5. Improve market functioning
• Provide for the right incentives:
o Get the right price signals at all times/ allow scarcity pricing
o Take real time value of energy as a basis for the price
o Remove distorting price caps
o Balancing responsibility for all parties
o Flexibility: level playing field for all sources of flexibility
• DSO’s as neutral market facilitators
o Maintain or enhance unbundling requirements (already
accomplished in NL)
o No ownership of storage and EV charging infrastructure

6. Need for an agile Electricity system
• Overall challenge is to integrate a range of local
energy systems into a system that also has to take
into account need for large scale renewables
generation and transport
• Prevent Local Energy Communities from turning
their back on the system, as that will reduce overall
efficiency and increase costs
• We may need flexible solutions to integrate local
energy into the market

7. Data management is key
Level playing field
• crucial is that all actors in the market (aggregators, energy
service companies) need non-discriminatory access to data
Privacy of consumer
• needs to be respected and protected: so access to data only
with explicit consent of consumer
Data management model with clear responsibilities needed
• CEP: designated competent authority,
• States need to be able make their own choices
Furthermore:
• unburden consumers: take care that they do not have to bother
about their data if they don’t want to be involved

8. Enabling flexibility: some examples
• As first steps ACM contributes by:
o approval of netcode modification facilitating two suppliers
on one connection: contributes to consumer empowerment
and will help developing DSR
o approval of Dutch netcode enabling dynamic pricing: ACM
has issued a permission to a supplier offering flexible
prices (APX-based) to facilitate price responsiveness
o accepting peer to peer trading of renewable electricity
within existing supply permit
o Exploring options to facilitate experiments in grid operation
aimed at developing smart grids
