Mental health has been in the news quite a bit lately. Dozens of U.S. states are currently suing Meta for contributing to the youth mental health crisis by inserting addictive features into their products, while the U.S. Surgeon General is touring the nation to bring awareness to the growing epidemic of loneliness and isolation. The country has endured periods of low national morale, such as in the 1970s when high inflation and the energy crisis worsened public sentiment following the Vietnam War. The current mood, however, feels different. Gallup recently reported that national mental health is at an all-time low, with few bright spots to lift spirits.
To better understand how Americans are feeling and their attitudes towards mental health in general, ThinkNow conducted a nationally representative quantitative survey of 1,500 respondents and found some interesting differences among ethnic, age and gender groups.
Technology
For example, 52% agree that technology and social media have a negative impact on mental health, but when broken out by race, 61% of Whites felt technology had a negative effect, and only 48% of Hispanics thought it did.
While technology has helped us keep in touch with friends and family in faraway places, it appears to have degraded our ability to connect in person. Staying connected online is a double-edged sword since the same news feed that brings us pictures of the grandkids and fluffy kittens also feeds us news about the wars in Israel and Ukraine, the dysfunction in Washington, the latest mass shooting and the climate crisis.
Hispanics may have a built-in defense against the isolation technology breeds, owing to their large, multigenerational households, strong social support systems, and tendency to use social media to stay connected with relatives abroad.
Age and Gender
When asked how individuals rate their mental health, men rate it higher than women by 11 percentage points, and Baby Boomers rank it highest at 83%, saying it’s good or excellent vs. 57% of Gen Z saying the same.
Gen Z spends the most amount of time on social media, so the notion that social media negatively affects mental health appears to be correlated. Unfortunately, Gen Z is also the generation that’s least comfortable discussing mental health concerns with healthcare professionals. Only 40% of them state they’re comfortable discussing their issues with a professional compared to 60% of Millennials and 65% of Boomers.
Race Affects Attitudes
As seen in previous research conducted by ThinkNow, Asian Americans lag other groups when it comes to awareness of mental health issues. Twenty-four percent of Asian Americans believe that having a mental health issue is a sign of weakness compared to the 16% average for all groups. Asians are also considerably less likely to be aware of mental health services in their communities (42% vs. 55%) and most likely to seek out information on social media (51% vs. 35%).

Creative operations teams expect increased AI use in 2024. Currently, over half of tasks are not AI-enabled, but this is expected to decrease in the coming year. ChatGPT is the most popular AI tool currently. Business leaders are more actively exploring AI benefits than individual contributors. Most respondents do not believe AI will impact workforce size in 2024. However, some inhibitions still exist around AI accuracy and lack of understanding. Creatives primarily want to use AI to save time on mundane tasks and boost productivity.
Organizational culture includes values, norms, systems, symbols, language, assumptions, beliefs, and habits that influence employee behaviors and how people interpret those behaviors. It is important because culture can help or hinder a company's success. Some key aspects of Netflix's culture that help it achieve results include hiring smartly so every position has stars, focusing on attitude over just aptitude, and having a strict policy against peacocks, whiners, and jerks.

2 Wstęp
Przeprowadzenie spadku po zmarłym członku rodziny to jedna z czynności prawnych,
którą każdy musi dokonać przynajmniej raz w życiu. Czynność ta jest ważna z tej
przyczyny, że porządkuje stosunki własnościowe między spadkobiercami pozostawionymi
przez spadkodawcę.
