Two men linked to a white supremacist group called Blood and Honor have been charged with assault causing bodily harm for setting a Filipino man sleeping on a discarded couch on fire, as well as two other assaults in 2008 and 2009 targeting a black man and Hispanic man. The 25-year-old Filipino man suffered severe burns to his head, neck, and arms but was able to douse the flames by finding a nearby pond, and the men are now in court awaiting punishment for their hate-motivated crimes.

Two landmark rulings made by the Supreme Court involve the cases of Plessy v. Ferguson and Miranda v. Arizona. In both rulings the impact to society was great with one resulting in the segregation of African American citizen for the next fifty years while the other affected the way law enforcement officers’ question and interrogate criminal offenders. While both of these cases occurred in two different centuries the ruling of the court had a direct impact on functions in American society and the rights of the individual citizen. In Plessy the rights of the African American where limited but in the case of Miranda individual rights were broadened.
Plessy vs. Ferguson
In the case of Plessy v. Ferguson the case began when an African American male who was half white and appeared white went against a Louisiana law that requires separate accommodations for separate races. Homer Plessy was a member of a group in New Orleans known as the Citizens Committee that fought for the equal right of the African American citizen. The Citizens Committee decided to test a Louisiana Law known as the 1890 Louisiana Separate Car Act. When Homer Plessy entered the train and took accommodations in the white section of the railcars he was detained by a police officer and held in a separate car until he was arrested upon exiting the train. Plessy was charged with breaching Louisiana Law and was jailed and fined.
On appeal the Louisiana Appeals Court ruled declared forced segregation in railroad cars traveling between states to be unconstitutional (Wolf, 2011). The case was then appealed to the Louisiana Supreme Court that upheld the ruling of the district court and found the state had a right to establish laws that provide separate but equal accommodations. The case was then appealed for the last time when it went in front of the Supreme Court. The Supreme Court ruled in favor of the state and the laws concerning the segregation of the White and African American citizen was not addressed for over sixty years when the Supreme Courts ruling was reversed in the case of Brown vs. Board of Education.
When the Plessy case was brought in front of the Supreme Court by the defendant and the members of the Citizens Committee the claim was the defendant was denied his Fourteenth and Thirteenth Amendment rights. Plessy claimed that the 1890 Louisiana Separate Car Act violated his Thirteenth Amendment right against involuntary servitude. In other Plessy was claiming that by being forced into separate accommodations he was being placed in involuntary servitude. The court ruled that the Thirteenth Amendment did not apply to segregation so the defendants Thirteenth Amendment right could not have been violated.
Under the Fourteenth Amendment the defendant, Plessy, claimed he was denied the right to equal protection.

Welcome to the United States Department of Justice Page 1 of 1 Department of Justice Office of Public Affairs FOR IMMEDIATE RELEASE Thursday, April 30, 2009 Three South Carolina Men Indicted on Federal Civil Rights Charges A federal grand jury in Florence, S.C., indicted three men from Marlboro County, S.C., on charges relating to their attack on an African-American man and two white men i December 2007. in Thomas Howard Blue Sr., 48, Thomas Howard Blue Jr., 28, and Judson Hartley Talbert, 34, were t charged in a 21-count indictment with violating and conspiracy to violate the civil rights of three South Carolina citizens, carjacking, use of fire to commit a felony, use of a firearm in relation to a crime of violence, evidence tampering and grand jury perjury. Each civil rights count carries a sentence of up to 10 years in prison and $250,000 fine. A trial has not yet been scheduled. An indictment is merely an accusation and defendants are presumed innocent unless proven guilty. The grand jury charged that Thomas Howard Blue Sr. forcibly escorted Dahndre Moore out of his D e establishment known as the Stop and Shop because Moore is African-American. Once outside, Thomas Howard Blue Sr. forced Moore to the ground a Thomas Howard Blue Jr. threatened Moore with a and . chainsaw. While Moore was being attacked by the father and son, Judson Hartley Talbert stole Moore’s W car and drove it to a site along the Great Pee Dee River known as Blue’s Landing. After being chased by the Blues, Moore escaped by running up the road and seeking refuge in a local home. According to the indictment, Thomas Howard Blue Sr. retrieved a pistol and attacked Jackson Hayes, a white man whom Blue believed to be aiding Moore, and used the pistol to threaten another white man, Jamie Gray, who came to the Stop and Shop to retrieve Moore’s car. Thomas Howard Blue Sr. and Judson Hartley later burnt Moore’s car in an attempt to cover up their crimes. The indictment also y T alleges the three defendants committed perjury when testifying before a federal grand jury that was investigating the incident. The case is being investigated by FBI Special Agent Steven Stokes with assistance from Special Agent Jeff Key of the Bureau of Alcohol, Tobacco, Firearms & Explosives and Investigator Shawn Feldner of the Marlboro County Sheriff’s Department.
