Balzac’s Café
“The café is the people’s parliament,” wrote 19th century French novelist Honoré de
Balzac, himself a dedicated patron of France’s lively cafés.
Two centuries later, The Distillery District’s eponymous café became the historic
neighbourhood’s first retail business. In keeping with the theme of no chains,
Cityscape, developers known for restoring historic sites, and responding to the
caffeine-starved pleas of the Distillery’s pioneering condo residents, had searched for a
coffee shop that met the company’s criteria for the area - creating unique venues with
character that also related to the arts.
They had heard of Diana Olsen, who, inspired by her love of French café life as a
student in Paris, had opened a French bistro themed coffee house in Stratford Ontario
in what had been a Victorian era bakery. Her vision was the perfect fit. Balzac’s Café
opened in the Distillery District in the autumn of 2002 in what had been the 19th
century distillery’s pump house, a beautiful intact example of industrial Victorian
architecture.
Today Balzac’s Café is a dynamic yet restorative refuge where people meet to chat
and exchange ideas, work, write - and even get married. Balzac’s Café hosts visiting
tour groups, Torontonians on a weekend outing, special events, artists, actors from
the nearby Soulpepper theatre, business people and residents simply out to grab a
quick java. Not to mention our Prime Minister. During the Christmas Market festivities
in December, CTV chose the iconic bistro for host Lisa LaFlamme’s interview with
Justin Trudeau. So drop by, sip a coffee and watch the parade of visitors and regulars.

Digital Media and Gaming Incubator at George Brown College
The George Brown College School of Design launched the Game and Digital Media Incubator in 2012 to
help emerging start-up companies transform into thriving businesses by providing guidance and
resources that start-ups need to succeed.
The Incubator is located in the former Toronto Sun building and combines working space, mentorship
and entrepreneurial programs such as the IT’S A START Pitch Competition which is featured annually at
Digifest, a three-day festival on digital creativity, at Corus Quay.
Sage Care
Sage was started by co-founders Vanessa Lee and Lucas Lu to help seniors age in a safe and
comfortable environment by providing them with trusted caregivers and using technology to help families
stay in the loop.
The idea of Sage first hatched when Vanessa was working in Seattle and her grandparents in Toronto
needed home care services. Vanessa felt the challenge of helping to arrange for home care and knew
there should be a better way. At the same time, Lucas’ mom has been a Personal Support Worker for
seven years, and he gets to see the many challenges faced by a home care worker, which include low
pay, lack of support from the main office and control over their own schedule. Together, they want to
create a new type of home care that provides more consistent care and greater visibility into a loved
one’s care plan for families.
While Vanessa and Lucas continue to focus on the GTA they have also been accepted into the
Y Combinator Fellowship, a prestigious incubator program in Silicon Valley USA. www.getsagecare.com

The Toronto branch is fortunate to have an enthusiastic
group of Executive members who volunteer their time

The Canadian International Council (CIC) is Canada’s foreign relations council. It is an independent,
member-based council established to strengthen Canada’s role in global affairs. Our 15-nationwide
branches hold over 100 events a year to engage the public with international issues. The Toronto branch

The Royal Canadian Institute for Science (RCIS)
One of Canada’s Oldest Societies
In forming the “Canadian Institute”, Sir Sandford Fleming believed it would, “do great good to my
adopted country.” For 167 years, we have worked towards his goal: an informed public that
embraces science to build a stronger Canada. The more people understand the science behind
today’s issues, they better decisions they make.
The Institute was the first place Sir Sandford Fleming presented his idea for Standard Time,
subsequently adopted around the world. The Institute played a role in the development of the
Royal Ontario Museum, Algonquin Park and a national science and technology funding agency.
Today, RCIS is a platform for Canadians to engage with scientists, featuring free live lectures and
panel discussions and an extensive physical and online archive.
Our public lectures are a tradition stretching back more than 100 years. Aimed at anyone who is
interested in science, we are the only organization in Canada with a focus on all scientific
disciplines and aimed at the general public.
All lectures are free to attend and open to anyone. The audience is varied, from students,
secondary and post-secondary, to life-long learners interested in keeping their knowledge
current, to people newly-arrived in Canada looking to practice grow their social and professional
networks. Lectures are held at various locations in the GTA: at the University of Toronto on
Sunday afternoons, in various branches of the Toronto and Mississauga Public Libraries and we
are expanding to new locations in 2016-17.
Webcasts of our lectures form an archive of modern research in Canada. These are posted on the
RCISCIENCE.CA website and are routinely accessed from around the Globe.

