Directions:
Students, you will be required to research popular local and national court cases
where the death penalty has been issued as punishment.
Before you begin researching these cases, state at the beginning of your
paper whether or not you are for or against the death penalty. If you are
against the death penalty, state how you believe that the convicted should
be punished. If you are undecided, you may want to check out the website
http://deathpenalty.procon.org/view.resource.php?resourceID=002000. It
lists the top 10 pros and cons for death penalty sentences. The reasons
range from questions of morality to income level of the accused.
First, state the case and give a brief description of the crime. Explain why
the death penalty was deemed the appropriate punishment, and whether
or not you agreement with the judgment. Do not write a simple “yes, I
agree” or “no, I disagree”.
Explain in detail why or why not this is/isn’t an appropriate punishment (in
your opinion). For example, if you believe that the evidence was too
circumstantial and that the prosecutor did not prove their case, tell me
that. If you think that the person was mentally unstable, state that. If you
think that the defendant’s counsel failed them, write that. Full credit will
only be awarded for responses that reflect both your effort and your ability
to think critically.
At the end of your research assignment, I want you to state whether or not
your position has changed or even waivered slightly based on the cases that
you had to research.
Finally, review your notes and list which cases you found to be the most
interesting.

Final Argument Paper: The Case of the West Memphis Three In 1994, three teenage males were convicted for the crimes of murder in West Memphis, Arkansas. Jessie MisKelley Jr, Damien Echols, and Jason Baldwin were tried and convicted for the murder of three 8 year-old boys: Steven Branch, Michael Moore, and Christopher Byers. Jessie and Jason received life sentences while Damien, the suspected ring-leader, was sentenced to death. In August of 2011, all three men made an Alford Plea and were released from jail as time served. An Alford plea is better known as the “I’m guilty but I didn’t do it” defense. Under the Alford plea, the defendant admits that sufficient evidence exists with which the prosecution could likely convince a judge or jury to find the defendant guilty beyond a reasonable doubt. However, the defendant(s) cannot be charged with these crimes again (Double Jeopardy Law). All three are currently free men and trying to integrate back into society. In 2013, we are still in search of answers as to what happened to the three 8 year-old boys and who is responsible for their death. Under the Alford plea, Damien, Jason, and Jessie are considered guilty of these crimes. Under our laws, they are considered ex-cons. The state of Arkansas has declared the murders of the three boys a cold case despite questions that have been raised regarding the possible involvement of two of the stepfathers, John Mark Byers and Terry Hobbs. There are many speculations as to what might have happened if the three men would have chosen to wait for a re-trial. For this paper, present an argument as to what you believe would have been the outcome of such a case. Would the three been found guilty or not guilty? Additionally, this argument will be focused on a specific element of the case. You may choose one of the following: police error/law enforcement mistakes (including false confession), Satanic Panic, or Media Involvement in case. Whichever element you choose to write about will be the sole argument for the paper. After reviewing all of the court testimonies, documents, evidence, and extra accounts that the real jury did not have access to, you will make a decision and support it with evidence as to the guilt or wrongful conviction of these three young men. There are a lot of evidence, statements, etc to dig through for this case. However, as a jury member it is imperative that you look at all that is available to you in order to make a sound judgment. The job of a jury member is to: sort through conflicting claims; weigh all evidence as objectively as possible, without personal biases; and uncover the assumptions behind the messages you are hearing. For the introduction section to your paper (1.5-2 pgs), give an overview of the crimes and how/why these three young men were arrested and charged. The study examined how participants justified decisions involving human lives versus money. Participants provided rationales for choices in scenarios about a disease outbreak or monetary gamble. Their justifications were coded as relating to emotion, risk, or morality. Results showed participants made more morality-based statements for human life scenarios than monetary ones. For outbreak scenarios, more risk statements were made about the general public, while more morality statements were about prisoners, often dehumanizing them. Future research could use larger, more diverse samples and additional coding schemes.

Objective: Describe the investigator's role in the prosecution of criminal offenses. EXAMPLE: The textbook discusses the role of the prosecutor in the criminal justice system. Explain some of their duties (before trial) and why the authors refer to them as the most powerful official in the courts system. Include in the discussion some reasons why a case may not be prosecuted. After an investigation is complete, the next step is presentation to the prosecutor’s office for review of the case. Orthmann and Hess (2013) refer to the prosecutor as the “gatekeeper of the court system” (p. 655). The prosecutors, and their assistants, have great power in that they are the deciders of the progression of a case. They take the information presented to them and decide if a person is going to be charged and if so, what the charges will be. Once the decision to charge is made, it is the prosecutor’s role to try the case within legal parameters. There can sometimes be contention between investigators and prosecutions caused by varying opinions regarding the strength of a case. Investigators do need to realize that the standard to arrest, probable cause, is significantly less than what a prosecutor needs to prove in the courts (beyond a reasonable doubt). A prosecutor can decide not to prosecute if they find no legal grounds to charge an individual. The prosecutor can simply refuse to prosecute with little or no reason. If the prosecutor does not have the support of the complainant, and even sometimes the victim, they may opt not to pursue the matter. If for some reason the offender cannot be presented to the court, the prosecutor can decide not to prosecute. The prosecutor has a lot power and a lot of this power stems from their discretion during the review of the case. The first step is to understand exactly what makes up an argument. To say that something is true is to make a claim. But to give reasons to believe that it is true is to make an argument. Thus, all arguments consist of at least two parts: 1. Premise: one or more reasons or pieces of evidence to support the claim 2. Conclusion: the claim being supported Arguments make the process of thinking visible. The logical leap from the premises to the conclusion is known as an inference. Whenever you draw a conclusion based on a piece of information, such as seeing a threateningly dark sky and deciding that there’s a good chance of rain, you’re making an inference. When these inferences are articulated with premises and conclusions, they make an argument. Recognizing Arguments Not every piece of text or spoken speech you encounter is necessarily an argument. Unless it has both premises and a conclusion, it’s not an argument. If no support is offered, it’s not an argument. It might be true. It might be a fact. It might be an opinion. But if there are no reasons to back it up, its not an argument. Consider the following passage: People say I'm angry. I am. I'm angry that our president started an unnecessary war.
