On January 18th 2019, the "Uspishna Varta" human rights platform received permission from the Central Election Commission (hereinafter - the CEC) to have its official election observers.
Observation is carried out via the work of more than 100 long-term and short-term observers in constituencies; interviews with representatives of candidate headquarters, election commissions, the media community, and the public sector; the collection of information from public sources of information.
This report was formed following the results of observation for the period of 1st-28th March 2019 in order to inform the Ukrainian and international community about the course of the electoral process in Ukraine and violations that may affect the free will of citizens and the election's result.

An anti-corruption court has not yet been established and is unlikely to work until 2020 (according to the presidential bill, 1 year is envisaged for its formation).
The amounts of funds returned to the NABU and SAP in the treasury do not cover the costs of their maintenance.
The percentage of convictions that came into force is 19.7% of the number of cases transferred to the NABU in court.
Out of 423 people's deputies, in just two years, 11 electronic declarations were submitted to NAPC.
Places in international anti-corruption ratings remain steadily low, and Western partners are unhappy with the progress of fighting corruption and attacks on anti-corruption activists.

SYSTEMIC REPORT "ABUSES AND PRESSURE INFLICTED BY LAW ENFORCERS ON BUSINESS"Iaroslav GREGIRCHAK
In the Business Ombudsman Council's Systemic Report "Abuses and Pressure of Law Enforcers on Business" the Council's team led by Iaroslav Gregirchak, the Deputy Business Ombudsman, comprehensively examined the most common malpractices at the part of law enforcers and developed a set of 27 recommendations to the Ministry of Justice of Ukraine, the General Prosecutor’s Office of Ukraine and the Ministry of Internal Affairs of Ukraine.
The document commences by examining problems related to the stage when criminal proceedings are being launched. The Report advocates the need for digitalization of the way the data is entered with the Unified State Registry of Pre-Trial Investigations (USRPI). Thereafter it updates the Council’s earlier recommendations aimed at alleviating pressure inflicted on business through (i) groundless launching of criminal proceedings based on allegations of tax evasion; as well as (ii) groundless denial to launch criminal proceedings.
The next chapter is focused on an inefficient (delayed) course of pre-trial investigation. The document commences by concentrating on (i) criminal proceedings launched prior to March 15, 2018, in whose regard the Criminal Procedural Code does not set forth deadlines of pre-trial investigation, thus resulting in such criminal proceedings becoming a convenient tool for inflicting pressure on business. While drawing attention to the lack of proper access to selected information about the course of pre-trial investigation, the Report calls for the need to simplify both suspect’s and victim’s access to the USRPI. Afterwards the document advocates vesting the defence and injured party with the right to independently lodge motions with prosecutor or investigatory judge seeking extension of terms of pre-trial investigation. The chapter ends by focusing on the taxonomy of problems stemming from the current state of legal framework governing use of court-ordered/forensic expert examinations.
In the subsequent chapter discussing procedural abuses in course of pre-trial investigations, the Report concentrated on the following taxonomy of this problem: (i) illicit retention of arrested property; (ii) transfer of materials of criminal proceedings from one body of pre-trial investigation to another; and (iii) practice of reiterative arrests. The Report ends with a comprehensive chapter focused on disciplinary liability of investigators and prosecutors.

The first speaker, Olga Mazina, Head of Tax Consulting, talked about the taxation changes anticipated in 2017. Olga outlined the changes in the taxation of electronic services supplied by foreign providers, as well as the upcoming changes in transfer pricing and other significant changes in tax and accounting regulations.
Corruption, Russia, Procuracy. A law review article co-authored with Mary Holland of NYU Law will be appearing in Columbia Journal of East European Law. The presentation has been given at University of Toronto and elsewhere.

The DoPT, vide their circular No 1/5/2016-IR dated 31 Mar 2017, has invited suggestions from the public on the proposed RTI Rules, 2017 attached to it. These rules have nothing in them to ensure compliance of the law by PIOs, FAAs and ICs and are obviously intended to make it more difficult for information seekers to access information and easy for public servants to avoid providing them. If anything these proposals only expose the public servants who have drafted them and approved them for circulation as idiots and traitors!
Under the circumstances it has become necessary to draft an entirely independant set of rules for the effective implementation of the RTI Act in keeping with its objectives- for setting out the practical regime of right to information for citizens to secure access to information under the control of public authorities, in order to promote transparency and accountability in the working of every public authority and also to contain corruption and to hold Governments and their instrumentalities accountable to the governed- as stated in its preamble.

