1. What were the various problems with the Articles of Confederation?
The Articles of Confederation was the first system of government in the new country of America. After the countless amount of issues born out of being owned by Great Britain, the expectations of the new system were as such: that power would be given through the people, that power would be expressed through a representative of the people, and that the representative was one of the needs and interests of the people. And while that sounds ideal, great almost, it doesn’t work out. The Articles as described in class, were pretty much bad/not good. Where the people were looking for the framework for an actual government, they seemed more like a firm league of friendship. The Articles, founded in 1778 lasted 10 years. Under this system there was no president or judiciary, any decision required a 9 out of 13 votes, so if it came down to 2/3rds there would be no decision made. The Articles allowed the declaration of war, conduct of foreign affairs, treaty creation, but could not tax. But hey two cool positives are that it won them the war and we also gained Ohio! And it was a tremendous disaster by the fact that it did not collect taxes, which was probably because the big debt from the war they had previously won.
No tax means no power, and inadvertently no money either. This became a bigger problem because the newfound America had borrowed money and weapons from the French, and since they were in debt they couldn’t pay the French back. The inability to tax left the founders hands tied; they couldn’t tax so they were unable to address their debt issue. And as the debt intensified, there was a rebellion in Massachusetts kicking off known as “Shays Rebellion.”
2. How did Shays Rebellion motivate “the founders” to hold a convention to resolve the problems of the Articles?
Shays Rebellion was the rebellion of the people (primarily farmers) against their government and more specifically, the affects of the Articles of Confederation. The huge debt problem affected everyone; farmers/civilians couldn’t pay mortgage, faced debt, and would land in jail. Shays Rebellion occupied the jails, courts, etc. and while the origins of this movement started in Massachusetts, movements were being started all over the new country because Massachusetts wasn’t the only state facing issues.
At this moment the economic elite realized they needed to strengthen the central government in order to fight debt/put down the rebellion. And it is from this realization that the Constitution was born, the document that laid down the foundation for “freedom, liberty and rights.” But to whom were these rights attributed? It is important to note that the Constitutions original purpose was not about giving us our rights, but how to control the people. Enlightenment and the Country’s founding
The founding of the country was based in principles in the European enlightenment.
One of the Enlightenment’s goals was to base governance on rationality.
Prior to the Enlightenment, governance was justified through tradition rather than reason.
Locke v Hobbes
Hobbes argued that the rationality for government was to prevent the state of nature.
Hobbes argued that life without the state would be a war between all and nasty, brutish and short. He advocated for a dictator to prevent this.
Locke disagreed. Locke argued that people would rather deal with what he called the mischief of foxes and polecats than to be devoured by lions.
This means that conflicts between individuals are manageable, but a tyrannical state is impossible to avoid.
Locke’s justification for a state is the social contract which is an agreement that the state protects rights. However if a state abuses its people, then it loses its legitimacy.
Locke’s principles drove the American Revolution.
The Revolution
The colonies originally had more freedom to run their own land prior to the Seven Years War (war between France and England).
The colonists were prevented to settle past Appalachia.
To pay back the taxes that resulted from the Seven Years War, England levied taxes on the colonists.
Colonists demanded representation in Parliament.
Stamp Act, (Tax on Paper goods) Townsend Act (Tax on glass, Tea, Paint)
The Colonies boycotted British Manufacturing goods.
Britain sent troops to the colonies, leading to an altercation with the troops known as the Boston Massacre
Britain passed an act that granted a monopoly on the British East India Tea Company, which led to the “Boston Tea Party.”
The Revolution cont.
These acts led to the state of Massachusetts to revolt, followed by the rest of the colonies.
The Declaration of Independence laid out the principles that drove the colonies to revolt against England.
This listed out the ways that Britain abused its power regarding the Social Contract.
“We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness.--That to secure these rights, Governments are instituted among Men, deriving their just powers from the consent of the governed”

Overview
The United States, as a nation, was born of the American Revolution of 1776. This revolution cut the political ties between England and its American colonies. Many "Americans" living in the colonies had complained about harsh British rule. King George of England had ruled over the colonies with a heavy hand, increasing taxes with the Stamp Act and the Sugar Act, for example. These abuses began to divide the "patriots" in favor of independence and the "loyalists" in favor of the English Crown.
