Municipal Housing Law, Section 3-45-5 (A) Every city, in addition to other powers conferred by the Municipal Housing Law, shall have power and is authorized, by proper resolution of its governing body, to create, as an agent of the city, an authority to be known as the "housing authority" of the city. The housing authority of the city may constitute a public body corporate. The city may delegate to the authority the power to construct, maintain, operate and manage any housing project or affordable housing programs of the city and may delegate to the authority any or all of the powers conferred on the city by the Municipal Housing Law.

32. Why Merge the HACLC and DACHA? Less administrative burden required by Housing Authority and HUD staff. Duplication of effort removed. Better efficiency and less cost to deliver services. Jurisdiction remains the same as it is currently. County and City both have representation on Housing Authority Board but neither have direct liability nor majority control. No loss of funding for housing services. No negative effect on the delivery of services for our current and future clients.

48. Municipal Housing Law, Section 3-45-5 (C) Two or more cities joined together pursuant to Subsection B of Section 3-45-4 NMSA 1978 shall establish their commissioners in accordance with Subsection B of this section, except that each city shall have equitable representation on the commission. The commissioners representing each city shall be appointed by the mayor of the city.
49. Suggested Process for Merger City Council and County Commission draft and execute resolutions to allow merger to go forward. Leave existing Housing Commissioners in place until their respective terms end. County Commission will appoint two new Housing Commissioners as the next two vacancies occur. Remaining two original Housing Commissioners and the two new Housing Commissioners will begin process for recruiting a Resident Housing Commissioner prior to the expiration of the fifth Housing Commissioner’s term. Final Housing Board of Commissioner make-up will be two DAC appointees, two CLC appointees and one Resident Housing Commissioner.