New Book: The Anatomy of Innovation-What makes innovation succeed in the 21st
century? Author: Dr. Kamiel S. Gabriel, Professor and Founding Associate Provost
of Research and Graduate Programs, University of Ontario Institute of Technology,
Oshawa, Canada
In the knowledge-based economy, how can innovation be successfully leveraged for broader social and
economic benefit? In his book “The Anatomy of Innovation”, international expert and thought leader Dr.
Gabriel takes a holistic approach in accounting for the key elements of a successful innovation system.
He traces the progression from research to commercialization. This process includes fostering
communities of innovation that help promote cooperation and alignment between distinct actors in order
to realize ultimate goals. The book also addresses some of the persistent obstacles to innovation systems
such as the lack of focus and goals, lack of connectivity between the innovation “actors”, and ineffective
IP policies.
Dr. Gabriel describes the book main thesis in that “for innovation to occur and succeed, it needs all parts
of its anatomy to work in harmony. As with the body, the brain controls the thought process to bring forth
ideas; it also controls the nervous system to make parts move and put such ideas to action; it enables the
eyes to see what the rest of the members are doing and hence work in harmony while the heart produces
the blood flow necessary to either walk, run or sprint to produce the desired outcome.”
Innovation is often mistakenly thought to derive only from science and engineering. Broadly speaking,
however, one may argue that it arises from two main sources: “new innovations”, which are typically
science or engineering-based; and “incremental innovations”, which are social, process, and industry-
based. In addition, innovation has a cultural or social dimension to it which adds to the uniqueness of
how it is deployed and employed in different countries around the world or even in different regions within
a particular jurisdiction. For example, in third world countries and emerging technologies, social
innovation takes precedence over technological innovations in that preference is given to projects that
target the social and economic needs of its citizens. The opposite can be true for western countries
where innovation focuses more (but not exclusively) on competing in the market place with the most
advanced technologies, feeding the consumers of affluent societies. The innovation process will and
should reflect the particular economic and social norms of each region and jurisdiction.
The book eloquently draws on the analogy and provides a fascinating discussion on the main parts of a
successful innovation system.

Tony Koukos, photographer, has found inspiration throughout the world. Currently
residing Canada, it is not uncommon for him to board a jet plane at the last minute to
complete a project or embark on a new adventure. Whether it’s climbing the medieval
towers of Tuscany or scuba-diving the Great Barrier Reef, he does whatever it takes to
find a distinctive angle, that perfect shot. His pictures speak for themselves, each a piece
of art, conveying a message of history, character and natural beauty.
After obtaining a University degree in business, Tony was in the financial services industry
for 7 years. In May of 2004, he decided to make a change. Resigning from his position, he
decided to become a photographer. Having no experience or education in the art and
design industry, his passion for travel, photography and design surpassed the fear of
failure.His obsession to keep moving forward in life, has brought him to approximately 70
countries including; Italy, Cuba, Australia, Thailand, Morocco, Japan, Turkey, Croatia,
Brazil, Argentina and many more.

The inspiration for this series was born while lying in a long-tail boat, staring at the
sky, off the coast of Koh Phi Phi Island in Thailand. Ever-shifting sky sculptures
create dreamscapes throughout the world. Layered cloud formations above the
Acropolis in Athens, a sunrise in Miami, and the Muskoka Lakes in Ontario, Canada
can all be found within the collection.