Tensions between the American colonials and British soldiers boiled over in the Boston Massacre, when a mob harassed British soldiers, who then fired their muskets into the crowd, killing three, mortally wounding two others, and injuring six.
Another famous incident which helped inspire the American Revolution was the Boston Tea Party of 1773, launched as a protest to the British Tea Act. This Act gave the British East India Company a tea monopoly, shutting out American traders. Bostonians disguised themselves as Mohawk Indians, then boarded the British ships and dumped all 342 containers of tea into the harbor.
Two years later, in 1775, there were more serious conflicts between colonials and British troops: the Battles of Lexington and Concord, the prelude for a full conflict. The American Revolutionary War was long, bloody and ended with the French-assisted victory of the American Continental Army in Yorktown in 1781.
An understanding of American government and politics should consider two documents related to this war and its aftermath. The first is the Declaration of Independence, which launched the American Revolutionary War; and the second is the U.S. Constitution, which replaced the post-war Articles of Confederation and which remains the highest law of the land.

Congress and the President
The way our legislative and the executive branches run our country have its roots to the beginning of our country and our constitution. Our founding fathers were intent on making sure neither the president had too much power and wanted to be sure they had very specific powers and roles within our new government. These two powerful and important roles are known as Congress and the Presidency.Congress
Congress is a Bicameral house made up of the Senate and the House of Representatives. The makeup of these two houses was chosen very carefully by our founding fathers at the Constitutional convention. The Senate is made up by two senators from each state as to give all states equal representation. This idea was proposed through the New Jersey Plan which proposed that all states had “equal representation regardless of population” (“The Almost Painless Guide, ”2000). The house of representative, on the other hand, is built based on the population of each state with the larger states having more representatives than the smaller states an idea proposed by the Virginia Plan laid out at the Constitutional Convention. These two parts that make up the legislative branch are tasked with making new laws, handling any impeachment proceedings, recommend amendments to the constitution, make budgets, and check the president’s decisions on personnel and treaties and vetoes by gaining a two-thirds vote to stop any of his decisions.
Powers of the President and Congress
Through Article I section 8 of the constitution congress has its most important power which is the ability to create laws. When a bill or any proposed law is up for a vote it can only be passed if the House of Representatives and the Senate both approve it in the same form. Congress also has the powers to “declare war, coin money, raise an army and navy, regulate commerce, establish rules of immigration and naturalization, and establish the federal courts and their jurisdictions ("The Powers of Congress", 2018). According to Article II of the constitution, the president has the power to commission officers of the armed forces, grant reprieves, and pardons, convene Congress in special sessions, wield executive power, receive ambassadors, and ensure that laws are being executed correctly. One of the aforementioned executive powers the president has is to veto a law or bill though even if that happens congress can overturn the veto with a two-thirds vote.
Checks and Balances
The founding fathers of the US were wise to set up a form of checks and balances built into the constitution to ensure no branch of government could garner too much power and guard against tyranny. “If men were angels, no government would be necessary,” James Madison wrote in the Federalist Papers, of the necessity for checks and balances. “In framing a government which is to be administered by men over men, the great difficulty is this: You must first .

Constitutional Law And Meaning
1. Our Constitution and it's meaning.
This is a new series exploring both the US Constitution and our state Constitution and how
these documents should be applied to our way of life. Some will object to these writings and
some will argue against them. Others will learn what the real responsibility of our government
and our leaders really are and how they should actually be acting on our behalf. It is up to
you to decide if our leaders are doing their part and if what is presented is correct. Everything
that will be presented is documented and verifiable through our nations own records. With
this said, let us begin.
The Constitution is essentially a rule book for government. It's guiding principle is the
concept that the state is a source of corruptive power and ultimate tyranny. The Federal
government's responsibilities were confined to a few enumerated powers which were mainly
national security and the public welfare. The main objective of American government was
very high limitations of government interference with the lives of the people.
