3. About California Family Court
• California Family Court judges can mandate a child
custody evaluation, also known as a 730 Evaluation,
during marital dissolution. In addition, either party
to the dissolution can request an evaluation. The
purpose of this evaluation is to have a professional
appraise the mental health and parenting practices
of either or both parents. The judge may choose the
evaluator from a pre-existing list of qualified
mental-health professionals, have the two parties
submit a list of potential evaluators, or let them
agree on an evaluator. However, state law limits the
type of people who can fulfill this function based on
education and professional experience.

4. Conclusion
• When making a report, evaluators focus on what
is in the best interest of the child. Factors they
look at include potential child abuse, illicit
substance use, questionable activities, and
mental and medical health issues. At the end of
the process, the evaluator files a report with the
court and both parties. The parents and/or
guardians can either agree to it or argue against
the document by selecting another evaluator to
challenge its findings.
