Introduction
Schools are a people-intensive business, and school districts regardless of size allocate the majority of available funding (sometimes as much as 85–90%) to salaries and benefits for employees. Parents and other stakeholders expect the best teachers for their children. They also demand sound stewardship of this public trust. Consequently, recruiting, selecting, and supervising employees is an important, some might say the most important, role for school leaders. At the same time, teachers and other school employees are protected by a variety of employment laws. Sound stewardship requires an awareness, understanding, and acceptance of these laws and policies. Effective school leadership also requires that they be fairly applied in order to create cooperative environments.
The basic ethical and legal principles concerning employment, teacher supervision, and collective bargaining that apply to most states are emphasized in this chapter. These laws vary, sometimes substantially, from state to state. Therefore, leadership candidates and instructors are encouraged to obtain and use state law to guide discussions in this chapter.

Jason Whitehead glanced across the table at the face of Corinne Lodge, the board chairperson. Corinne was obviously unhappy. He looked around the table. The other six board members seemed in varying degrees to share Corinne’s displeasure. This was Jason’s first year as superintendent of Pine Valley School District (PVSD), a relatively small school district in Johnson County. Easy access to interstate highways and a major metropolitan complex made Pine Valley a thriving community. Pine Valley, unlike many neighboring districts, faced continuing increases in enrollment. Over the years, the population had grown, and in that time the teaching staff had almost doubled. Corinne said, “I’m concerned about some of the allegations in this letter. Case Study So Many Detentions, So Little Time
Jefferson Middle School (JMS) was the most racially and culturally diverse of the three middle schools in Riverboat School District, a relatively affluent bedroom community within commuter distance of Capital City. Unfortunately, the culture of Jefferson Middle School was not going well. Over the past 5 years, assistant superintendent Sharon Grey had seen JMS become a school divided by an underlying animosity along racial and socioeconomic lines. This animosity was characterized by numerous clashes between student groups, between teachers and students, between campus administrators and teachers, and between teachers and parents. Sharon finally concluded that JMS was a “mess.”
After much thought and a few sleepless nights, Sharon as part of her job description made the recommendation to the Riverboat school board to not reemploy Jeremy Smith as principal of JMS. Immediately after the board decision, Sharon organized a search committee of teachers, parents, and campus administrators and began the process of finding the right principal for JMS. The committee finally agreed on Charleston Jones. Charleston was a relatively inexperienced campus administrator but had impressed the committee with his instructional leadership knowledge, intelligence, and youthful energy. However, the job of stabilizing JMS was proving to be more of a challenge than anyone had anticipated.
Charleston had instituted a schoolwide discipline plan and had insisted that teachers and school administrators not deviate from the plan. However, he could sense that things were still not right. Animosity among student and parent groups remained just below the surface, ready to erupt at the slightest provocation. Clashes between teachers and students were still relatively frequent. Teachers still blamed one another, school administrators, and the school resource officer for a lack of order in the school. Change was not coming quickly to RMS, and Charleston understood that although school management had improved, several aspects of school culture were less than desirable. Student suspension rates remained high, and parental support was waning. As one of the assistant principals remarked after the umpteenth student referral, “So many detentions, so little time!”

proceed to prove that the school had board had behaved properly and done everything correctly.
Seth Bloom spoke out against a controversial measure by a new school board president, which aimed to nullify and
renegotiate the contracts of an interim superintendent and Deputy Superintendent for Charter Schools. Serving as an
attorney in addition to a school board member, Seth Bloom questioned why objections to the initial contracts had not
been raised by attorneys at the time when the contracts were rst drafted or signed.
Seth Bloom has spoken out strongly in support of the Disadvantaged Business Enterprise (DBE). Under the DBE, the
district set forth a goal that 35 percent of the value of its contracts should be awarded to minority-owned businesses.
This includes all contracts, from large-scale products to contracts for food service and lawn care. Seth Bloom was
quoted by WDSU as saying, “We put so much energy into it, [the DBE program], and I think we’re doing a really good
job.” The program was established in October of 2012 during Seth Bloom’s rst term on the Orleans Parish school
board, and is expected to reach a larger range of businesses in coming years.
Seth recommended that interim Superintendent Stan Smith’s contract should be reviewed and amended, if needed. This
moderate approach to handling the contracts was adopted by other school board members instead of the more radical
proposal that had been put forth by the new president. NOLA reports that the school board voted in favor of Seth Bloom’s
motion.
These are just some of the many important issues that school board member Seth Bloom has addressed. His advocacy is
helping to make a real di erence for students and families in District 5.
