The Competition Commission of India found 11 shoe manufacturers guilty of cartelization and collusive bidding in a government tender. The CCI held that the manufacturers quoted nearly identical prices and imposed supply restrictions, in violation of competition laws. The manufacturers argued there was no agreement or evidence of bid-rigging. However, the CCI did not find their explanations credible and fined the companies Rs 6.18 crore. On appeal, the COMPAT set aside the CCI order, holding that identical pricing alone did not amount to cartelization, as the CCI failed to properly consider the market conditions.