Monthly summary of key policy developments in Poland (for June/July 2014)
The "tape scandal" resulted in no changes in the government (yet), but the support for Donald Tusk's government dropped. The main opposition party, Jaroslaw Kaczynski's PiS (Law and Justice) leads polls with 35% of support. PO (ruling Civic Platform) has only 23%. SLD (the Left) has 8% and New Right - 5%. The second coalition party, PSL, has only 4% of support - therefore wouldn't make it to the parliament if that is the result of elections.
The second result of the "tape scandal" is a consolidation of the right part of the political scene; Law and Justice finally signed the agreement with Zbigniew Ziobro's Solidarna Polska and Jaroslaw Gowin's Polska Razem. While not changing anything in polls, this move prevents the division of votes in the November local election between very similar parties. Zbigniew Ziobro was in past the very popular right-wing politician, who left PiS few years ago. Jaroslaw Gowin is the conservative liberal, former member of Civic Platform and former minister of justice in Donald Tusk's government. His economical views are completely different to those presented by Law and Justice.
The last session of parliament before summer holidays begins today. Therefore the next issue of Warsaw Insight will be published in two months. In case of important events in between, we will distribute the "alert" with a summary and analysis of the change.

The paper briefly discusses the main economic developments in Poland since its accession to the EU in May 2004 and sees how they relate to the regulatory environment and policies which the EU imposes on the member states. Even though the paper concerns the recent period of 2004-2006 there are frequent references to developments that took place in Poland in the pre-accession period. This is because the country’s integration into the EU economy was a gradual and lengthy process which had formally been initiated in December 16, 1991 when Poland and the EU signed the Europe Agreement.

El informe CPPI utiliza dos enfoques metodológicos diferentes para calcular la clasificación del índice: uno administrativo o técnico y otro estadístico, basado en análisis factorial (FA). Según los autores, esta dualidad pretende asegurar una clasificación que refleje con precisión el rendimiento real del puerto, a la vez que sea estadísticamente sólida. shift in Polish public debate. At the elections
day, the major victory of the main opposition
party was announced (based on exit polls). Due
to technical difficulties, it took a week to an-nounce
official results - and the expected vic-tory
of Law and Justice (PiS) was not so big
anymore. Additionally, due to low coalition ca-pabilities
of Law and Justice, PiS was able to
get the power only in one voivodeship - in Pod-karpackie
region - and no major city. The rest
of regions is dominated by the coalition of Civic
Platform (PO) and Peasants’ Party (PSL).
The final result of the vote for members of local
parliaments is as follows:
Law and Justice (PiS) - 26.85% (171 seats) Civ-ic
Platform (PO) - 26.36% (179 seats) Peasant’s
Party (PSL) - 26.68% (157 seats) The Left (SLD)
- 8,78% (28 seats)
The second left party, Janusz Palikot’s Your Move
(TR) and the right-wing Janusz Korwin Mikke’s
KNP didn’t get any places in local parliaments.
Due to differences in sizes of local parliaments
in various regions, the number of seats taken by
Civic Platform is bigger that the number of the
winning Law and Justice.
No mainstream political party has visible major-ity
in local authorities (except for 16 local par-liaments).
81% of executive power is in hands of
local committees, not affiliated with any party.
As a result of prolonging vote counting and a dif-ference
between exit polls and the final results,
the chief of PiS accused the ruling coalition of
ballot rigging and called its supporters to march
that will take place on December 13th, the an-niversary
of the 1981 communist martial law.

Council of Ministers appointed Wojciech Kowal-czyk
as government representative responsible
for restructuring the coal mining industry (with
the rank of Secretary of State in the Ministry of
Economy). His most important task will be to
prepare concept of the mining industry and the
coordination and monitoring activities related to
the transformation. Wojciech Kowalczyk was as-sociated
with the financial market, as of 2012,
he was Secretary of State in the Ministry of Fi-nance
is responsible for the supervision of finan-cial
market and financial institutions. Since June
2014, he served as undersecretary of the Ministry
of Treasury.

Tomasz Orłowski was dismissed from the position
of Deputy Minister for Eastern affairs at the For-eign
Ministry.

coalition - is not necessary to be repeated in par-liamentary
elections. The history of previous elec-tions
indicated that the PSL has always a relative-ly
good position in local elections that does not
directly converts to the good result in following
parliamentary elections. PSL, as one of most active
players on local ground, has a very strong position
in local administration - when people generally
vote for people they know. The situation is differ-ent
in parliamentary elections, when most of can-didates
with the biggest chance of winning (that is
- with first positions on voting lists) are either peo-ple
from “central politics” or complete outsiders.
Moreover, the profile of typical local voter differs
from the typical voter in parliamentary elections.
The very weak result of SLD (the post-communist
party) is a major warning signal for the party that
they are too close to the ruling Civic Platform.
Many months of good relations between PO and
SLD resulted in switching former voters of SLD to
PO or abstaining during the elections. In effect,
the first steps of SLD’s leader (recently expected
to join PO-PSL coalition next year) after the elec-tions
were the meeting with Jarosław Kaczyński
of Law and Justice. The meeting was received
very badly by SLD’s voters and further decreased
the support for the party.

The clause is legal solution applied to taxpayers
making fictitious economic activities and create
artificial legal structures that bring significant tax

the changes envisaged in the draft amendment to
the Act - Tax Ordinance.
