El Comité Ejecutivo del CERMI ha aprobado el 'Informe de Derechos Humanos y Discapacidad 2008', elaborado para dar a conocer las vulneraciones que presenta este sector social con el fin de eliminarlas y poder restituir los derechos a estas personas, tal y como establece la Convención Internacional de los Derechos de las Personas con Discapacidad. El Informe, escrito por la delegada del CERMI para la Convención de la ONU para los Derechos de las Personas con Discapacidad, Ana Sastre, pone de manifiesto los déficits en materia de accesibilidad, recursos o educación, así como la existencia aún de prejuicios sociales que provocan la vulneración de muchos derechos fundamentales de las personas con discapacidad. Según el texto, "muchos de los casos relatados se han solucionado, o están en vías de hacerlo, antes de emprender acciones administrativas o judiciales, lo que refleja que las discriminaciones son en muchas ocasiones fruto del desconocimiento y de los prejuicios sociales". El documento recoge algunas contradicciones normativas que vulneran los derechos de las personas con discapacidad. Se hace alusión al Código Penal, donde se contempla el supuesto de poder abortar si el feto tiene "graves taras físicas o psíquicas". El Informe argumenta al respecto que "implícitamente esta disposición normativa considera la vida de una persona con discapacidad como menos valiosa que la de un niño sin discapacidad al no protegerlos de la misma forma". También se cuestionan los internamientos forzosos, en tanto que vulneran el derecho de libertad de la persona como recurso para el grupo de población con enfermedad mental. "En muchas ocasiones ni siquiera son escuchados y se les aplican procedimientos penales sin diagnosticar su enfermedad, provocándoles daños irreparables". Asimismo, el CERMI recuerda que la defensa del derecho a la familia es una de las prioridades que recoge la Convención, haciendo especial hincapié en el sistema de apoyos que debe habilitarse al efecto. "La Ley de Autonomía Personal y Atención a las Personas en Situación de Dependencia establece recursos importantes para desarrollar este derecho, pero ni permite al usuario elegir los apoyos que más se adecuen a su situación, ni extiende las ayudas del asistente personal a todas las personas con discapacidad", argumentan desde el CERMI en un comunicado de prensa.
