Sexual Harassment
• Sexual harassment has become a major
  concern.
• Parliament has passed a Bill to counter this
  menace.
• It will make it mandatory to have a Sexual
  Harassment Code in all enterprises.
Sexual Harassment Bill
• The name of the statute: The Sexual
  Harassment of Women at Workplace
  (Prevention, Prohibition and Redressal) Bill,
  2010.
• Definition of workplace will include all kinds of
  enterprises, even NGOs and domestic helpers.
• The statute will also apply on unorganized
  sector having less than 10 workers.
Internal Complaints Committee
               (contd.)
• Employer will constitute this committee.
• Member will be nominated by the employer.
• Will be present at all the offices of the
  enterprise.
Internal Complaints Committee
• Composition of the committee:
  (i) Presiding Officer – woman employee
  (ii) Min 2 employees committed to the cause
  of women or having experience in social work
  or legal knowledge.
  (iii) one from NGO or has sufficient
  information about sexual harassment.
• Term of members – 3 Yrs.
Local Complaints Committee
• Will be constituted by the District Officer in
  every district.
• Will have jurisdiction over all cases from
  unorganized sector having less than 10
  workers or complaints against employers.
Complaint, Inquiry and Award
• Both committees will have power to lodge
  complaints and inquire upon them.
• Then they will submit the report to the
  employer    or    District   Officer giving
  recommendations.
• Employer or District Officer will award
  punishment.

Sexual harassment in enterprises

  • 2. Sexual Harassment • Sexual harassment has become a major concern. • Parliament has passed a Bill to counter this menace. • It will make it mandatory to have a Sexual Harassment Code in all enterprises.
  • 3. Sexual Harassment Bill • The name of the statute: The Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Bill, 2010. • Definition of workplace will include all kinds of enterprises, even NGOs and domestic helpers. • The statute will also apply on unorganized sector having less than 10 workers.
  • 4. Internal Complaints Committee (contd.) • Employer will constitute this committee. • Member will be nominated by the employer. • Will be present at all the offices of the enterprise.
  • 5. Internal Complaints Committee • Composition of the committee: (i) Presiding Officer – woman employee (ii) Min 2 employees committed to the cause of women or having experience in social work or legal knowledge. (iii) one from NGO or has sufficient information about sexual harassment. • Term of members – 3 Yrs.
  • 6. Local Complaints Committee • Will be constituted by the District Officer in every district. • Will have jurisdiction over all cases from unorganized sector having less than 10 workers or complaints against employers.
  • 7. Complaint, Inquiry and Award • Both committees will have power to lodge complaints and inquire upon them. • Then they will submit the report to the employer or District Officer giving recommendations. • Employer or District Officer will award punishment.
