This document summarizes a dental malpractice case lodged against Dr. M by a patient. It describes that Dr. M performed endodontic surgery on tooth #16 instead of #15, as indicated by Dr. F's x-ray. However, Dr. M did not take his own x-ray before surgery. The patient is requesting copies of their dental records and x-rays from the visit. In response, Dr. M's office provided 3 x-rays taken during and after surgery, but none before. They are questioning why Dr. M proceeded with surgery on tooth #16 without proper evidence. 1. Dental Malpractice Case vs “Dr M” Lodged by Patient [Facilitator: Michael Pastien] 11/6/15
It is only reasonable for me to assume that the May 3 2010 Endodontic Quad Surgery which
“Dr M” performed on me was uncalled for.
“Dr F” who referred him (for ambiguous reasons), indicated (on the mediocre caliber X-Ray he provided) that the abscess
was at Tooth #15 but without taking any due X-Rays of his own before Endo Surgery began, Dr M immediately
proceeded with applying anesthetic and drilling on Tooth #16 instead.
* His note in a Post-Surgery Letter to Dr F stating that the 1-6 was necrotic as “Expected” is Outrageous!
In reply to requests from Dr M for his Before/After X-Rays taken at my May 3 2010 visit, I received a total of 3; two of
which were taken after Endodontic Surgery was already under way, and the third, after the Quad was finished.
* No X-Ray taken by Dr M before Endodontic Surgery commenced, is included.
If any X-Ray whatsoever needed being taken during my Visit…it notably should have been before Endo Surgery.
It is only Logical that Dr M would have routinely taken a new X-Ray, before proceeding with Endodontic Surgery
(Principally since the Caliber of his X-Ray Facilities are so Evidently Superior to Dr F’s).
The X-Ray that Dr F sent to Dr M (which I have a hardcopy of) ahead of my visit is so poor, that one cannot realistically
see evidence of radiolucency or abscesses at any tooth in it whatsoever.
Dr M has provided Zero Logical Evidence as to why he went ahead with any Surgery [at Tooth #16].
I also wound up having a costly Crown installed at that tooth as a result afterwards, by Dr F.

Ontario; against Dr F.

I was referred to you for Endodontic Treatment by “Dr F” on April 22 2010.
You performed the Endodontic Exam and Root Canal on May 3 2010.
I am formally requesting from your office, copies of my Complete Dental Records in regards to this Visit; including the
Before and After X-Rays which you took; plus a copy of the Official Booking and any Details communicated
between “Dr F” and yourself, ahead of the May 3rd 2010 Visit.
Your prompt compliance to my request (Email shall likely suffice) will be much appreciated.

Since the Quality of X-Ray that Dr F sent you (which I have a hardcopy of) ahead of my visit is so “milky” that one can’t
reasonably see definite evidence of any dental problems in it; it is only logical that a new X-Ray would have routinely
been taken by you, before proceeding with Endodontic Surgery (primarily since the caliber of your X-Ray Equipment is
so Evidently Superior to Dr F’s).
On what basis did you decide to proceed with 4 Micro Root Canals on Tooth 16?
Because I can’t make out the medically abbreviated jargon scribbling on your 2 forms; I need you to type out without
abbreviations, exactly what you jotted down on my Dental Records, and then concisely elaborate on them.
Your prompt response to my overall queries via email, is most appreciated.