Przykład
Jan i Barbara odziedziczyli nieruchomość po swoim ojcu Adamie, który uprzednio
odziedziczył tę nieruchomość po swoim ojcu Jerzym. Jednak Adam nie przeprowadził
spadku po swoim ojcu Jerzym wskutek czego w księdze wieczystej prowadzonej dla
nieruchomości nadal figuruje Jerzy zamiast Adama. W takiej sytuacji Jan i Barbara muszą
przeprowadzić dwa postępowania spadkowe: jedno w którym sąd stwierdzi, że spadek po
Jerzym nabył Adam i drugie, w którym sąd stwierdzi, iż spadek po Adamie nabyli:
Barbara i Jan. Gdyby Adam nie zaniedbał przeprowadzenia spadku stosunki
własnościowe dotyczące nieruchomości byłyby bardziej przejrzyste, a jego dzieci nie
musiałyby przeprowadzać aż dwóch postępowań spadkowych, gdyż wystarczyłoby
stwierdzenie nabycia spadku po ojcu. Wówczas Jan i Barbara szybciej uzyskaliby, np. wpis
prawa własności do księgi wieczystej nieruchomości, co byłoby szczególnie ważne, gdyby
mieli zamiar szybkiego sprzedania odziedziczonej nieruchomości.
Przytoczony przykład obrazuje jak istotne dla spadkobierców jest uporządkowanie prawa
własności przedmiotów wchodzących w skład spadku po zmarłym spadkodawcy.
Niniejszy poradnik zawiera kompleksowy zbiór zasad postępowania ze spadkiem i ma na
celu ułatwienie spadkobiercom uporządkowania stosunków własnościowych po zmarłym
członku rodziny. Napisany został językiem przystępnym dla osób nie posiadających
wykształcenia prawniczego, by mogły we własnym zakresie dokonać odpowiednich
czynności spadkowych bez konieczności korzystania z pomocy adwokata lub radcy
prawnego.

spadku?
I. Wniosek o stwierdzenie nabycia spadku
Pierwszym krokiem, jaki powinni wykonać spadkobiercy zmarłego jest ustalenie, czy
spadkodawca pozostawił testament czy też nie, gdyż od tego zależy dalszy tryb
postępowania spadkowego, a szczególnie treść wniosku, który należy skierować do sądu
oraz to, kto będzie dziedziczył.
Jeśli spadkodawca nie pozostawił testamentu, którykolwiek ze spadkobierców
należących do kręgu spadkobierców ustawowych (małżonek zmarłego, jego dziecko,
rodzice lub rodzeństwo) powinien złożyć w sądzie wniosek o stwierdzenie nabycia
spadku po zmarłym z mocy ustawy (rozdział 12, wzór nr I). Wniosek taki należy w myśl
art. 628 K.p.c. skierować do sądu spadku, tj. sądu rejonowego wydziału cywilnego,
w którego okręgu zmarły spadkodawca miał ostatnio miejsce zamieszkania. Miejsce
zamieszkania – zgodnie z art. 25 K.c. – należy rozumieć jako miejscowość, w której
zmarły ostatnio przebywał z zamiarem stałego pobytu. Ważne jest, by we wniosku
o stwierdzenie nabycia spadku podać miejsce zamieszkania zmarłego, by sąd mógł ocenić
swoją właściwość do rozpoznania sprawy. Jeśli takie miejsce nie zostanie podane, sąd
wezwie osobę składającą wniosek o uzupełnienie braków w terminie 7 dni pod rygorem
zwrotu wniosku, co wydłuży postępowanie.
Przykład 1
Córka Barbara mieszkająca w Krakowie chce złożyć wniosek o stwierdzenie nabycia
spadku po jej zmarłym ojcu Janie, który ostatnio mieszkał stale w Płocku. Powinna zatem
złożyć wniosek w Sądzie Rejonowym w Płocku wskazując, że ojciec mieszkał w okręgu
tego sądu.
Jeśli zmarły spadkodawca nie miał miejsca zamieszkania w Polsce, wniosek należy
skierować do sądu rejonowego, w którego okręgu znajduje się majątek spadkowy lub
przynajmniej jego część. Jeśli majątek spadkowy znajduje się w okręgu kilku sądów
rejonowych, osoba, która składa wniosek o stwierdzenie nabycia spadku może skierować
go do jednego (wybranego przez siebie) z tych sądów rejonowych.
Przykład 2
Syn Jan chce złożyć wniosek o stwierdzenie nabycia spadku po ojcu, który od wielu lat

Kiedy i w jaki sposób należy dokonać stwierdzenia nabycia spadku?
stale mieszkał w Kanadzie, a w Krakowie zostawił nieruchomość, którą od lat
wynajmował. Syn powinien złożyć wniosek w Sądzie Rejonowym w Krakowie, gdyż tu
znajduje się majątek spadkowy, a zmarły nie miał miejsca zamieszkania w Polsce.
