You work as a paralegal in a public defender’s office. In an upcoming presentation to a local legislative committee, the public defender plans to address criminal justice issues, constitutional principles, cultural sensitivity, and diversity awareness to promote social justice goals in local communities. You have been asked to assist the public defender in preparing the presentation. To this end, you will explore processes and issues in three criminal cases, applications for criminology, and relevant critical perspectives toward the goal of building a more just society.
Your Task
The public defender hopes to gain funding to support programs that respond to criminal justice issues and that promote a more just society. Earlier in this course, you had an opportunity to criminology through the works of Messer et al. (2016), Salvatore (2017) and Zoutewelle-Terovan & Skardhamar (2016). These authors consider how criminology may help to explain factors that associate with crime. Recall for example the consideration of life course theory in Messer et al. (2016). To help the public defender with preparation, you have been asked to create a paper between six and eight pages in length. Your description of processes, explanation of issues, and analysis of critical perspectives will provide the foundation for the public defender’s address to the local legislative committee, and thereby promote support for programs and laws that address large societal problems and that promote the social justice principles of equality, solidarity, and human rights to build a more just society.

2. Introduction
Case 1:- In December 6,1993 a prominent Indian actor was trailed for illegal arms
possession under arms act
March 21,2013,the actor was found guilty and sentenced for 5 years of
imprisonment.
Case 2:-In December 2001, Indian parliament attacked , case filed on
November 2002.
November 9 2013-Afzal Guru found guilty and was executed after
11 years.
Case 3:-April 30 1999,a journalist Jessica Lal shot dead. Including a political
leader there were many suspects.
February 21 2006-the case was pending in Delhi High Court for 6 years
until the court decided to proceed the case on a fast track basis , the
hearing went on every day for 25 days , Manu Sharma was found
guilty and was sentenced to life imprisonment on December 20,2006.

5. Cases concerning national issues referred to supreme
court:-
Cases due to which there was a direct threat to the nation involving terrorist
activities , scams , if any political authority involved should be directly handed over
to the supreme authority of jurisdiction. Today we have the facility to file our case
in lower court , if found guilty then we move to higher court and so on. By directly
applying such type of cases in supreme authority will result in minimisation of time
consumption , which can effectively be put to solve other cases
Coordination between court and investigation committee:-
One of the reasons that delay the jurisdiction of court is miscommunication between
court and investigating committee . An independent committee comprising of formal
decision making people should be formed which should act as an intermediate between
court and investigating committee.
This committee will study all the cases and analyse the evidences corresponding to the
case . If found substantial the committee itself can reshuffle the order of trial of
cases , this will lead in better output from the existing courts.

INTRODUCTION:- Fast track courts , as the name suggests , are a remedy for expeditious and timely justice . in
the past decade 1732 fast track courts have been setup till date , but still we lack to give justice to this nation of
121 crore people.
INITIATIVE:- Here is a fictitious example for the entire implementation of above concept.
Let’s consider a city XYZ , with a population of about 10,00,000.In the past 30 years ,20,000 cases have been
registered in the sessions court of of XYZ. Out of these 2500 cases were given verdict. Rest 17500 cases were
pending.A rough approximation of the type of cases in XYZ can be seen below

7. Going through the above calculations an estimated amount of time required to solve the no. of cases
is approx. 75 years.
These statistics portray the city’s jurisdiction analogous to present India . Our model is a step towards
betterment of this system.To improve the existing judicial system we have applied our above
concept. Let’s have a view….
For a population of 1000000 people we will set up 3 fast track courts.
Details of fast track court
Each fast track court will comprise of a bench of 3 judges and a justice.These judges will be
appointed by the governor along with the justice of sessions court.
An approx fund of each court including the infrastructure, salary, miscellaneous will be
5 crores.
Operation of each court:-
Court 1: Dealing with the social cases
Court 2: Dealing with economic cases
Court 3: Dealing with cases concerned to national issues
Over edge of these courts over the traditional courts will be their coordination with our
committee . As this committee will be in contact even with the investigating agency
it will proceed those cases for verdict which have received sufficient evidences. As the
committee comprises of ex-judges they will handle the reshuffling of cases for jurisdiction.
This process will further enhance the speed of judicial process

be around 50 years i.e. 25 years of minimisation

The city XYZ can be considered as a smaller module of our nation.The population and the cases are at a
broader aspect. In this analysis if no. of cases considered at the level of our country can be very well seen with
situation of our country at present. The analysis for a hypothetical town and its comparison with Indian

**All the calculations are pertain to the above mentioned data of city XYZ on the nation’s level.
On the collection and analysis of all data it was seen that on India’s level the time reduction would be
around 60 years. Plenty amount of time to direct a country’s future to brightness.
10. Risks and challenges:-
Funding of this model through government can be a
hindrance.
Since many committees will come into existence , lack of
experienced judges will be a major problem.
Since there are more than 2 crore pending cases , classification
of each and every case will be cumbersome.
It should be seen that the committee which is formed is
ensured independence , but must be under direct control of
Supreme Court.
For transparency the committee members should be
answerable to common people through RTI act.