Article 1, section 8 defines these powers very well. In a nutshell, these powers are the
collecting of certain taxes, how those taxes are levied, the borrowing of monies on credit of
the Federal government, establish uniform rules of naturalization and uniform laws of
Bankruptcies, to regulate commerce with foreign nations and the several states as well as
Indian Tribes, to provide for the punishment of counterfeiting the securities and current coin of
the united States. To “coin” money, regulate the value thereof, and of foreign “coin” and fix
the standard of weights and measures, to promote the sciences and useful arts, constitute
tribunals inferior to the Supreme Court, to establish post offices and post roads, declare war
and raise and support armies and a navy and create the powers for said armies and the navy.
The above are the limitations. Question being presented today. What is providing for the
general welfare of the people? Is Snap benefits, Section 8 housing, free health care and the
like a part of providing for the general welfare of the people? The answer may surprise you.
Back in 1828, Noah Webster wrote the first US Dictionary. His reason? He saw that lawyers
and politicians were constantly trying to change the meaning of the words used in the Federal
Government's Constitution. His intention was to preserve the original meanings of the words
used in the Constitution. That dictionary is now available online. We looked up the word
welfare. Here is the meaning as it existed in 1828. Welfare: noun. 1. Exemption from
misfortune, sickness, calamity or evil; the enjoyment of health and the common blessings of
life; prosperity; happiness; applied to persons. 2. Exemption from the unusual evil or
calamity; the enjoyment of peace and prosperity, or the ordinary blessings of society and civil
government; applied to states.
What the definition does not state is that government is responsible for proving the people
with food, clothing, health care, money, housing or the like. Providing for the welfare of the
people is actually providing for the protection of the people to enjoy the freedoms of their own
prosperity. It was meant as a limiting power and not an ever expanding power. So let's go to
the top authority here. James Madison who spoke as President on the powers given to
Congress through the US Constitution regarding Proving for the common defense and
general welfare.
Madison speaking on the Bonus Bill stated the following: The power to regulate commerce
2. among the several States can not include a power to construct roads and canals, and to
improve the navigation of water courses in order to facilitate, promote, and secure such a
commerce without latitude of construction departing from the ordinary import of the terms.....
To refer the power in question to the clause “to provide for the common defense and general
welfare” would be contrary to the established and consistent rules of interpretation, as
rendering the special and careful enumeration of powers which follow the clause nugatory
and improper. Such a view of the Constitution would have the effect of giving Congress a
general power of legislation instead of the defined and limited one hitherto understood to
belong to them.
Again, James Madison in 1794 wrote disapprovingly of a $15,000.00 appropriation for
French refugees: “I cannot undertake to lay my finger on that article of the Constitution which
granted a right to Congress of expending, on objects of benevolence, the money of their
constituents.”
1796 William Giles of Virginia condemned a relief measure for fire victims and insisted that
it was not the purpose nor the right of Congress to “attend to what generosity and humanity
require, but to what the Constitution and their duty require.”
1827, Davy Crockett, House of Representatives, Tennessee: “We must not permit our
respect for the dead or our sympathy for the living to lead us into an act of injustice to the
balance of the living. I will not attempt to prove that Congress has no power to appropriate
this money as an act of charity. Every member upon the floor knows it. We have the right as
individuals to give away as much of our own money as we please in charity; but as members
of Congress we have no right to appropriate a dollar of the public money.
1854; President Franklin Pierce; “I cannot find any authority in the Constitution for public
charity.”
President Grover Cleveland vetoed hundreds of spending bills during his two terms in office.
He famously wrote, “I can find no warrant for such an appropriation in the Constitution.”
1828; William Drayton, Senator, South Carolina reminded his peers; “If Congress can
determine what constitutes the general welfare and can appropriate money for it's
advancement, where is the limitation to carry into execution whatever can be effected by
money?'
Where we are today is up to you to decide if we are on the right course. History is clear on
the real limitations on our representatives. But are they following those limitations?
