2. Introduction
• Registration of documents of immovable
properties is compulsory according to Section
17 of the Registration Act,1908 and Section
54 of the Transfer of Property Act,1882.
However, there are certain circumstances
under which the registering authority can
refuse registration of documents

3. Reasons For Refusal To Register A Document.
1. The document is in a language not understood by
the registering officer, or a language not commonly
used in the district; Section 19 of Registration
Act,1908.
The document has corrections, alterations, erasures,
interlineations blanks, which are not attested by the
executant; Section 20 of Registration Act,1908.

4. The description of the property is insufficient to
identify and the document is not accompanied by a
copy of the map, plan as required under the relevant
provisions; Section 21,22of Registration Act,1908.
The document is presented after prescribed time
limit; Section 23,24,25,26,75,77of Registration
Act,1908.
The document is presented by a person who has no
right to present it; Section 32,33of Registration
Act,1908.

5. The executants or their authorized representative,
assigns, agents did not attend to registration within
the prescribed time. Section 34of Registration
Act,1908.
The person supposed to have executed the
document is a minor, idiot, lunatic, not competent to
contract.
The prescribed fee, penalty under any other law in
force for time being has not been paidSection80of
Registration Act,1908.

6. Refusal Document (Sec.71)
• Document may refused on that grounds
• A document can refused by the sub-register officer to
register on the ground that the property is not
situated within his area.
• There is no remedy against the order of the sub
register.

7. Appeal To The Register(Sec.72)
• When the registration of a document is refused
on grounds other than want of jurisdiction or on
denial of execution, the aggrieved party may appeal
in writing to Registrar of the District or Officer in
charge, District Registrars office, along with a copy
of refusal order and the document

8. • The appeal shall be preferred within 30 days from
the date of refusal order
• If he satisfied then registered will be fulfill
• Application of Appeal will be under Section73 of
Registration Act,1908
• Procedure of registrar on such application will be
under Section74 of Registration Act,1908.

9. • Enquiry of the register from which ground
document is refused.
• Register has no authority to call for further
description of property.

10. Refusal By Register
• Document may also refused by the register.
• Section76 of Registration Act,1908 says about order
of refusal by register.
• No appeal lies from any order by a register under
Section76 or Section72

11. Suit against the Register
• Under Section77 of Registration Act,1908 says
about Suit in case of order of Refusal By Register.
• To the Civil Court division.
• Such suit will be filed within 30 days of the order of
refusal by the register.

12. Penalties
• Says about Penalties Section81-84 of Registration
Act,1908
• Penalty for incorrectly

Shall be punishable with imprisonment may extend seven
years, or with fine or with both under Section 81.
