community correctional agencies benefit from them?
· What was the ex parte United States court case? What was its
impact on modern probation?
· What are the two kinds of suspended sentences? How do they
differ, and how does the distinction between them affect the
organization of our modern probation system?
· Explain how parole works in light of mandatory release and
discretionary release.
· Assume that you are part of a committee that evaluates
medical parole prisoners. Based on the following two factors,
please determine whether he or she should be released early on
medical parole:
1. That he or she is no longer a risk to public safety if released
into the community.
2. That he or she has a verifiable terminal medical condition OR
a permanent medical condition that limits movement OR a
medical condition that could be treated less expensively in a
community treatment facility.
Tony has served 40 years in prison for a highly publicized
murder case that he committed when he was 20 years old. He
has been a model inmate. He was a clerk in the new library that
he quit five years ago when he was diagnosed with a brain
tumor. The tumor was cancerous, so he received chemotherapy
and radiation for two years, but that did not completel y stop the
cancer from spreading. Tony is 62 now, he is bedridden,
breathes and eats through a tube, and takes pain medication to
ease his suffering. He has been deemed not to be a danger to
anyone. It costs the state $1000.00 per day; whereas a
community hospice could provide the same medical care for
$500.00 a day. However, his case was a high-profile murder
case, and the victim's survivors said they will never forgive
Tony.
