Criminal law aims to punish misbehavior that violates societal norms and values. Both state and federal governments help establish and enforce criminal law within their jurisdictions. Each state enforces criminal law within its borders according to the U.S. Constitution, which also gives some criminal law powers to the federal government. For an individual to be found guilty of a crime, the government must prove beyond a reasonable doubt that a mental state and physical act were present, as required by that crime and ensured by due process of law.
