The three elements necessary to establish a case for passing off are: 1) The plaintiff has established goodwill and reputation through their identifiable branding of goods/services. 2) The defendant has misrepresented their goods/services in a way that is likely to lead the public to believe they originate from the plaintiff. Whether the public knows the identity of the plaintiff is irrelevant. 3) The plaintiff has suffered or is likely to suffer damage due to the erroneous belief caused by the defendant's misrepresentation regarding the source of their goods/services.
