The executive and federal judiciary

3. 1. According to article number 41, clause 1-6:
The President is head of state and shall be not less than 45 years of
age.
He must possess all qualities as enshrined in article 62.
He Shall be elected by an electoral college which shall comprise of all
the members of the both the houses of Parliament and all the members
of provincial assemblies.
The election of president shall take place not earlier than 60 days and
not later than 30 days from the time of expiry of the term of office.
2. Under article 42 the president shall take oath under third schedule.
3. Under article 43 the President shall not hold any office of Profit under
government of Pakistan and shall not contest for membership of
national or provincial assemblies, however if a member of parliament
and provincial assembly get elected as President then their seat will be
considered vacant.

I, ____________, do solemnly swear that I am a Muslim and believe in the
Unity and Oneness of Almighty Allah, the Books of Allah, the Holy Quran
being the last of them, the Prophethood of Muhammad (peace be upon
him) as the last of the Prophets and that there can be no Prophet after him,
the Day of Judgment, and all the requirements and teachings of the Holy
Quran and Sunnah:
That I will bear true faith and allegiance to Pakistan:
That, as President of Pakistan, I will discharge my duties, and perform my
functions, honestly, to the best of my ability, faithfully in accordance with
the Constitution of the Islamic Republic of Pakistan and the law, and
always in the interest of the sovereignty, integrity, solidarity, well- being
and prosperity of Pakistan:
That I will not allow my personal interest to influence my official conduct
or my official decisions:
That I will preserve, protect and defend the Constitution of the Islamic
Republic of Pakistan:
That, in all circumstances, I will do right to all manner of people, according
to law, without fear or favor, affection or ill- will:
And that I will not directly or indirectly communicate or reveal to any
person any matter which shall be brought under my consideration or shall
become known to me as President of Pakistan, except as may be required
for the due discharge of my duties as President.

5. 4. Under article 44 the president shall be elected for a term
of 5 years. The president can be reelected for two
consecutive terms and not more. The president may
resign from his office by submitting resignation to
speaker of National assembly.
5. Under article 45 the president can Pardon criminals.
6. Under article 54 the president can summon a meeting of
National assembly or senate.
7. Under article 58 president can dismiss the National
Assembly.
8. Under article 47 clause 1-8 state that president can be
removed from office through impeachment on grounds of
physical and mental incapacity.
9. Under article 49 clause 1 the president shall be succeeded
by the Chairman senate and then by Speaker of national
assembly.
6. 1) Under Part III chapter 3 article 90 the powers of
Federation shall be exercised in name of President by the
prime minister and federal ministers.
2) Under article 91 Prime minister will be the head of
Federal cabinet and will perform administrative duties of
federation.
3) Under article 92 states that the number of federal and
state ministers who are members of senate shall not
exceed 1/4th . The prime minister shall elect a cabinet and
ministers of state from the parliament not exceeding 11%
of the total strength of parliament.
4) Under article 95 the members of national assembly can
pass a vote of non-confidence against the prime minister,
provided that 20% of the members support pass a
resolution and three day have passed, the parliament is
not considering any grants/demands for annual budget
statement and the resolution is supported by majority of
the members.
7. 1. Under Part VII Chapter 1 article 175 clause’s 1-3 the Judicial
organ of the state of Pakistan shall comprise of :
A. Supreme Court
B. High court (one for each province)
C. High court for Federal capital
D. Other courts as provided under law (District and session
courts, Revenue courts, criminal courts, model courts,
consumer courts, labor courts…etc)
E. Federal Shariat court (Under article 203)
2. Under article 175(A) the judges of the respective courts will be
appointed by Judicial commission, comprising of:
a) Chief Justice of Supreme court.
b) 4 senior Judges of supreme court.
c) Former Chief justice
d) Federal minister of law and justice
e) Attorney General
f) Senior Advocate of Supreme court
8. 3. Under article 179 the retiring age for judges of
supreme court is 65 years.
4. Under article 184 the original jurisdiction of
Supreme court includes:
i. Decide the matter of dispute between two
governments.
ii. Pronouncement of declaratory judgment.
iii. Act on matters relating to fundamental rights.
5. Under article 185 Appellate jurisdiction includes:
i. Hear appeals from lower courts
ii. Acquittal of accused….etc
6. Under article 186 Advisory powers include:
i. Advise president on any question referred to it.
