Filing of the frivolous objections shall constitute an election offense
punishable under the Omnibus Election Code. For this purpose, the
EB is allowed to administer oaths so that if the protest is frivolous,
falsification or perjury charges may be filed.
d. At the close of polls, the EB shall then place the VVPAT receptacle
inside the ballot box.
Sec 75. Manner of Voting
Ballots may berejected by the VCM during the scanning. There will be three
(3) different types of messages when VCM rejects a ballot:
a. Misread ballot – When a ballot has not been scanned properly for this
purpose, the EB shall allow the voter to re-feed the ballot four times (4)
times in four (4) different orientations;
b. Previously Read Ballot – When a ballot with the same ballot ID number
was already scanned; and
c. Invalid Ballot – When the Ballot is not configured to the VCM. The voter
shall return the ballot to the chairperson who shall in turn, check if the
ballot ID of the rejected ballot corresponds to the clustered precinct
number. If it does not match, the chairman shall mark the ballot with the
word “REJECTED” and place the same inside the envelope for rejected
ballots. The chairperson shall then issue the correct ballot to the voter.

The holding area shall be used by the voters waiting for their turn to vote. The voters shall sit and arrange themselves on a first-come, first-serve basis, such that they will vote according to the sequence of their arrival.
Giving numbers to the voters to determine their sequence of voting is strictly prohibited. Voters in the holding area shall be assisted by EB support staff.

#96 For most of the populace, the polling place is the site of the Elections; the polling place is the foremost physical manifestation of the preparations and the state of the Elections. A well laid out polling place conveys to the voters that process is safe and secure, that everything is as it should be. Thus, setting a polling place to meet this expectation is an understated imperative.
However, this requirement is becoming more difficult considering factors such as existing security conditions and the present pandemic. Preventing, or at least mitigating, the plethora of situations that may disrupt the orderly conduct of Elections is a serious concern of all election managers and poll workers. In addition, the present pandemic gives election planners a pause to take into account ventilation and social distancing. In as much as members of the Electoral Board are primarily responsible for the polling place, they must take heed of these considerations.
#106 The Poll Clerk shall:
2. If the voter’s name is found, check, without touching the voter, the fingernails, for any indelible ink stain.
If stained, it shall be a conclusive presumption that the voter has already cast his/her vote. As such, the voter shall be directed to leave the polling place after informing him/her the reason thereof. This fact. Including the name of the precinct of the voter, shall be recorded by the Poll Clerk in the Minutes;
3 . If the fingernail is not stained, establish the identity of the voter through the following:
i. Voter’s photograph or specimen signature in the EDCVL. In case the identity of the voter cannot be determined with certainty in the EDCVL, the EB may require the voter to present any valid identification document, except barangay certificate or community tax certificate; or
ii. In the absence of any of the above-mentioned proof of identity, any member of the EB or any registered voter of the precinct/clustered precinct may identify under oath the voter, and such fact shall be reflected in the Minutes
#107 b. The Poll Clerk shall:
4. If satisfied with the voter’s identity, the name of the voter shall be distinctly announced in a tone loud enough to be heard throughout the polling place.
If not satisfied with his/her identity, the voter shall be directed to leave the polling place after informing him/her of the reason therefore.
5. If the voter is not challenged or having been challenged, the question has been decided in his/her favor, require the voter to sign in the EDCVL.
In the case of illiterate voters or PWDs who cannot sign, require said voters to affix their thumb marks in the EDCVL
#153 And, so we now take the entrance to the PP. At least 3 days before the conduct of the FTS, the members of the EB, DESO and their SS shall set up the PP in this manner:
Strategically arrange the chairs and tables with 1–meter apart distance;
Install hand sanitation station beside or near the door
Post a clear and visible sign saying: “PERSONS NOT PROPERLY WEARING MASK AND SHIELD SHALL NOT BE ALLOWED INSIDE”.
Then post PCVL, near or at the door of the PP, with pages/sheets spread out to give free access to voters who are checking their names in the list.
Fifth is install a plastic barrier between EB members & voters. In coordination with the DESO, designate an adjacent room as waiting room with the same chair arrangement – that is, 1 meter apart. This is for the voters who are waiting for their turn to vote and shall sit on a first come, first serve basis. Note that the “Giving numbers to the voters to determine their sequence is STRICTLY PROHIBITED.”
6. The last on is the provision of trash boxes/bags for easy
disposal of all medical wastes – like the face masks, face
shield, gloves.

If after sealing the BB, the EB discovers that some election documents required to be put inside were no placed, the EB shall deliver the same to the EO. Note that the BB cannot be reopened except upon prior authority of the Commission. In case it must be duly opened, notice must be sent to the EB, treasurer, and watchers.