ARTIST'S BIO and STATEMENT: Golrokh Keshavarz is a
multidisciplinary artist and architectural designer. She was born in
Iran and raised in Sweden and Canada. Her photographic work has
won awards and has been shown in notable cultural establishments
such as The Royal Ontario Museum and The Louvre. Her “Unstill of
the Night” collection captures the street life in the early am hours.
It Focuses on the interactions and exchanges that happen as people
leave night clubs and stumble onto the streets. Inspired by long
exposure photography techniques Golrokh uses her camera as a
metaphoric paintbrush to create a dynamic narrative within one
single image and to evoke an intoxicated state of mind.

What you should know before buying a new home in Ontario
Purchasing a new home is an exciting and enticing endeavour to many people in today's real estate
market. However, it involves complexities and considerations that significantly differ from the purchase
of a resale home. This article will briefly discuss 10 factors to consider before purchasing your new
home from a builder in Ontario.
1. Ensure your builder is registered with Tarion Warranty Corporation
Tarion Warranty Corporation (“Tarion”) is tasked with administering the Ontario New Home Warranties
Plan Act, which protects new home buyers and regulates new home builders. All builders in Ontario
must be registered with Tarion. This means they have completed technical requirements associated
with the Ontario Building Code and have met financial qualifications set by Tarion. If you use an
unregistered builder, you are risking your entire investment.
The warranty that Tarion provides for newly built homes (and condos) in Ontario consists of 1-year, 2-
year, and 7-year warranties. The warranty takes effect on the date of possession and covers bad
workmanship, water penetration, major structural defects, delayed closing and protection for your
deposit. Deposits on new freehold homes are protected by Tarion up to $40,000.
2. Don't forget about the various costs and fees NOT included in the purchase price
The cost of purchasing a new home from a builder consists not only of the builder’s sticker purchase
price and the cost of any upgrades you requested, but also of the extra fees and adjustments the
builder will pass on to you at closing. These adjustments may total many thousands of dollars, catching
unsuspecting new home buyers by surprise a few days before closing.
Some of these fees and adjustments can include the enrollment fee for Tarion, development and
education levies, park and transit levies, tree planting costs, legal fees, land transfer taxes, and fees
related to utility agreements and rental items. Although some of these items may have a specific
amount disclosed, many will not simply because the builder has not incurred the expense yet. Your real
estate lawyer may be able to negotiate with the builder for placing a cap on the total amount of some of
these costs, or even for removing some of these adjustment fees from the agreement all together. Ask
and you shall (maybe) receive.
3. Know if you qualify for the HST rebate on new homes - and the implications if you don't
The Ontario HST rebate for new homes is available to anyone in the province who purchases a new
house or condo from a builder, or who hires a builder to construct a new house. The maximum rebate
you could be eligible for is $30,000.
To be eligible, the new house must be used as the primary place of residence by the purchaser or their
immediate family. If there is more than one purchaser and one of the purchasers does not qualify for
the new housing rebates, none of them will be eligible.
The rebate is generally assigned to the builder vendor upon closing, which allows the builder to
advertise a lower sticker price. For example, if the builder has listed a purchase price of $325K for a
new home, the HST rebate of approximately $24K has already been discounted to arrive at the
advertised purchase price of $325K.
Be aware that if you are found not to be eligible for the rebate, you will still be required to pay the
amount of the rebate you would have received, if eligible, to the builder vendor upon closing. Following
from the above example, if you were found not to be eligible for the HST rebate, you would be obligated
to pay the $24K rebate to the builder, essentially raising the purchase price to $349K at closing.
4. Be wary of falling in love with the 'show home'
Show homes typically have expensive upgrades, features, and finishes installed that you will have to
pay extra for if you want them in your new home. It is essential that you carefully review the schedule
attached to your agreement that lists the actual features and finishes that will be included in your home.
If it’s not listed in that schedule, it won’t be in your newly built home.
