   Además, los proveedores recibirán asistencia técnica
    conjuntamente con cualquier sanción disciplinaria.

   Cada violación al estándar tiene asignada una
    clasificación basada en el tipo o la severidad de las
    violaciones según lo identificado en el Child Care
    Facility Standards Classification Summary (el resumen
    de la clasificación de los estándares para facilidad
    del cuidado de niño), Forma CF-FSP 5316.
   CLASE I –es la más seria, presenta una amenaza
    inminente (a punto de suceder) a un niño
    incluyendo abuso o descuido y pudiese causar la
    muerte o daño serio a la salud, la seguridad o el
    bienestar de un niño.

   CLASE II – menos seria que violaciones de la clase
    I ya que puede anticiparse que plantea una
    amenaza a la salud, a la seguridad o al bienestar
    de un niño, aunque la amenaza no es inminente.

   CLASE III – son menos serias que violaciones de
    Clase I o II y plantea un daño potencial bajo para
    los niños.
   Por la 1ra violación de la Clase I . . . (1/1) – una multa
    no menor de $100 ni mayor de $500 por dia y pudiese
    imponer otras sanciones disciplinarias además de la
    multa.

 Por la 2da violación de la Clase II… (2/2) -una multa de
  $50 para cada violacion.
 Por 3ra violación de la Clase II . . . (2/3) - una multa de
  $60 POR DIA para cada violación.

 Por la 3ra violación de la Clase III . . . (3/3) –una multa
  de $25 por cada violación.
 Por la 4ta violación de la Clase III . . . (3/4) – una multa
  de $30 POR DIA para cada violación.

Classrooms of one age group:
• Birth through 1 year of age, there must be one staff for every 4 children.
• 1 year of age or older, but under 2 years of age, there must be one staff
member for every 6 children.
• 2 years of age or older, but under 3 years of age, there must be one staff
member for every 11 children.
• 3 years of age or older, but under 4 years of age, there must be one staff
member for every 15 children.
• 4 years of age or older, but under 5 years of age, there must be one staff
member for every 20 children.
• 5 years of age or older, there must be one staff member for every 25 children.
Mixed Ratios:
• In groups of mixed age ranges, where children under 1 year of age are
included, one staff member shall be responsible for no more than 4 children of
any age group at all times.
• In groups of mixed age ranges, where children 1 year of age but under 2 years
of age are included, one staff member shall be responsible for no more than 6
children of any age group at all times.
• When children 2 years of age and older are in care, the staff-to-children ratio
shall be based on the age group with the number of children within the group.
For every 20 children, a child care facility must have one (1) credentialed staff
member.

   2      Direct supervision of children in the [ ] group was inadequate in that [ ].

        Fire drills were not conducted and/or did not include one drill during napping/sleeping
       times, one drill using alternate evacuation routes, or one in the presence of the licensing
  2    authority.
        The facility operator did not have a current fire safety inspection by the local fire
  2    authority.

  2     All adults and children failed to evacuate the facility when the fire alarm was activated.


       The facility operator/staff failed to possess a current attendance record during a fire drill,
  2    emergency preparedness drill or an actual emergency.

  2     The operator failed to conduct emergency preparedness drills.
40. Outdoor Equipment rule 65C-22.002(9)(b), F.A.C.



  2     The play equipment was not safe for the children to use in that [ ].

  2     A resilient surface was not provided beneath and within the fall zone for [ ].


       Sharp, broken and/or jagged edges were observed on the [ ] that pose a threat to the
  2    health, safety or well-being of the children in the play area.
57. Children's Health/Immunization and Records rule 65C-22.006(2)(a)-(c),(3)(c)3. F.A.C. & 402.305,
F.S.
    3    A Student Health Examination/DH Form 3040 or equivalent, was not available
         for the child(ren).
    3    The Student Health Examination/DH Form 3040 was no longer current (over
         two years since last examination) for the child(ren).
    3    A current DH Form 680, Florida Certification of Immunization, was missing for
         the child(ren).
    3    The immunization record was incomplete for the child(ren). The record did not
        document signature of a physician, dates immunizations were administered, or the expiration
        date.
         The parents of children enrolled were not provided information detailing the causes,
   3    symptoms, and transmission of the influenza virus.
60. Background Screening Documents ss. 402.3054(3), 435.04(1), & 435.05(1)(a)(c) F.S., & rule
65C-22.006(4), F.A.C.
   2     Documentation of Level 2 screening was missing for staff.