Jeśli natomiast nie można ustalić, gdzie w Polsce spadkodawca miał miejsce zamieszkania
ani też, gdzie w Polsce znajduje się jego majątek spadkowy, wówczas wniosek
o stwierdzenie nabycia spadku należy kierować do Sądu Rejonowego dla miasta
stołecznego Warszawy.
Jeśli spadkodawca pozostawił testament pisemny wówczas przed stwierdzeniem nabycia
spadku musi on zostać otwarty i ogłoszony, a w przypadku sporządzenia testamentu
ustnego ogłasza się napisane przez świadka pismo stwierdzające treść tego testamentu.
Otwarcia i ogłoszenia dokonuje sąd spadku, którym jest wskazany powyżej sąd rejonowy.
Do złożenia testamentu lub pisma stwierdzającego treść testamentu ustnego w sądzie
spadku zobowiązany jest każdy, u kogo te dokumenty się znajdują (rozdział 12, wzór
nr II). Sąd na posiedzeniu niejawnym sporządza protokół z otwarcia i ogłoszenia
testamentu, po czym zawiadamia o tym fakcie osoby wskazane w treści testamentu, czyli
spadkobierców. Sąd ogłasza tyle testamentów, ile sporządził zmarły spadkodawca. Celem
otwarcia i ogłoszenia jest bowiem poznanie treści ostatniej woli zmarłego. Sąd nie bada
na tym etapie postępowania, czy testament jest ważny. Czyni to dopiero na dalszym
etapie, tj. po złożeniu wniosku o stwierdzenie nabycia spadku po zmarłym na podstawie
testamentu. Wówczas też decyduje na podstawie którego z kilku testamentów stwierdzić
nabycie spadku. Jeśli sam spadkobierca jest w posiadaniu testamentu, może złożyć
wniosek o stwierdzenie nabycia spadku na podstawie testamentu jednocześnie
z wnioskiem o jego otwarcie i ogłoszenie (rozdział 12, wzór nr II i III).
Przykład 3
Zmarły Jan zostawił testament własnoręczny, w którym powołał do spadku swojego syna
Adama. Testament znajdował się u ciotki zmarłego, Reginy. W takiej sytuacji po śmierci
Jana na Reginie ciąży obowiązek złożenia testamentu w sądzie spadku celem jego
otworzenia i ogłoszenia. Sąd spadku o otwarciu i ogłoszeniu testamentu zawiadomi
Adama, gdyż został on wskazany w treści testamentu. W ten sposób Adam dowie się
o istnieniu testamentu, jeśli o tym nie wiedział wcześniej i będzie mógł złożyć wniosek
o stwierdzenie nabycia spadku na swoją rzecz na podstawie testamentu. Gdyby powołany
do spadku syn Adam był w posiadaniu testamentu, mógłby już w chwili śmierci swojego
ojca złożyć jednocześnie wniosek o stwierdzenie nabycia spadku na podstawie
testamentu oraz wniosek o otwarcie i ogłoszenie testamentu, załączając ten testament,
a także pozostałe dokumenty wymienione w załącznikach wniosku o stwierdzenie

Kiedy i w jaki sposób należy dokonać stwierdzenia nabycia spadku?
nabycia spadku na podstawie testamentu (rozdział 12, wzór nr II i III). Ponadto Adam
powinien załączyć jedną opłatę w wysokości 50,- zł od wniosku o stwierdzenie nabycia
spadku, gdyż od wniosku o ogłoszenie testamentu nie uiszcza się opłaty. W sytuacji,
gdyby ciotka Regina będąca w posiadaniu testamentu nie chciała go ujawnić lub
zwlekała z jego złożeniem do sądu spadku, a syn Adam wiedziałby o istnieniu testamentu,
mógłby składając wniosek o stwierdzenie nabycia spadku złożyć jednocześnie do sądu
spadku wniosek o zobowiązanie ciotki na podstawie art. 647 i 648 K.p.c. do złożenia
testamentu w sądzie spadku (rozdział 12, wzór IV). Sąd spadku wówczas wezwie ciotkę
do stawienia się w sądzie pod rygorem grzywny w celu przesłuchania jej co do faktu
posiadania testamentu. Jeśli okaże się, że testament jest w jej posiadaniu, sąd zobowiąże
ją do wydania.
