I have finished proofreading Atty. Newleaf’s response brief from the Drueck appellate case. There are a
number of items that were missing from his first draft, which include the following:
1. Table of Contents pursuant to Wis. Stat. § 819.19(a)
2. Table of Cases (Table of Authorities) pursuant to Wis. Stat. § 819.19(a)
4. Statement as to reasons whether oral argument is necessary and whether the opinion should be
published pursuant to Wis. Stat. § 819.19(c)
5. Affidavit of Service and Certification pursuant to Wis. Stat. § 809.19(2)(b)
6. Appendix pursuant to Wis. Stat. § 809.19(2)(a)
Please note that I have added both a Table of Contents and a Table of Cases (Table of Authorities). I also
drafted the Certification statement.
Atty. Newleaf could exclude a statement of the issues and the statement of the case—if he chooses—
since it is included in the defendant-appellant’s brief pursuant to Wis. Stat. § 819.19(3)(a)(2). Since his
version is slightly different than that of the opposing counsel, he may wish to leave it in.
The brief had a number of spelling, grammar, and punctuation errors. Many of the statutes and case law
references were incorrectly cited. I have corrected these areas to the best of my ability. I did not edit any
of the legal substance in the brief aside from a few questions I wrote in the right-side margin.
Once the final proofread version of the document is complete, we must provide the Court of Appeals with
10 copies of the brief and appendix and 3 copies on each party pursuant to Wis. Stat. § 809.19(8)(a)2. We
must also provide the court with one electronic copy of the brief and appendix according to Wis. Stat. §
809.19(8)(a)4. The color of our cover for the defendant-respondent response brief for the Court of
Appeals must be red. See Wis. Stat. § 809.19(9).