         A finger print card for the purpose of conducting state/federal criminal records check was
   2     not on file for the employees.

          CF-FSP Form 5131, Background Screening and Personnel File Requirements, was not on
   2     file for the employees.

         The fingerprint card had been completed but was never submitted to FDLE for the
   2     employees.
   2     Verification of employment history for the past 2 years was not on file for the employees.

          Background screening was not completed every five years after the initial screening for
   2     the individuals.
63. Access/Child Abuse or Neglect/Misrepresentation ss. 402.319, F.S. & rule 65C-22.001(9),(11),
F.A.C.

        The owner, operator, employee or substitute, while caring for children, committed an act or
        omission that meets the definition of child abuse or neglect provided in Chapter 39, Florida
   1    Statutes.

         As a mandated reporter, the owner, operator, employee or substitute failed to report
   1    suspected child abuse or neglect as required in section 39.201, Florida Statutes.

        The owner, operator, employee or substitute failed to grant access to the child care facility
   2    during the hours of operation to the licensing authority or parent/legal guardian.

         Child care personnel misrepresented information, impersonated, or provided fraudulent
        information related to the child care facility to a parent/guardian, licensing authority, or law
   1    enforcement.

  • 2. serán aplicadas progresivamente por cada violación a los estándares.    Además, los proveedores recibirán asistencia técnica conjuntamente con cualquier sanción disciplinaria.  Cada violación al estándar tiene asignada una clasificación basada en el tipo o la severidad de las violaciones según lo identificado en el Child Care Facility Standards Classification Summary (el resumen de la clasificación de los estándares para facilidad del cuidado de niño), Forma CF-FSP 5316.

CLASE I –es la más seria, presenta una amenaza inminente (a punto de suceder) a un niño incluyendo abuso o descuido y pudiese causar la muerte o daño serio a la salud, la seguridad o el bienestar de un niño.  CLASE II – menos seria que violaciones de la clase I ya que puede anticiparse que plantea una amenaza a la salud, a la seguridad o al bienestar de un niño, aunque la amenaza no es inminente.  CLASE III – son menos serias que violaciones de Clase I o II y plantea un daño potencial bajo para los niños.

Classrooms of one age group: • Birth through 1 year of age, there must be one staff for every 4 children. • 1 year of age or older, but under 2 years of age, there must be one staff member for every 6 children. • 2 years of age or older, but under 3 years of age, there must be one staff member for every 11 children. • 3 years of age or older, but under 4 years of age, there must be one staff member for every 15 children. • 4 years of age or older, but under 5 years of age, there must be one staff member for every 20 children. • 5 years of age or older, there must be one staff member for every 25 children. Mixed Ratios: • In groups of mixed age ranges, where children under 1 year of age are included, one staff member shall be responsible for no more than 4 children of any age group at all times. • In groups of mixed age ranges, where children 1 year of age but under 2 years of age are included, one staff member shall be responsible for no more than 6 children of any age group at all times. • When children 2 years of age and older are in care, the staff-to-children ratio shall be based on the age group with the number of children within the group. For every 20 children, a child care facility must have one (1) credentialed staff member.