Dopóki testament nie zostanie otwarty i ogłoszony, nie może zostać wydane na jego
podstawie postanowienie o stwierdzeniu nabycia spadku. Należy podkreślić, iż sąd
spadku może – zgodnie z art. 646 § 2 K.p.c. – nałożyć grzywnę na każdą osobę, która
posiada testament i nie wyda go w terminie zakreślonym przez ten sąd. Poza tym osoba
taka może odpowiadać wobec spadkobiercy za szkodę wynikłą z bezzasadnego uchylania
się od obowiązku wydania testamentu, który powstaje w momencie, gdy posiadacz
testamentu dowiedział się o śmierci spadkodawcy. Jeśli spadkodawca sporządził
testament ustny, a świadkowie tej czynności nie spiszą treści testamentu, wówczas
spadkobierca, który wie, że ostatnią wolą zmarłego było, np. pozostawienie mu całego
majątku, powinien złożyć do sądu spadku wniosek o przesłuchanie świadków co do
treści ustnego testamentu (rozdział 12, wzór nr V). Wniosek taki jest wolny od opłat
sądowych i można go połączyć wraz z wnioskiem o stwierdzenie nabycia spadku na
podstawie testamentu ustnego.

dziedziczenia?
Do dziedziczenia można być powołanym w myśl art. 926 K.c. na podstawie testamentu
lub ustawy. Dziedziczenie z ustawy następuje wtedy, gdy zmarły spadkodawca nie
pozostawił testamentu lub napisany przez niego testament okazał się, np. nieważny lub
osoba, która została wskazana w testamencie jako spadkobierca nie chce, czy też nie
może dziedziczyć, np. odrzuciła spadek, zmarła przed spadkodawcą.
I. Dziedziczenie z ustawy
W pierwszej kolejności – zgodnie z art. 931 § 1 K.c. – powołane z ustawy do spadku są
dzieci spadkodawcy, zarówno małżeńskie, jak też pozamałżeńskie oraz małżonek
zmarłego. Dziedziczą oni w częściach równych, ale udział małżonka nie może być nigdy
mniejszy niż 1/4 całości spadku. Oznacza to, że zasada dziedziczenia przez małżonka
i dzieci w częściach równych jest zachowana tylko w przypadku, gdy dziedziczy małżonek
i nie więcej niż troje dzieci, gdyż wówczas każdy z nich otrzymuje 1/4 część spadku.
Przykład 1
Po zmarłym Adamie dziedziczy małżonka Anna i córka Kasia, a zatem każda otrzyma 1/2
część.
Przykład 2
Po zmarłym Adamie dziedziczy małżonka Anna i 5 dzieci, a zatem Anna otrzyma 1/4
część, a dzieci po 3/20 części.
Jeśli dziecko spadkodawcy nie dziedziczy, gdyż np. nie dożyło otwarcia spadku lub
odrzuciło spadek, udział spadkowy, który by mu przypadał, przypada jego dzieciom
w częściach równych.
Przykład 3
Zmarły spadkodawca Adam pozostawił wdowę Annę, z którą miał córkę Kasię, syna
Grzegorza, syna Artura i syna Jana. Syn Grzegorz zmarł wcześniej niż Adam jako kawaler
i nie miał dzieci. Syn Artur zmarł przed swoim ojcem Adamem, nie miał dzieci
i pozostawił jedynie swoją małżonkę Małgorzatę, która żyje. Córka Anna żyje, jest
mężatką i ma dwoje dzieci. Syn Jan również zmarł wcześniej niż jego ojciec Adam, ale

Kto dziedziczy, a kto może być uznany za niegodnego dziedziczenia?
