Law Enforcement against the Crime of Fraud through Funds Transfer Study at Po...ijtsrd
Fraud using SMS short message services is usually carried out by perpetrators by sending SMS to random recipients using a send to many system more than one recipient of the message or some kind of broadcast message. Then the perpetrator waits for several responses which are then followed up with lies and ruses so that the victim transfers some money. A crime that is still a complex problem is that criminals use SMS as a medium to find victims with the mode of asking the victim to transfer a certain amount of money with certain tricks until the potential victim actually follows the perpetrators wishes. Based on this description, the authors found problems in this research, namely legal arrangements regarding the criminal act of fraud through the transfer of funds in Indonesia, law enforcement against the crime of fraud through the transfer of funds at the Medan Polrestabes. The purpose of the study is to find out the legal arrangements regarding the criminal act of fraud through the transfer of funds in Indonesia, to find out law enforcement against the crime of fraud through the transfer of funds at the Medan Polrestabes. The research method used is normative juridical research positive law , data collection techniques are conducting library research by reading books, scientific works, legislation, lecture materials, as well as through internet media websites , field research by conducting interviews with The related party is the Medan City Resort Police. From the results of the research conducted, the authors conclude that the legal regulation regarding the criminal act of fraud through the transfer of funds in Indonesia is Article 378 of the Criminal Code, the threat of which is a maximum of 4 years in prison, Article 28 paragraph 1 of Law Number 19 of 2016 concerning Amendments to Laws Law Number 11 of 2008 concerning Information and Electronic Transactions, Article 82 of Law Number 11 of 2011 concerning Transfer of Funds, imprisonment for a maximum of 4 four years and or a fine of a maximum of Rp. 1,000,000,000.00 one billion rupiahs . Law enforcement against criminal acts of fraud through transfer of funds at the Medan Polrestabes conducted an investigation into SMS media fraud with the mode of transfer of funds, officers immediately asked for the perpetrators data to find out the identity of the perpetrator. Investigators study the traces left by the perpetrators, complete the facilities and infrastructure at the Medan Besar City Resort Police such as cyber tools and improve the ability of members related to technology understanding. The next legal process is the trial process. H. I chose law studies and, then, to specialize in criminal law and new technologies, on the one
hand for the innate propensity to defend those who are in difficulty and have no tools and / or
capacity to protect themselves and adequately, on the other hand because I have always been
extremely fascinated by the potential, and also by the risks, of new technologies. Moreover, I
have always been fascinated by the fact that we could use them to remedy to the economic
backwardness of my native land, Sicily. Following the numerous work, study and collaboration
experiences with companies from all over Italy, my own personal ambition is to grow culturally
and professionally in a dynamic, interdisciplinary and evolved environment, where my analytical
and research abilities, also in terms of problem solving, can be used to bring value to Italy. I do
not want to be unnecessarily self-referential, so I refer to Prof. Fabio Macioce - Professor of
Philosophy of Law at LUMSA (https://www.slideshare.net/slideshow/embed_code/key/3YNF6bRVE92HHx) and to my

a more accurate and impartial description of my abilities.
In March 2014 I obtained a master's degree in law with 110/110 cum laude at the LUMSA
University of Palermo, with the Thesis in Criminal Procedural Law called "The Atypical
Testimonies in Criminal Proceedings".
Immediately afterwards I started the legal practice at the law firm of Donatella Buscaino, a
criminal and family law expert, and in September of the same year I was hired as a trainee
pursuant to art. 73 of Legislative Decree 69/2013 at the Criminal Section of the Court of Trapani,
a hearing area, alongside a Magistrate acting as a Monocratic Judge, alongside the College and
Review Judge.
In February 2017 I became a lawyer and, moreover, I won the "Giovanni Falcone and Paolo
Borsellino" scholarship for the research project: "Organized crime in the digital age: the new
frontiers of the deep web and bitcoins", concluded on 22 December 2017.
Since then I have continued my studies in the field of cybercrimes and cryptocurrencies and
started fruitful collaborations with legal journals, the National Anti-Money Laundering
Observatory and the Municipality of Naples as a member as a member of the "Napoli Blockchain"
Working Group, Normative Section, for the analysis of legal issues related to project
development for public administration innovation through the use of cryptocurrencies and the
blockchain.
In 2018 I founded Crypto Avvocato, a network of professional experts in the legal, economic and
technology fields & innovative companies. The goal is to assist users in every field, developing
their projects and protecting them from the risks of the web.
In March 2019, I was appointed a member of the national council of Italia4blockchain, an
important association for training and dissemination in the field of digital innovation & blockchain
and in May of that year I became Scientific Advisor of Scrypta Foundation, an autonomous
organization, legally regulated, which represents and finances projects related to the Scrypta
blockchain architecture.

