Brennan & Clark, a commercial collection agency based in Illinois, has supported charities including MADD for over 30 years. Recently, MADD representatives testified before New Jersey lawmakers to support legislation requiring ignition interlocks for all individuals convicted of drunk driving, not just repeat offenders. If passed, the new law would require first time offenders with a BAC of .08 to .14 to use interlock devices for 3 to 12 months, strengthening the state's efforts to reduce alcohol-related traffic deaths.
Ever wonder why you pay so much local and excise taxes when you rent a car while traveling? It is because the large national rental car companies stopped supporting state rental car associations according to a Wall Street Journal article in November, 2005. The article said, “The flurry of taxation is partly due to the fact that the rental-car industry's trade association was dissolved in June, leaving it with no effective lobby. The industry is notoriously fractious, making it harder for companies to jointly combat tax increases.” This led to some 44 rental-car tax proposals in various states up from only three the year before they abandoned their support of their associations. This played out again in the Maryland legislature during the sales tax flurry in 2007 when the legislature passed new taxes on computer services and landscapers. They both were not represented by associations.
MACPA has been advocating for Maryland CPAs since the passage of the first Accountancy laws in 1900. We work at the federal, state, and state board of accountant levels to pass proactive legislation that enhances the ability of CPAs to work and practice in Maryland and to stop bad bills that will inhibit the ability of CPAs to work and practice in Maryland.
This year we are facing a significant challenge as we face an election predicted to cause over 40% turnover in the 188 seats in Maryland's General Assembly along with a new governor, attorney general and most likely a new secretary of the DLLR that oversees our state board of public accountancy.
This presentation is a call to action for our members and firms to support these efforts and ensure another decade of positive impact.

This presentation compares the relative lack of innovation in law with the record of robust innovation in other fields, and describe how ethics standards restricting the unauthorized practice of law, non-lawyer ownership of law firms (Model Rule 5.4(b), (d)), and sharing of legal fees with non-lawyers (Model Rule 5.4(a) are holding back innovation. In other fields, industrial scale production creates commoditized products and services at radically lowered per-unit costs, greatly increasing the number of people who can afford those products and services. (Compare the high price of bespoke clothing with the low price of off-the-rack manufactured clothes.) By contrast, a significant portion of legal services are bespoke rather than commoditized, and thus are available at relatively high prices that few individuals can afford. A recent study showed that 76 percent of cases in state courts involve at least one party who is not represented by counsel. The law has seen little of the kind of innovation that would make legal services available at prices individuals can afford. To the degree that our “ethics” standards stand in the way of such innovation, they need to be reexamined.

MADD Testifies in Support of New Jersey Legislation

2. Based in Villa Park, Illinois, Brennan & Clark, Ltd., is a full-
service commercial collection agency that has been in
operation since 1980. Dedicated to giving back to the
community, Brennan & Clark supports the work of several
charities and nonprofit groups, including Mothers Against
Drunk Driving (MADD).
Recently, MADD representatives testified before New
Jersey lawmakers in support of legislation requiring
ignition interlocks for every individual convicted of driving
under the influence. Similar to a breathalyzer, ignition
interlocks are mechanisms that can analyze blood alcohol
concentration (BAC).
3. The devices are installed into a vehicle’s dashboard and
prevent its motor from starting until a clean breath sample
is provided. Interlocks have been proven to reduce repeat
offenses, and states that have all-offender interlock laws
have seen major reductions in alcohol-related traffic
deaths.
Current New Jersey law only requires ignition interlock
devices for repeat offenders or those convicted with a BAC
of .15 or more. The proposed bill, which was introduced by
Assemblywoman Stender, would strengthen existing
legislation by requiring first-time offenders with a BAC of
.08 to .14 to drive with an interlock device for three to 12
months.