Supervision rule 65C-22.001(5)(a)-(d), 65C-22.001(6)(f), 65C-22.002(4)(c)2. & 65C-22.007 (2), F.A.C. 2 Direct supervision of children in the [ ] group was inadequate in that [ ]. 2 Staff were not within sight and hearing of all the children during nap time. 2 There were insufficient personnel readily accessible to meet ratio requirements during nap time. 2 Children in the outdoor play area were not adequately supervised in that [ ]. 1 A child was unknowingly left behind in a vehicle, at the facility or on a field trip. 1 A child was not adequately supervised and left the facility premises without the knowledge or awareness of staff. 2 In addition to the staff required to meet staff-to-child ratios, an additional adult was not present during a field trip. 1 The operator, employee or substitute was observed supervising children while under the influence of narcotics, alcohol or other drugs that impair the
  • 10. 12. Child Discipline rule 65C-22.001(8)(a)(b), F.A.C. & 402.305(12), F.S. 2 A staff member did not comply with the facility's written discipline policy. A method of discipline was used at the facility that was severe, humiliating or frightening to 1 children in that [ ]. The facility's discipline practices included the use of spanking or other form of physical 2 punishment. 1 A form of discipline used by staff was associated with food, rest and/or toileting.
  • 11. 33. Fire Drills & Emergency Preparedness rule 65C-22.002(7) & rule 65C-22.006(5)(e), F.A.C. Fire drills were not conducted and/or did not include one drill during napping/sleeping times, one drill using alternate evacuation routes, or one in the presence of the licensing 2 authority. The facility operator did not have a current fire safety inspection by the local fire 2 authority. 2 All adults and children failed to evacuate the facility when the fire alarm was activated. The facility operator/staff failed to possess a current attendance record during a fire drill, 2 emergency preparedness drill or an actual emergency. 2 The operator failed to conduct emergency preparedness drills.

Outdoor Equipment rule 65C-22.002(9)(b), F.A.C. 2 The play equipment was not safe for the children to use in that [ ]. 2 A resilient surface was not provided beneath and within the fall zone for [ ]. Sharp, broken and/or jagged edges were observed on the [ ] that pose a threat to the 2 health, safety or well-being of the children in the play area.

F.A.C. & 402.305, F.S. 3 A Student Health Examination/DH Form 3040 or equivalent, was not available for the child(ren). 3 The Student Health Examination/DH Form 3040 was no longer current (over two years since last examination) for the child(ren). 3 A current DH Form 680, Florida Certification of Immunization, was missing for the child(ren). 3 The immunization record was incomplete for the child(ren). The record did not document signature of a physician, dates immunizations were administered, or the expiration date. The parents of children enrolled were not provided information detailing the causes, 3 symptoms, and transmission of the influenza virus.
  • 14. 60. Background Screening Documents ss. 402.3054(3), 435.04(1), & 435.05(1)(a)(c) F.S., & rule 65C-22.006(4), F.A.C. 2 Documentation of Level 2 screening was missing for staff. A finger print card for the purpose of conducting state/federal criminal records check was 2 not on file for the employees. CF-FSP Form 5131, Background Screening and Personnel File Requirements, was not on 2 file for the employees. The fingerprint card had been completed but was never submitted to FDLE for the 2 employees. 2 Verification of employment history for the past 2 years was not on file for the employees. Background screening was not completed every five years after the initial screening for 2 the individuals.
  • 15. 63. Access/Child Abuse or Neglect/Misrepresentation ss. 402.319, F.S. & rule 65C-22.001(9),(11), F.A.C. The owner, operator, employee or substitute, while caring for children, committed an act or omission that meets the definition of child abuse or neglect provided in Chapter 39, Florida 1 Statutes. As a mandated reporter, the owner, operator, employee or substitute failed to report 1 suspected child abuse or neglect as required in section 39.201, Florida Statutes. The owner, operator, employee or substitute failed to grant access to the child care facility 2 during the hours of operation to the licensing authority or parent/legal guardian. Child care personnel misrepresented information, impersonated, or provided fraudulent information related to the child care facility to a parent/guardian, licensing authority, or law 1 enforcement.
