what they want.
I took down the datas collected from their yes/no response and compiled them into a graph which gave me a much clearer overview.
I hope that my presentation might be helpful to you all and know the current scenario of people's mindset to some extent.

criminal law. Several jurisdictions have go on to exercise this means of penalizing felonies and
in the other parts, questions emerge on the legitimacy of the exercise. The mostly used methods
of implementing capital punishment long ago incorporated skewering as well as beheading. The

2. DEFINITION
• Death penalty is the
punishment given to
those who have been
found guilty of
heinous crimes
through the
observance of due
process of law.
3. The tragic case of the 23 year old woman who was brutally attacked, raped and left for
dead by six men in New Delhi on December 16. Violence against women is endemic,
more than 220,000 cases of violent crimes against women were reported in 2011
according to official statistics from Indian government, with the actual number likely to
be much higher.

5. 1. The penalty should be retained for heinous crimes like rape and murder. Else the crime rate
will shoot up. The death penalty will set an example for other criminals and will keep a check
on crime rate.
2. Keeping a rapist or a murderer for years in jail with all facilities and letting them free after a
period of time is no justice to the victim.
3. As it is awarded only in rarest of rare cases, so not all the criminals are awarded the
penalty.
6. 1. Capital punishment is a must in
case of crimes of higher degree
like rape, murder etc.
2. Life imprisonment will not deter
people from committing crimes.
3. In case of life imprisonment,
government would use tax payers
money in order to feed them for
years, thus, in a along run it would
prove more costly.
4. There is always a risk of
prisoner breaking out of the
prison, Government will have to
shell out extra money for
additional security.
5. There is always a risk of another
terrorist activity taking place to
rescue the prisoner. Let us not
forget the hijacking of Indian
airlines flight.
7. Capital Punishment is very
barbaric and medieval. We are
a civilized society, so let’s
remove it
• We are surrounded by violent groups from all
sides. ISIS is much more violent than any medieval
group. We need capital punishments for such
terrorist. With about 68 rape cases reported
every day in India in 2012.
• It would be so unfair for the victims’ families. It’s
not blood lust, its justice for them.
• If someone has committed a heinous crime, then
why is it argued that he needs to be treated like a
human? Wasn’t the crime he committed of
inhumane nature.
8. Believe it or not,
gruesome criminal does
exist. Death penalty is
reserved for“the Rarest
of rare crimes”. For
crimes like Nirbhya
case, Nithari case – is
Life imprisonment
enough? Certainly not.
Then there won’t be
any difference criminals
and monsters? If there
is no provisions of
death penalty, and we
find a crime as
disgusting as it is, will
we again change our
constitution?
10. At last I would like
conclude that I’m not in
favor of Death penalty
but, only if our our
Government could afford
the money required for
criminals and security of
prisoners on their own
risk.
Honestly, I don’t think so.