żyją jego dzieci: syn Franek i córka Basia oraz małżonka Felicja. Małżonka zmarłego
Anna będzie dziedziczyć. Syn Grzegorz zmarł przed swoim ojcem nie pozostawiając
dzieci, zatem nie może po nim dziedziczyć i należy go pominąć przy ustalaniu kręgu
spadkobierców. Z tego samego powodu należy pominąć syna Artura. Wprawdzie
pozostawił on małżonkę Małgorzatę, ale ona nie może być powołana do dziedziczenia po
swoim teściu Adamie. Syn Jan także nie może nabyć spadku po ojcu, gdyż zmarł przed
nim. Zamiast niego będzie dziedziczyć dwójka jego żyjących dzieci: syn Franek i córka
Basia, między których zostanie podzielony w częściach równych udział, który by
przypadał ich ojcu Janowi, gdyby przeżył ich dziadka Adama. Małżonka Felicja nie
dziedziczy po swoim teściu Adamie. Córka Kasia dziedziczy. W rezultacie spadek nabędą:
małżonka Anna w 1/3 części, córka Kasia w 1/3 części oraz Franek i Basia po 1/6 części
każdy z nich (udział ich zmarłego ojca Jana wynosiłby 1/3, co należy podzielić na dwoje
równych części).
Jeśli zmarły spadkodawca nie pozostawił dziecka lub pozostawił, ale odrzuciło ono spadek
czy zostało uznane za niegodne dziedziczenia czy zrzekło się dziedziczenia w drodze
umowy, wówczas dziedziczą po nim w myśl art. 932 K.c.: małżonek, rodzice i rodzeństwo.
Małżonek jest tutaj uprzywilejowany, gdyż jego udział spadkowy zawsze wynosi 1/2 część,
a pozostała połowa przypada rodzicom i rodzeństwu. Jednak rodzice są obok małżonka
również uprzywilejowani, gdyż w myśl art. 933 K.c., jeśli są powołani do spadku razem
z rodzeństwem zmarłego, udział każdego z nich wynosi 1/4 część tego, co przypada
łącznie dla rodziców i rodzeństwa.
Przykład 4
Spadkodawca Adam zginął w wypadku samochodowym miesiąc po ślubie. Zostawił
małżonkę Annę. Nie miał dzieci i jego małżonka nie była w ciąży w dniu wypadku. Żyją
rodzice Adama. Zmarły był jedynakiem. Spadek po Adamie odziedziczą zatem: małżonka
Anna w 1/2 części oraz rodzice po 1/4 części każde z nich.

5 Testament
Testament jest wygodną formą rozporządzenia majątkiem na wypadek śmierci.
Sporządzenie tej czynności jest proste i niedrogie. Testament warto napisać przede
wszystkim w dwóch przypadkach:
– wtedy, gdy chcemy, by dziedziczyły po nas inne osoby niż te, które są uprawnione
do dziedziczenia na podstawie Kodeksu cywilnego, a zatem: małżonek, dzieci,
wnuki, rodzice lub rodzeństwo,
– wtedy, gdy chcemy, by nasz majątek przypadł po naszej śmierci tylko jednej
osobie lub tylko niektórym osobom spośród uprawnionych do dziedziczenia
według Kodeksu cywilnego, np. chcemy by dziedziczyła tylko żona, ale już nie
dzieci albo chcemy, by dziedziczyli rodzice, ale już nie rodzeństwo.
I. W jaki sposób sporządzić testament?
Osoba sporządzająca testament nazywana jest w języku prawniczym testatorem. Takim
testatorem może być każdy z nas, ale pod następującymi warunkami:
a) należy mieć pełną zdolność do czynności prawnych, co oznacza, iż nie może
sporządzić testamentu osoba, która w chwili sporządzenia testamentu jest
ubezwłasnowolniona lub niepełnoletnia – art. 944 § 1 K.c.,
b) jeden testament może sporządzić jedna osoba, co oznacza, że prawo polskie nie
zna testamentu wspólnego i nawet małżonkowie, którzy posiadają wspólny
majątek, który chcą pozostawić temu samemu spadkobiercy, np. córce, muszą
napisać dwa odrębne testamenty pomimo, iż w praktyce będą one miały
identyczną treść – art. 942 K.c.,
c) testament można sporządzić tylko osobiście tzn. osobiście go napisać lub
oświadczyć ostatnią wolę ustnie albo osobiście stawić się u notariusza, nie można
dokonać tej czynności przez swojego przedstawiciela – art. 944 § 2 K.c.