5. Be aware that the floor plan may change at the discretion of the builder
Your agreement of purchase and sale for a new home will typically allow the builder, at its sole
discretion, to alter the floor plan. For example, many of these agreements allow the builder to construct
a ‘mirror image’ of the original floor plan. It is also often the case that the floor plan drawings attached
to your agreement do not include dimensions or even total square footage, or they are noted as
approximate only. These ambiguities and possible changes may result in a new home that is quite
different from the one shown to you in the sales brochures.
To avoid disappointment, it would be prudent to have your real estate lawyer attempt to renegotiate
with the builder with respect to some of these potential variations to the floor plan. For example, your
lawyer should request that any variation to the dimensions or square footage noted on the drawings be
in accordance with Tarion’s Builder Bulletin 22, which provides that any variation to the floor plan must
be within 2% of the total area measurement.
6. Be diligent during the pre-delivery inspection (PDI)
A PDI is the opportunity for you to visit your newly built home and inspect for any damages or
deficiencies. Your builder will contact you to inform you of the date and time of the PDI, but it may be
worthwhile to have your solicitor request that the PDI be at a mutually agreed upon date/time, for your
convenience.
You will want to ensure you record all damages and deficiencies on the builder’s PDI Form during the
inspection and before occupancy, otherwise it may be difficult to determine whether they were caused
by you or the builder.
Hiring a home inspector for the PDI, despite not being mandatory, can provide new home buyers with
peace of mind. Although they can attend the PDI in your absence, it would be prudent for you to also
attend to ask any specific questions.
7. Consider whether you’re able to transfer the agreement to another purchaser
If you need to get out of the deal and cannot terminate the agreement without suffering severe financial
penalties, you may be able to transfer your agreement to another interested purchaser before the
closing date. Although some builders may allow such a transfer or assignment, many will not. If they do
allow it, most will require that you obtain their consent, which may be arbitrarily withheld, and/or pay a
fee. Your real estate lawyer may be able to renegotiate the terms of the agreement with the builder in
an effort to loosen the tight restrictions and conditions placed on transfer and assignment.
8. Prepare your patience with respect to the closing date
It is not unusual for the closing date to be delayed or extended on a new home being built for you
because of labour or material shortages, strikes, or the builder's inability to meet the original delivery
deadlines. You should prepare yourself for some of these uncertainties and realize that a delay does
not automatically void or cancel your agreement. Always check the Tarion addendum, included with
your agreement, for these critical dates.
9. Be aware that if it's not written in the agreement, it’s not binding
All agreements of purchase and sale have what is known as an ‘entire agreement’ or ‘whole agreement’
clause. Essentially it provides that you and the builder vendor are only bound by what is written in that
particular agreement - nothing more, nothing less. This clause is significant in that in the event of any
conflict between the terms in your agreement and any sales materials (brochures, ads, etc.), sales
pitches, or anything contained within the model/show home, the terms of the agreement will normally
prevail. The message is clear - if it’s not in writing, it will be treated as if it didn’t happen or doesn’t exist.
10. Always have your agreement reviewed by a real estate lawyer
Agreements of purchase and sale for new homes, compared to resale homes, are extensively detailed,
complex, and usually heavily skewed in favour of the builder vendor. Unlike when purchasing a new
condominium, you do not have a 10-day 'cooling off period' after you sign the agreement to get out of
the deal. Instead, you should insist on adding a clause that makes the deal conditional upon review by
your solicitor.
A good real estate lawyer will not only read through the entire agreement and help you understand your
obligations, risks, and liabilities, but he or she will also assist you in renegotiating some of the terms of
the agreement, in your best interests. However, when it’s a ‘seller’s market’ (as it is today), builder
vendors hold much of the bargaining power and may be unlikely to accept any amendments to the
original agreement. In this circumstance, you will need to decide whether the terms in the agreement,
as is, are acceptable to you.

