Mr. Suarez:
You have a legal right to communicate with other owners and have meetings with each other. However,
you cannot create a nuisance in the community. A Nuisance by law is anything that annoys or disturbs
one in the free use, possession, or enjoyment of his property, or which renders its ordinary use or
occupation physically uncomfortable, and may be restrained. The form of your newsletter is misleading
to owners and the content is inaccurate and negative towards the association. The message you are
relaying and its inaccuracies will create and ill will and animosity amongst the community, that is not
necessary, and a nuisance to many owners.
Newsletter Issue #1, begins with the title, “Board Selects Vender for Hallway Project And Scope Not
Disclosed, Bid With Same Scope For $8,000 Less Than Winning Bin Not Considered”, that title nor your
content, gives an explanation that led to the Board’s decision. It is a statement made without backing, a
statement that most certainly will create a problem. The remainder of your newsletter continues with the
same negative tone and slander of the Board and their decisions. Any notices, publications, newsletters,
letters that are addressed to the community as a whole, should be first approved by the Board. The
Board was formed for the betterment of the community and to see that all unit owners live in a pleasant
and peaceful environment.
In order to settle this matter amicably and with little expense to the community, do not forward any
newsletter to the community as a whole without the approval of the Board. Also, I would like to redirect
you to the By-laws Section 3.3, whereby specifically provides a guideline to follow when a Unit Owner
would like to speak at a meeting. This is the time to speak your concerns or request. Again, the By-
Laws, Rules and Regulation, the Condominium Declaration and Florida Statutes were created to be
followed and if followed, all within the community may live peacefully amongst each other.
In addition, it is to your benefit and the community that a resolution is reached. As a result of your
actions, the Association has had to pay for my services. Let’s try to resolve this matter as quickly as
possible.

Can you please cite, demonstrate or show where it says in any of the Villa Alhambra of Coral Gables
Condominium Association Inc documents, where owners are prohibited from communicating with each other or
meeting outside of a Villa Alhambra board meeting?
Also, can you please provide any documentation showing that any information disseminated in the newsletter or
any future meeting, referred to in your letter, is misleading, deceiving or inaccurate?
Furthermore, as unit owners at Villa Alhambra of Coral Gables Condominium Association Inc., we are requesting
to know if your retained services are being paid for by the association or an individual.
