Terms of Agreement
All services and materials which we may be contracted to provide for you will be subject to the
provisions in this agreement. We will begin work when signed confirmation of this proposal or a
purchase order is received from the Client.
Estimates.
The fees and expenses shown are minimum estimates only. Final fees and expenses shall be shown
when invoice is rendered. Client’s approval shall be obtained for any increases in fees or expenses
that exceed the original estimate by 10% or more.
Revisions or Alterations.
Client shall be responsible for making additional payments for changes requested by Client in original
assignment. This includes additional copywriting, design, photography or artwork; or alterations thereof.
Expenses.
Client shall reimburse M + M Design for all expenses arising from the assignment, including
out-of-pocket charges such as shipping, delivery, postage, and the payment of any sales taxes.
Rights.
Any design ideas which are not accepted by the Client become the property of M + M Design.
Rights to all images, artwork, and electronic files created by M + M for use by Permatex shall become
the exclusive property of Permatex. M + M reserves the right to use of the material for self-promotional
purposes only such as our Web Site, or as part of a press release or other promotional material.
Rights to use of the material pursuant to this agreement is conditional upon receipt of payment in full.
Cancellation.
In the event of cancellation of this agreement, a cancellation fee for the work completed based on
the percentage of completion of the job at the time of cancellation as well as payment for all out-of-
pocket expenses incurred to the date of cancellation shall be paid by Client.
Terms of Payment.
A signed confirmation of this agreement or a purchase order, and a 50% deposit of $ 7,346.50 is
requested to begin work on the project. The balance will be invoiced upon completion and delivery
of the final files. Failure of the Client to make payment to M + M Design as provided shall constitute
a breach of this agreement by the Client. In the event of any dispute arising under the terms or
conditions related to this agreement, M + M Design shall be entitled to recover all costs incurred
including reasonable attorney’s fees. In the event either party institutes legal proceedings in
connection with or for the enforcement of the agreement, the prevailing party shall be entitled
to recover its’ cost of suit, including reasonable attorney’s fees.

Cynosure manufactures and distributes lasers and light sources for medical
and aesthetic use. Our lasers are used for laser hair removal, non-ablative skin
treatment, laser removal of veins, birthmarks, scars, stretch marks, redness,
pigmented lesions, tattoos and skin resurfacing. Our lasers also treat diseases