THE ELEMENTA QUARTET is a floating public
interactive light and sculpture installation symbolizing
the four elements, earth, wind, air and water.
It is meant to engage the public with the history of
Canada through an interactive experience; how
together, as artist and public, we might ceremonially
engage in the ‘what happened’, ‘is happening’ and ‘may
happen’ in our country by using the four elements as
catalysts to awaken our memory to the stories of
history.
The materials, forms, symbols, light and colour I use
are meant to arouse sensations of permanence and
impermanence, the familiar and unfamiliar in our
memory. It is an encounter that is meant to evoke and
illuminate visceral responses to history in an
unexpected way which the public can then digitally
create and contribute to the collectively induced light
energy of the artwork.

Deborah Berlin-Romalis, BSW, MSW, RSW has been practicing as a social
worker/psychotherapist since 1991. She has done considerable agency work in various
women’s shelters and community-based services. In addition to her private work,
Deborah practiced clinical social work in the Division of Haematology/Oncology at The
Hospital for Sick Children from 1998 to 2014, working with children and their families in
the Stem Cell Transplant Program and the Paediatric Brain Tumour Program. She has
facilitated groups for women with eating disorders and body image issues at Sheena’s
Place since 1998.
From 1998 to 2008, Deborah was a member of the Health Sciences Review Committee
for Bioethics and Research at the Faculty of Medicine, University of Toronto. In 2003,
she was appointed as an adjunct practice lecturer at the Faculty of Social Work,
University of Toronto. An active public speaker, she has presented at numerous
conferences including TEDxToronto 2013.
At Sheena’s Place we offer hope and support to individuals aged 17 and over, families
and friends affected by eating disorders by providing a wide range of professionally
facilitated support groups and services. We are committed to inspiring hope, reducing
stigma, raising awareness and offering meaningful help and information at all stages of
recovery.
Located in downtown Toronto, Sheena’s Place is a non-institutional, non-residential
centre where people with similar issues and concerns come together in groups to share
experiences, thoughts, feelings, and coping strategies. We offer groups for young
adults, adults, mothers, men, and women over forty, as well as groups for families,
friends and partners of those with eating disorders. We recommend individuals attend
an introductory information interview with us to enable them to choose the support
group best suited to their needs.
Although we are a registered charity, we do not receive funding from the government
and we are not a United Way Member Agency. We rely on revenue from special events
and the generosity and financial support of individuals, foundations and corporations.

