3. Definition of Terms
Discipline -behavior in accord with rules of
conduct to bring under control, to punish.
In any organization, a kind of
discipline must be present in order that subordinates
can willingly carry the instructions of their superiors
and abide by established and known rules of conduct
in the organization.
4. Disciplinary Action - the action taken to
correct faults of employees.
Disciplining Authorities - the officers who have
the ultimate power to investigate the offending
official/employee and impose the corresponding
penalty for the offense committed.
Disciplinary Jurisdiction - the power vested in the
disciplining authority.
5. Grounds for Disciplinary Action
Grave Offenses with DISMISSAL as the
penalty for the first offense:
Dishonesty
Gross Neglect of duty
Grave Misconduct
Being notoriously undesirable
Conviction of a crime involving moral turpitude
Falsification of official documents
6. Physical/mental incapacity or disability due to
immoral or vicious habits
Engaging directly or indirectly in partisan
political activities by one holding non-political office
Receiving for personal use of a fee, gift or other
valuable thing in the course of official duties, when
such is given by any person who expects a favor or
better treatment than that accorded to other persons or
committing acts punishable under the anti-graft laws.
Contracting loans of money or other property
from persons with whom the office of the employee has
business relations.
7. Soliciting or accepting directly or indirectly any
gift, gratuity favor, entertainment, loan or anything of
monetary value wherein a transaction is affected by the
functions of the office of the employee. A thing of
monetary value is one which is evidently excessive by
its nature.
Nepotism
Disloyalty to the Republic of the Philippines.
8. Other Grave Offenses with Suspension for Six
months and one day to one year penalty for the
first offense and dismissal for the second offense:
Oppression.
Disgraceful and immoral conduct.
Inefficiency and incompetence in the
performance of official duties.
Frequent unauthorized absences, or
tardiness in reporting for duty or loafing during
regular office hours.
Refusal to perform official duties.
9. Gross insubordination
Conduct prejudicial to the best interest of the
service
Directly or indirectly having financial and
material interest in any transaction requiring the
approval of the office of the employee. Financial and
material interest is a situation where one will lose or
gain something.
Owning, controlling, managing or accepting
employment in any private enterprise regulated,
supervised or licensed by his office unless expressly
allowed by law.
10. Obtaining or using any statement filed under
the Code of Ethical Standards for Public Officials and
employees for any purpose other than by news and
communication media for dissemination to the general
public.
Recommending any person to any position in a
private enterprise which has a regular or pending
official transaction with his office unless such referral
or recommendation is allowed by law or as a part of
the functions of his office.
Disclosing or misusing confidential or classified
information officially known to him because of his
office and not made known to the public for his own
personal interest and give undue advantage to others.
11. Less Grave Offenses with penalty of suspension
of one month and one day to six months for the
first offense and dismissal for the second offense:
Simple neglect of duty.
Simple misconduct.
Gross discourtesy in the course of official
duties.
Violation of existing CSC law or rules of
serious nature.
Insubordination.
Habitual drunkenness.
12. Unfair discrimination in rendering public service
due to party affiliation or preference.
Failure to file SALN.
Failure to resign from position in the private
business enterprise within 30 days from assumption of
public office when conflict of interest arises, and/or
failure to divest himself of his shareholdings or interest
in a private business enterprise within 60 days from
assumption of public office when conflict of interest
arises. If already in the public service and conflict of
interest arises, resign or divest within the scheduled
periods from the date conflict of interest had arisen.
13. Light offenses with the penalty of reprimand for the
first offense, suspension for one day to 30 days for
the second offense and dismissal for the third
offense:
Discourtesy in the course of official duties
Improper or unauthorized solicitation of contributions
from subordinate employees and by teachers/school
officials from school children
Violation of reasonable office rules and regulations
Frequent unauthorized tardiness (habitual tardiness)
Gambling prohibited by law
Refusal to render overtime services.
14. Disgraceful, immoral or dishonest conduct prior to
entering the service.
Borrowing money by superior officers from
subordinates.
Lending money at usurious rates of interest.
Willful failure to pay just debts or taxes due to the
government.
Lobbying for personal interest or gain in legislative
halls and offices without authority.
Promoting the sale of tickets in behalf of private
enterprises that are not intended for charitable or
public welfare purposes, and even in the latter, if
there is no prior authority.
15. Failure to act promptly on letters or requests within 15
days from receipt except as otherwise provided in the
rules implementing the Code of conduct and ethical
standards for public officials and employees
Failure to process documents and complete action on
papers and documents within a reasonable time from
preparation thereof unless provided in the CCESPOE.

Failure to attend to anyone who wants to avail himself
of the services of the office or act promptly and
expeditiously on public transactions
Engaging in practice of his profession when authorized
by law or regulation provided such practice will not
conflict with his official functions

then one who knows the law has no reason to
violate it. If he does, he should be penalized all
the more….

17. Duties and Responsibilities of a Teacher:
Teaches various subjects assigned to them in the
elementary/secondary schools.
Enrolls pupils/students.
Evaluates pupils’/students’ progress and
provides various experiences for their continuous
development.
Works with other school personnel, parents and
the community for the total development of the
children.
18. Keeps students and school records and prepares
required reports.
Supervises curricular and co-curricular projects
and activities of the children.
Provides guidance services to the pupils/students.
Participates in the socio-economic development
projects in the community.
Coordinates and cooperates with other teachers
in school projects or activities.
Does related work.
19. Additional duties of a Master Teacher:
Shall have regular teaching load.
Assists other teachers in the school toward
improving their competencies.
Takes leadership in the preparation of
instructional materials.
Serves as demonstration teachers or teacher-
consultant in other schools.
Performs other functions commensurate
with their capabilities as the principal may assign.
20. Duties of a School Head
Setting the mission, vision, goals and objectives
of the school.
Creates a school environment conducive to
learning.
Implements the school curriculum and is
accountable for higher learning outcomes.
Developing the school educational program
and school improvement plan.
Offers educational program, projects and
services which provide equal opportunities for all
learners in the community.
21. Introduces new and innovative modes of
instruction to achieve higher learning outcomes.
Administers and manages all personnel,
physical and fiscal resources of the school.
Recommends the staffing complement of the
school based on its needs.
Encourages staff development.
Establishes school and community networks
and encourages active participation of teachers
organizations, non-academic personnel and
PTAs.
22. Accepts donations, gifts, bequest and grants for
the purpose of upgrading teachers’ learning,
facilitates competencies, improving and expanding
school facilities and providing instructional materials
and equipment. Such donations and grants must be
reported to the Division Superintendent.
Performs other functions assigned by proper
authority.

The right to full access to the evidence in the case.
The right to defend himself and to be defended by a
representative of his choice.
The right to appeal to clearly designated authorities.
25. No discrimination whatsoever in entrance to the
teaching profession.
Academic freedom in the discharge of their
professional duties, particularly with regard to
teaching and classroom methods.
The right to freely establish or to join
organizations of their choosing, whether local or
national to further and defend their interests.

years of service. No teacher shall be allowed to

additional semester to finish his thesis for a graduate study in
education or allied courses. No compensation shall be due the

shall be considered in computing length of service.
