Equity Act
What Is Employment Equity Act ?
EMPLOYMENT EQUITY ACT NO. 55 OF 1998. The most important cause of the Employment
Equity Act is to attain equality in the workplace by promoting equal opportunity and fair treatment
through the elimination of unfair discrimination.
This Code is relevant to all employers that are regarded as designated employers in terms of the Act,
including employers who choose to comply voluntarily.

How must the EE Committee be established?
Role of the Employment Equity Committee
• Be knowledgeable in all matters relating to the Employment Equity Act.
• Consult with employees in matters relating to Employment Equity.
• Teach and train employees on equity and diversity.
• Develop and execute the employment equity constitution.
• Develop and execute all employment equity policies and procedures.
• Analyze the workforce, prepare a transformation plan and develop an employment equity plan.
• Screen and report progress against BBBEE, EAP and the CEE targets.
• Execute and screen the employment equity plan.
• Ensure full compliance with the employment equity Act and report all outstanding issues.
• Safeguard records of all meetings, registers, agendas and minute
• Execute transformation.
The EE committee ought to be selected after a nomination
process is completed by the company , however the
company can appoint members of the committee should
there be not enough nominations to constitute the
committee as required

A designated employer must
develop and execute an
employment equity plan that
includes the following elements:
• objectives for each year of the plan,
• affirmative action measures,
• numerical goals for achieving equitable
representation,
• a timetable for each year,
• internal monitoring and evaluation
procedures, including internal dispute
resolution mechanisms, and
• identification of designated employees.
Drafting OF Employment
Equity Plan
Employment Equity (EE)
plan is designed to provide
direction for an
organization to reach its
employment equity targets
and affirmative action
measures approved by all
stakeholders in the
organization.
◦ In order to draw up the EE plan, a business needs to
analyze their workforce profile, employment
practices and policies. Consultation with employees is
required before drawing up the plan, including union
representatives, to provide the information on the
current status and consult on what the plan should
include.

  • 1. Employment Equity Act What Is Employment Equity Act ? EMPLOYMENT EQUITY ACT NO. 55 OF 1998. The most important cause of the Employment Equity Act is to attain equality in the workplace by promoting equal opportunity and fair treatment through the elimination of unfair discrimination. Role of the Employment Equity Committee • Be knowledgeable in all matters relating to the Employment Equity Act. • Consult with employees in matters relating to Employment Equity. • Teach and train employees on equity and diversity. • Develop and execute the employment equity constitution. • Develop and execute all employment equity policies and procedures. • Analyze the workforce, prepare a transformation plan and develop an employment equity plan. • Screen and report progress against BBBEE, EAP and the CEE targets. • Execute and screen the employment equity plan. • Ensure full compliance with the employment equity Act and report all outstanding issues. • Safeguard records of all meetings, registers, agendas and minute • Execute transformation.   • 4. WHAT IS THE EMPLOYER'S OBLIGATION FOR ENSURING THAT THE EEA IS FOLLOWED? A designated employer must develop and execute an employment equity plan that includes the following elements: • objectives for each year of the plan, • affirmative action measures, • numerical goals for achieving equitable representation, • a timetable for each year, • internal monitoring and evaluation procedures, including internal dispute resolution mechanisms, and • identification of designated employees.

Drafting OF Employment Equity Plan Employment Equity (EE) plan is designed to provide direction for an organization to reach its employment equity targets and affirmative action measures approved by all stakeholders in the organization. ◦ In order to draw up the EE plan, a business needs to analyze their workforce profile, employment practices and policies. Consultation with employees is required before drawing up the plan, including union representatives, to provide the information on the current status and consult on what the plan should include.

DEVELOPING THE EMPLOYMENT EQUITY PLAN The following need taken into consideration when developing the Employment Equity Plan Analysis Report Duration of EE Plan Objectives of the EE Plan Numerical goals and numerical targets Affirmative action measures The plan must not be less than one year Consultation should take place with an endeavor to reach an agreement on the underrepresentation of the assigned groups The objective of the plan –to accomplish equitable representation among the assigned groups, the objective must be “SMART “ Consensus The employer must endeavor to reach an agreement on yearly goals and remedial measures contained within the EE plan Employer to respond to workplace obstructions recognized within the analysis report Whole workforce and the anticipated workplace profile the employer looks to attain