A Canadian startup company has made an interchangeable smartwatch that

  • 18. ! Balzac’s Café “The café is the people’s parliament,” wrote 19th century French novelist Honoré de Balzac, himself a dedicated patron of France’s lively cafés. Two centuries later, The Distillery District’s eponymous café became the historic neighbourhood’s first retail business. In keeping with the theme of no chains, Cityscape, developers known for restoring historic sites, and responding to the caffeine-starved pleas of the Distillery’s pioneering condo residents, had searched for a coffee shop that met the company’s criteria for the area - creating unique venues with character that also related to the arts. They had heard of Diana Olsen, who, inspired by her love of French café life as a student in Paris, had opened a French bistro themed coffee house in Stratford Ontario in what had been a Victorian era bakery. Her vision was the perfect fit. Balzac’s Café opened in the Distillery District in the autumn of 2002 in what had been the 19th century distillery’s pump house, a beautiful intact example of industrial Victorian architecture. Today Balzac’s Café is a dynamic yet restorative refuge where people meet to chat and exchange ideas, work, write - and even get married. Balzac’s Café hosts visiting tour groups, Torontonians on a weekend outing, special events, artists, actors from the nearby Soulpepper theatre, business people and residents simply out to grab a quick java. Digital Media and Gaming Incubator at George Brown College The George Brown College School of Design launched the Game and Digital Media Incubator in 2012 to help emerging start-up companies transform into thriving businesses by providing guidance and resources that start-ups need to succeed. The Incubator is located in the former Toronto Sun building and combines working space, mentorship and entrepreneurial programs such as the IT’S A START Pitch Competition which is featured annually at Digifest, a three-day festival on digital creativity, at Corus Quay. Sage Care Sage was started by co-founders Vanessa Lee and Lucas Lu to help seniors age in a safe and comfortable environment by providing them with trusted caregivers and using technology to help families stay in the loop. The idea of Sage first hatched when Vanessa was working in Seattle and her grandparents in Toronto needed home care services. The Royal Canadian Institute for Science (RCIS) One of Canada’s Oldest Societies In forming the “Canadian Institute”, Sir Sandford Fleming believed it would, “do great good to my adopted country.” For 167 years, we have worked towards his goal: an informed public that embraces science to build a stronger Canada. The more people understand the science behind today’s issues, they better decisions they make. The Institute was the first place Sir Sandford Fleming presented his idea for Standard Time, subsequently adopted around the world. The Institute played a role in the development of the Royal Ontario Museum, Algonquin Park and a national science and technology funding agency. Today, RCIS is a platform for Canadians to engage with scientists, featuring free live lectures and panel discussions and an extensive physical and online archive. Our public lectures are a tradition stretching back more than 100 years. Aimed at anyone who is interested in science, we are the only organization in Canada with a focus on all scientific disciplines and aimed at the general public. All lectures are free to attend and open to anyone. The audience is varied, from students, secondary and post-secondary, to life-long learners interested in keeping their knowledge current, to people newly-arrived in Canada looking to practice grow their social and professional networks.   • 30. ! New Book: The Anatomy of Innovation-What makes innovation succeed in the 21st century? Author: Dr. Kamiel S. Gabriel, Professor and Founding Associate Provost of Research and Graduate Programs, University of Ontario Institute of Technology, Oshawa, Canada In the knowledge-based economy, how can innovation be successfully leveraged for broader social and economic benefit? In his book “The Anatomy of Innovation”, international expert and thought leader Dr. Gabriel takes a holistic approach in accounting for the key elements of a successful innovation system. He traces the progression from research to commercialization. This process includes fostering communities of innovation that help promote cooperation and alignment between distinct actors in order to realize ultimate goals. The book also addresses some of the persistent obstacles to innovation systems such as the lack of focus and goals, lack of connectivity between the innovation “actors”, and ineffective IP policies. Dr. Gabriel describes the book main thesis in that “for innovation to occur and succeed, it needs all parts of its anatomy to work in harmony. As with the body, the brain controls the thought process to bring forth ideas; it also controls the nervous system to make parts move and put such ideas to action; it enables the eyes to see what the rest of the members are doing and hence work in harmony while the heart produces the blood flow necessary to either walk, run or sprint to produce the desired outcome.” Innovation is often mistakenly thought to derive only from science and engineering. Broadly speaking, however, one may argue that it arises from two main sources: “new innovations”, which are typically science or engineering-based; and “incremental innovations”, which are social, process, and industry- based. In addition, innovation has a cultural or social dimension to it which adds to the uniqueness of how it is deployed and employed in different countries around the world or even in different regions within a particular jurisdiction. For example, in third world countries and emerging technologies, social innovation takes precedence over technological innovations in that preference is given to projects that target the social and economic needs of its citizens. The opposite can be true for western countries where innovation focuses more (but not exclusively) on competing in the market place with the most advanced technologies, feeding the consumers of affluent societies. The innovation process will and should reflect the particular economic and social norms of each region and jurisdiction. The book eloquently draws on the analogy and provides a fascinating discussion on the main parts of a successful innovation system.