Zachowek
6 Zachowek
Zachowek jest formą rekompensaty dla tych osób, które mogłyby dziedziczyć po zmarłym
jako spadkobiercy ustawowi, ale nie dziedziczą, gdyż spadkodawca pozostawił testament,
w którym powołał do spadku inną osobę.
I. Kto i w jakiej formie może otrzymać zachowek?
Zachowek należy się: zstępnym zmarłego (jego dzieciom, wnukom, prawnukom),
małżonkowi zmarłego oraz jego rodzicom pod warunkiem, że byliby oni powołani do
spadku po zmarłym z mocy ustawy (rozdział 4), gdyby spadkodawca nie pozostawił
testamentu. Zachowek nie należy się rodzeństwu zmarłego pomimo, że jest ono zaliczane
do kręgu spadkobierców ustawowych.
Przykład 1
Zmarły Jan w testamencie pozostawił cały swój majątek przyjaciółce Annie. Pozostały po
nim dzieci z małżeństwa z Marią. Żyje również jego żona Maria i matka Barbara oraz
siostra Regina. Spadek nabędzie Anna na podstawie testamentu. W sytuacji, gdyby Jan
nie pozostawił testamentu, spadek z mocy ustawy nabyliby: jego żona Maria i dzieci,
dlatego mają prawo domagać się od Anny wypłaty zachowku. Matka zmarłego nie
doszłaby do dziedziczenia, gdyż są dzieci zmarłego, dlatego zachowek się jej nie należy.
Zachowek może być wypłacony wyłącznie w formie kwoty pieniężnej, a nigdy w formie
rzeczowej, np. w postaci przedmiotu wchodzącego w skład spadku. Osoba uprawniona do
zachowku, której zmarły nie powołał do dziedziczenia w testamencie, nie zawsze jednak
fizycznie go otrzyma. Jeśli bowiem spadkodawca zapisał w testamencie jakąś rzecz ze
spadku osobie uprawnionej do zachowku lub uczynił na jej rzecz za życia darowiznę
w wysokości odpowiadającej wysokości należnego zachowku, wówczas osoba ta może nie
otrzymać zachowku lub otrzyma tylko kwotę potrzebną do jego uzupełnienia.

Wnoszę o przesłuchanie Barbary Nowak i Zofii Malinowskiej, które są świadkami testamentu ustnego,
sporządzonego przez ojca wnioskodawcy Emila Kowalskiego, zmarłego dnia 4 stycznia 2004 roku
w Krakowie.
Uzasadnienie
W dniu 4 stycznia 2004 r. zmarł Emil Kowalski ostatnio zamieszkały w Krakowie. Spadkodawca Emil
Kowalski zmarł jako wdowiec. Pozostawił po sobie jedynego syna Jana Kowalskiego.
Dowód: odpis skrócony aktu zgonu
W obliczu zbliżającej się śmierci ustnie oświadczył, iż cały swój majątek pozostawia swojemu jedynemu
synowi, wnioskodawcy Janowi Kowalskiemu. Świadkami tego były pielęgniarki: Barbara Nowak, Zofia
Malinowska oraz lekarz Piotr Nowak. Żaden ze świadków nie spisał dotychczas ostatniej woli zmarłego.
Przesłuchanie świadka Piotra Nowaka jest obecnie niemożliwe, gdyż będąc w Szwajcarii na nartach uległ
wypadkowi i leży w tamtejszym szpitalu w stanie śpiączki.
Dowód: przesłuchanie świadków: Barbary Nowak, Zofii Malinowskiej
Wniosek w tym stanie sprawy jest uzasadniony.
