Marijuana has been used for many millennia with some of the earliest mentions dating back to 2700
BCE in China. It has "long been considered valuable as an analgesic, an anesthetic, an
antidepressant, an antibiotic, and a sedative", it has also been "administered internally to treat
gonorrhea and angina pectoris" (Abdullah). Also, unlike many other drugs, "chronic use does not
establish a physical dependence, nor does the regular user suffer extreme physical discomfort after

figures for drug–related crimes in 2012 and it showed that a staggering 749,825 people were
arrested for marijuana related offenses; that is one arrest every 42 seconds. It also accounted for
48.3 percent of all drug arrests. Even with the recent upsurge in public support for the liberation of
the drug policy, police arrested the same number of people in 2012 on pot–related charges as they

Marijuana has been used extensively as a medical remedy for more than five thousand years. In the
early 1900s, medical usage of marijuana began to decline with the advent of alternative drugs.
Injectable opiates and synthetic drugs such as aspirin and barbiturates began to replace marijuana as
the physician 's drug of choice in the twentieth–century, as their results proved to be more consistent

While such popular and potent drugs (alcohol and nicotine) are legally available to the public, there
is fallacious logic in outlawing a drug less exponentially less dangerous and far less addictive than
these two easily accessible drugs. Alcohol and nicotine are infinitely more harmful to the human
body than marijuana, cannabis simply not toxic enough to kill (In Pot). Marijuana is demonized by
the government and much of the media as a dangerous drug, while the deaths of roughly 50,000
people in The United States per year can be contributed to alcohol and 440,000 to tobacco. All the
while, marijuana has never directly caused the death of anybody in the entire history of mankind
(Jillette). While some would expect marijuana to be at least as carcinogenic as tobacco, recent
medical journals have found no link between smoking marijuana and lung cancer (Boyles). One
example given in one study was that two–pack–a–day cigarette smokers saw a 20–fold increase in
cancer risk when compared to non–smokers, while no elevation in risk was observed in even the
heaviest (22,000+ joints smoked in lifetime) smokers of marijuana (Boyles). Any consistent person
that believes marijuana should stay illegal should also believe alcohol and cigarettes should be made

As these numbers increase the question of legalization in general across the states has become an
interesting and pressing issue. Multiple stances on both the pro and con side of the issue exist.
Supporting arguments often use studies to back up their claims. In an October 15, 2014 article in
The Washington Post, Christopher Ingraham writes of the non–negative aftereffects of the
decriminalization of marijuana. In particular he reviews a report from the Center on Juvenile and
Criminal Justice, which studied California, where full decriminalization began at the start of 2011.
Of interest the report states "marijuana decriminalization in California has not resulted in harmful
consequences for teenagers, such as increased crime, drug overdose, driving under the influence, or

The picture is quite complex and at odds with federal legislation, posing a major challenge in terms
of public policy design, implementation and evaluation. In the next sections, for analytical purposes,
the policy cycle will be divided in two major models: the legalization for recreational purposes (4
states) and legalization for medical purposes (in all of its forms) (33 cases).
3. Design stage
3.1 Policy design for recreational cannabis model
The main goal pursued by the legalization policies is to convert marijuana in a tradable commodity,
under similar conditions and treatment given to alcohol and tobacco. In this sense, the policy
approach is mainly directed to market development. The full legalization of cannabis in Colorado,
Washington, Oregon and Alaska (as well as the district of Columbia), is a recent phenomenon that
started in 2012. In all cases the process was triggered by ballot system, following the path
inaugurated by California in 1996 where the medical use of cannabis was approved (Anderson and
Rees, 2014). However, in some states like Oregon and Alaska, the process have started earlier with
two previous failed attempts, where the same proposition was defeated by ballot system.