  • 53. What you should know before buying a new home in Ontario Purchasing a new home is an exciting and enticing endeavour to many people in today's real estate market. However, it involves complexities and considerations that significantly differ from the purchase of a resale home. This article will briefly discuss 10 factors to consider before purchasing your new home from a builder in Ontario. 1. Ensure your builder is registered with Tarion Warranty Corporation Tarion Warranty Corporation (“Tarion”) is tasked with administering the Ontario New Home Warranties Plan Act, which protects new home buyers and regulates new home builders. All builders in Ontario must be registered with Tarion. This means they have completed technical requirements associated with the Ontario Building Code and have met financial qualifications set by Tarion. If you use an unregistered builder, you are risking your entire investment. The warranty that Tarion provides for newly built homes (and condos) in Ontario consists of 1-year, 2- year, and 7-year warranties. The warranty takes effect on the date of possession and covers bad workmanship, water penetration, major structural defects, delayed closing and protection for your deposit. Deposits on new freehold homes are protected by Tarion up to $40,000. 2. Don't forget about the various costs and fees NOT included in the purchase price The cost of purchasing a new home from a builder consists not only of the builder’s sticker purchase price and the cost of any upgrades you requested, but also of the extra fees and adjustments the builder will pass on to you at closing. These adjustments may total many thousands of dollars, catching unsuspecting new home buyers by surprise a few days before closing. Some of these fees and adjustments can include the enrollment fee for Tarion, development and education levies, park and transit levies, tree planting costs, legal fees, land transfer taxes, and fees related to utility agreements and rental items. Although some of these items may have a specific amount disclosed, many will not simply because the builder has not incurred the expense yet. Your real estate lawyer may be able to negotiate with the builder for placing a cap on the total amount of some of these costs, or even for removing some of these adjustment fees from the agreement all together. Ask and you shall (maybe) receive. 3. Know if you qualify for the HST rebate on new homes - and the implications if you don't The Ontario HST rebate for new homes is available to anyone in the province who purchases a new house or condo from a builder, or who hires a builder to construct a new house. The maximum rebate you could be eligible for is $30,000. To be eligible, the new house must be used as the primary place of residence by the purchaser or their immediate family. If there is more than one purchaser and one of the purchasers does not qualify for the new housing rebates, none of them will be eligible. The rebate is generally assigned to the builder vendor upon closing, which allows the builder to advertise a lower sticker price. For example, if the builder has listed a purchase price of $325K for a new home, the HST rebate of approximately $24K has already been discounted to arrive at the advertised purchase price of $325K. Be aware that if you are found not to be eligible for the rebate, you will still be required to pay the amount of the rebate you would have received, if eligible, to the builder vendor upon closing. Following from the above example, if you were found not to be eligible for the HST rebate, you would be obligated to pay the $24K rebate to the builder, essentially raising the purchase price to $349K at closing.
  • 54. 4. Be wary of falling in love with the 'show home' Show homes typically have expensive upgrades, features, and finishes installed that you will have to pay extra for if you want them in your new home. It is essential that you carefully review the schedule attached to your agreement that lists the actual features and finishes that will be included in your home. If it’s not listed in that schedule, it won’t be in your newly built home. 5. Be aware that the floor plan may change at the discretion of the builder Your agreement of purchase and sale for a new home will typically allow the builder, at its sole discretion, to alter the floor plan. For example, many of these agreements allow the builder to construct a ‘mirror image’ of the original floor plan. It is also often the case that the floor plan drawings attached to your agreement do not include dimensions or even total square footage, or they are noted as approximate only. These ambiguities and possible changes may result in a new home that is quite different from the one shown to you in the sales brochures. To avoid disappointment, it would be prudent to have your real estate lawyer attempt to renegotiate with the builder with respect to some of these potential variations to the floor plan. For example, your lawyer should request that any variation to the dimensions or square footage noted on the drawings be in accordance with Tarion’s Builder Bulletin 22, which provides that any variation to the floor plan must be within 2% of the total area measurement. 6. Be diligent during the pre-delivery inspection (PDI) A PDI is the opportunity for you to visit your newly built home and inspect for any damages or deficiencies. Your builder will contact you to inform you of the date and time of the PDI, but it may be worthwhile to have your solicitor request that the PDI be at a mutually agreed upon date/time, for your convenience. You will want to ensure you record all damages and deficiencies on the builder’s PDI Form during the inspection and before occupancy, otherwise it may be difficult to determine whether they were caused by you or the builder. Hiring a home inspector for the PDI, despite not being mandatory, can provide new home buyers with peace of mind. Although they can attend the PDI in your absence, it would be prudent for you to also attend to ask any specific questions. 7. Consider whether you’re able to transfer the agreement to another purchaser If you need to get out of the deal and cannot terminate the agreement without suffering severe financial penalties, you may be able to transfer your agreement to another interested purchaser before the closing date. Although some builders may allow such a transfer or assignment, many will not. If they do allow it, most will require that you obtain their consent, which may be arbitrarily withheld, and/or pay a fee. Your real estate lawyer may be able to renegotiate the terms of the agreement with the builder in an effort to loosen the tight restrictions and conditions placed on transfer and assignment.
  • 55. 8. Prepare your patience with respect to the closing date It is not unusual for the closing date to be delayed or extended on a new home being built for you because of labour or material shortages, strikes, or the builder's inability to meet the original delivery deadlines. You should prepare yourself for some of these uncertainties and realize that a delay does not automatically void or cancel your agreement. Always check the Tarion addendum, included with your agreement, for these critical dates. 9. Be aware that if it's not written in the agreement, it’s not binding All agreements of purchase and sale have what is known as an ‘entire agreement’ or ‘whole agreement’ clause. Essentially it provides that you and the builder vendor are only bound by what is written in that particular agreement - nothing more, nothing less. This clause is significant in that in the event of any conflict between the terms in your agreement and any sales materials (brochures, ads, etc.), sales pitches, or anything contained within the model/show home, the terms of the agreement will normally prevail. The message is clear - if it’s not in writing, it will be treated as if it didn’t happen or doesn’t exist. 10. Always have your agreement reviewed by a real estate lawyer Agreements of purchase and sale for new homes, compared to resale homes, are extensively detailed, complex, and usually heavily skewed in favour of the builder vendor. Unlike when purchasing a new condominium, you do not have a 10-day 'cooling off period' after you sign the agreement to get out of the deal. Instead, you should insist on adding a clause that makes the deal conditional upon review by your solicitor. A good real estate lawyer will not only read through the entire agreement and help you understand your obligations, risks, and liabilities, but he or she will also assist you in renegotiating some of the terms of the agreement, in your best interests. However, when it’s a ‘seller’s market’ (as it is today), builder vendors hold much of the bargaining power and may be unlikely to accept any amendments to the original agreement. In this circumstance, you will need to decide whether the terms in the agreement, as is, are acceptable to you. About the Author: Stephen G.   • 58. T h o m S o k o l o s k i THE CONCEPT THE ELEMENTA QUARTET is a floating public interactive light and sculpture installation symbolizing the four elements, earth, wind, air and water. It is meant to engage the public with the history of Canada through an interactive experience; how together, as artist and public, we might ceremonially engage in the ‘what happened’, ‘is happening’ and ‘may happen’ in our country by using the four elements as catalysts to awaken our memory to the stories of history. The materials, forms, symbols, light and colour I use are meant to arouse sensations of permanence and impermanence, the familiar and unfamiliar in our memory. It is an encounter that is meant to evoke and illuminate visceral responses to history in an unexpected way which the public can then digitally create and contribute to the collectively induced light energy of the artwork.

