Sample litigation support experience
Professor De Waal assisted former Judge Mostert and senior advocates as an expert financial advisor to defend
a partnership of lawyers prosecuted for irregular use of trust funds. Professor De Waal successfully proved that
funds in the firm’s trust bank account exceeded the total credit balances on individual trust creditors’ accounts of
the firm. However, the partners had invested certain investment trust balances on behalf of and with the
knowledge of investor trust creditors. The court found that the attorneys were not registered as a financial
institution and were judged to have received and applied such trust funds illegally.
Professor De Waal served as an expert witness with a senior advocate of the Cape Bar in a six year long claim
for losses against a firm of attorneys who allowed a third party claim for the death of a bread winner husband in a
motor vehicle accident in the Former Transkei to expire. Based on Professor De Waal’s evidence of the
deceased husband’s probable earnings from electronic gaming machines, before his death, the original claim for
losses was doubled by the claimant’s advocate. When the firm of defending attorneys received notice of
Professor De Waal’s appointment as an expert witness and that the claim had been doubled, they immediately
settled the claim out of court.
Professor De Waal served as an expert witness in a game farm fencing benefit dispute in Mpumalanga. The
presiding magistrate called the claimant’s and defendant’s attorneys into his office before the start of the court
case and stated that he had examined all the court documents. He also stated that, in his opinion, Professor De
Waal’s determination of the benefit received by the defending game farm owner after completely fencing in his
own game farm, from the claimant game farmer’s existing game fence was correct. He advised the attorneys to
settle the benefit dispute based on Professor De Waal’s calculations and avoid further legal costs. This advice
was accepted and the dispute was settled out of court at a quarter of the benefit claimed.
Lecturing Experience
Extensive training of prospective Chartered Accountant (SA) at final undergraduate and post-graduate levels in
core academic disciplines (i.e. Financial and Managerial Accounting and Finance, Auditing and Taxation) on full
time and distance learning programmes at three different tertiary institutions and in major cities in South Africa
and one in Namibia.
Also lectured International Finance to South African students on two UK based MBA-programmes.
Frequently lectured USA graduate recruits at the USA training centre of an international firm of Chartered
Accountants.
