Plaintiff, Liberty Federal Credit Union formerly known as Evansville Teachers Federal Credit
Union, by counsel, having filed an Application for Default Judgment and Affidavit of Debt, Non-
Military Service and Competency and the Court being duly advised in the premises now finds:
1. Defendant, Gabriel M. Whitley, was duly served withprocess hereinby Sheriff, which
return on service is reflected in the Court's file herein.
2. This Court has jurisdiction over the parties and the subject matter of this case.
3. Defendant, Gabriel M. Whitley, has failed to timely enter an appearance, file a
responsive pleading, or otherwise comply with the Indiana Rules of Trial Procedure. Having failed
to appear or answer, Defendant is, pursuant to Trial Rule 55, hereby defaulted.
4. Defendant is not known to be an infant or incompetent or in the military service of the
United States.
5. Plaintiff is entitled to the relief prayed for in the Complaint and the Application for
Default Judgment should be granted.
6. Plaintiff, Liberty Federal Credit Union formerly known asEvansville Teachers Federal
Credit Union, is entitled to judgment in the principal amount of $7 56.41 , plus prejudgment interest in
the amount of $113.03, plus attorney's fees in the amount of $250.00, plus post-judgment interest and
costs.
2. IT IS THEREFORE CONSIDERED, ORDERED, ADJUDGED AND DECREED thAt
Plaintiff, Liberty Federal Credit Union formerly known as Evansville Teachers Federal Credit Union,
have judgment against and recover from Defendant, Gabriel M. Whitley, the sum of $l ,ll9.44rplus
costs, and said judgment shall bear interest at the statutory rate per annum from the rendition hereof
until paid.
