230 | Water Resources Law (3) - Blended
This course introduces the legal principles that control water allocation for human
and environmental purposes, taught via a combination of in-person class meetings
and online exercises such as lectures, readings, videos, discussion and research.
Legal principles covered include: categories of surface and groundwater rights,
management approaches, allocation for environmental purposes, federal–state
relationships, tribal and reserved right, reasonable use, waste, and the public trust
doctrine. Students gain practical understanding of water allocation and use in
contemporary society, as well as critically examine the social policies that govern
water management. Classes will meet in Classroom A on Mondays and Thursdays;
other instruction will be in an online format, with support from the professor,
structured to provide regular interaction with the professor and other students.
Students are precluded from enrolling in this course if they have completed Water
Resources Law in a different format. CLE credit pending.
Professor Jennifer Harder is an Assistant Professor
of Lawyering Skills at Pacific McGeorge School of Law
where she teaches courses in water and
environmental law. Jennifer brings to the classroom a
decade of experience as a water attorney and partner
with a respected Sacramento area law firm, in
addition to nearly 25 years of experience teaching,
advising, litigating, and presenting on water,
environmental, and public agency issues. Her
interests include integration of classic water rights
principles into contemporary regulatory systems, the
nexus between water and land use issues,
environmental compliance, water use efficiency, and
water finance. Jennifer is a graduate of the Water
Leaders program at the Water Education Foundation,
a member of the steering committee for the Anne J. Schneider Memorial
Foundation, and co-author of the water law casebook, Cases and Materials on
Water Law, 9th
edition (West American Casebook Series, 2014).