  • 62. ! Deborah Berlin-Romalis, BSW, MSW, RSW has been practicing as a social worker/psychotherapist since 1991. She has done considerable agency work in various women’s shelters and community-based services. In addition to her private work, Deborah practiced clinical social work in the Division of Haematology/Oncology at The Hospital for Sick Children from 1998 to 2014, working with children and their families in the Stem Cell Transplant Program and the Paediatric Brain Tumour Program. She has facilitated groups for women with eating disorders and body image issues at Sheena’s Place since 1998. From 1998 to 2008, Deborah was a member of the Health Sciences Review Committee for Bioethics and Research at the Faculty of Medicine, University of Toronto. In 2003, she was appointed as an adjunct practice lecturer at the Faculty of Social Work, University of Toronto. An active public speaker, she has presented at numerous conferences including TEDxToronto 2013. At Sheena’s Place we offer hope and support to individuals aged 17 and over, families and friends affected by eating disorders by providing a wide range of professionally facilitated support groups and services. We are committed to inspiring hope, reducing stigma, raising awareness and offering meaningful help and information at all stages of recovery. Located in downtown Toronto, Sheena’s Place is a non-institutional, non-residential centre where people with similar issues and concerns come together in groups to share experiences, thoughts, feelings, and coping strategies. We offer groups for young adults, adults, mothers, men, and women over forty, as well as groups for families, friends and partners of those with eating disorders. We recommend individuals attend an introductory information interview with us to enable them to choose the support group best suited to their needs. Although we are a registered charity, we do not receive funding from the government and we are not a United Way Member Agency.
