HIPAA Administrative Statute
and Rules
According to the U.S. Department of Health & Human Services,
to improve the efficiency and effectiveness of the health care
system, the Health Insurance Portability and Accountability Act
of 1996 (HIPAA), Public Law 104-191, included Administrative
Simplification provisions that required HHS to adopt national
standards for electronic health care transactions and code sets,
unique health identifiers, and security.

HIPPA - The Security Rule
The Security Rule specifies a series of administrative, physical, and technical
safeguards for covered entities and their business associates to use to assure
the confidentiality, integrity, and availability of electronic protected health
information.

What is HIPPA?
 The Privacy Rule
 The Department of Health & Human Services establishes The
HIPAA Privacy Rule national standards to protect individuals’
medical records and other personal health information and
applies to health plans, health care clearinghouses, and those
health care providers that conduct certain health care
transactions electronically. The Rule requires appropriate
safeguards to protect the privacy of personal health information,
and sets limits and conditions on the uses and disclosures that
may be made of such information without patient authorization.

Staff HIPPA Training/ Breach
 Each staff member once hired will be trained and tested on
HIPPA requirements
 Requirements and Testing includes:
Confidential documents are not to be viewed – Please
contact a Administrator
Be respectful of all patients private information
Consequences when breach takes place:
Awareness of those who are caught breaching the security
standards.

Confidentiality Breached
 Protect the Right to Privacy
 Take the initiative to protect and remain confidential
considering all patients.
 Maintain and build an ethical relationship with client by
remaining confidential with visitors/family and friends.
 BREACH Warning
3 days home, “No Pay.”
 Second/ Last Warning
The individual/ group involved will be release from their job and
reported.

What is HIPPA?  The Privacy Rule  The Department of Health & Human Services establishes The HIPAA Privacy Rule national standards to protect individuals’ medical records and other personal health information and applies to health plans, health care clearinghouses, and those health care providers that conduct certain health care transactions electronically.