sentences of the Collegiate Court, together with the Trainees alongside other Magistrates, I
could reinforce my own capacity for team collaboration.
In this way, during this intense period, I could understand the complex dynamics that govern the
jurisdiction and also greatly enrich my knowledge in civil and criminal matters through the
periodic participation in the seminars hold by the Scuola Superiore della Magistratura and the

The association, currently made up of about 60 members, pursues the ambitious goal of

or the reference month.
In March 2017 I was elected President of the Board of Directors, the body, composed of 7
members elected by the assembly, which, together with the three members of the Bureau, is

Encouraged to undertake the career of the jurist by those who saw in me an innate propensity
for dialectics, I grew up, culturally and professionally, thanks to a course of study - that of LUMSA
- which allowed me to understand the benefits that the legal professions can produce in the
social sphere. The university career, characterized by the attendance of optional courses aimed
at enriching the juridical and philosophical knowledge of the law, ended with the drafting of a
Degree Thesis in Criminal Procedural Law called "Atypical Testimonials in Criminal
Proceedings".
In the approximately 300 pages of discussion all forms of testimony were examined, starting
obviously from the direct one up to the most unusual, such as that of the Pope.
From this derives the use of the atypical term, which has been understood in a double sense:
first of all in the traditional sense, that is, to indicate a means of proof whose methods of
assumption are not governed by the law (and this with reference to the hostile testimony) . And
also, in a broad sense, with reference to those models of testimony which, although typified,
deviate from the "traditional" direct model made in the debate.

topicality of the opposition between the West and the Middle East", aimed at examining the origin
and motivations underlying the historical contrast between the Middle Eastern and Western
cultures. More precisely, through a preliminary in-depth examination of the phases that
characterized the relations between the Middle East and the West, since the Persian Wars, the
paper finally analyzes the most recent problems - energy crisis, religiously motivated terrorism,
interference by the West in middle-politics, freedom of expression and thought in one and in the
other reality - through the critical gaze of writers of our time such as Oriana Fallaci and Salman
Rushdie.

Conference organized in Cagliari by Ev Lab Training School to discuss digitization, IOT,
Blockchain and tokeneconomy cybersecurity, new processes and technologies that, if properly

7 February 2018 – "How to defend yourself against cyberbullying"
II national day for the fight against bullying and cyberbullying - Istituto Superiore Rosina Salvo
of Trapani. I informed the students about the measures that can be taken to prevent and combat
the phenomenon, in the family and school environment, and I analyzed the reasons why IT tools
have increased the dangers and the legislator had to dictate the specific legislation referred to
the L 71 of 2017. My intervention followed that of the Dr. Gianleandro Catania, web project
manager, aimed at making students aware of the correct use of social media and that of
theProfessor Alessandro Bertirotti, Vice-Secretary General of the NGO UNEDUCH-CCLPW at
the UN and the EU, “Bullying at home, at school and in the world ", which described and analyzed
the phenomena of bullying and cyber-bullying that occur even outside the school world.

Meeting on responsible use of the web and social networks.
During the meeting, addressed to teenagers and parents, I exposed the dangers deriving from
a poor use of the web and the techniques to avoid them. In particular, my intervention focused
on child pornography, online priming of minors, cyber stalking, phishing and cyber bullying.

Giovanni and Francesca Falcone Foundation
Research thesis:
"Organized crime in the digital age: the new frontiers of the deep web and bitcoins".
Originating from the research project won for the “Giovanni Falcone and Paolo Borsellino”
Scholarship in the year 2016, the paper analyzes the investigative strategies and the instruments
adopted, at national and foreign level, to fight against organized crime, including terrorist mold,
and child pornography, in cyber space, in particular, in the so-called "Deep web".
The aim of the paper is not only to carry out the current regulations, the means and techniques
adopted to combat these forms of crime at national, European and international level - as well
as the pertinent jurisprudential issues of greater importance - but, especially, to indicate new
possible investigative approaches and assess the proportionality of the tools used both on the
basis of the different virtual operating fields in which the operator finds himself acting (surface
web / deep web / dark web) and of the computer defenses adopted by the cyber criminal.
On 22 December 2017, the results of my work were discussed at the University of Palermo, in
the Department of law, and approved by the judging committee. Since then, the paper is
