dell’uomo e, in particolare, per chiarire
quali siano le possibilità, ma anche i limiti
della sostituibilità del computer

19. Il concetto giuridico di creatività cui fa riferimento l'art. 1
della legge n. 633 del 1941 non coincide con quello di
originalità e novità assoluta … essendo la protezione
subordinata alla sola condizione che nell'opera sia
riscontrabile un atto creativo, sia pur minimo, suscettibile
di manifestazione nel mondo esteriore, la creatività non
può essere esclusa per il solo fatto che l'opera consista in
idee e nozioni semplici, già facenti parte del patrimonio
intellettuale di persone aventi esperienza nella materia
(Cassazione civile sez. I, 12/01/2018, n.658)
20. «…Va osservato a tale proposito che la creatività,
nell'ambito di tali opere dell'ingegno, non è costituita
dall'idea in sè, ma dalla forma della sua espressione, ovvero
dalla sua soggettività, di modo che la stessa idea può
essere alla base di diverse opere che sono o possono
essere diverse per la creatività soggettiva che ciascuno
degli autori spende, e che in quanto tale rileva per
l'ottenimento della protezione» (Cassazione civile sez. I,
28/11/2011).

human beings, is copyrightable at all”
23. “Maaherra claims that there can be no valid copyright in the Book because it
lacks the requisite ingredient of human creativity, and that

A "work made for hire" is-
(1) a work prepared by an employee within the scope of his or
her employment; or
(2) a work specially ordered or commissioned for use as a
contribution to a collective work, as a part of a motion picture
or other audiovisual work, as a translation, as a supplementary
work, as a compilation, as an instructional text, as a test, as
answer material for a test, or as an atlas, if the parties expressly
agree in a written instrument signed by them that the work
shall be considered a work made for hire

(b)WORKS MADE FOR HIRE.—In the case of a work
made for hire, the employer or other person for
whom the work was prepared is considered the
author for purposes of this title, and, unless the
parties have expressly agreed otherwise in a
written instrument signed by them, owns all of the
rights comprised in the copyright.
32. Art. 12-bis. Salvo patto contrario, il datore di lavoro è titolare del
diritto esclusivo di utilizzazione economica del programma per
elaboratore o della banca di dati creati dal lavoratore
dipendente nell'esecuzione delle sue mansioni o su istruzioni
impartite dallo stesso datore di lavoro.
Art. 12-ter. Salvo patto contrario, qualora un'opera di disegno
industriale sia creata dal lavoratore dipendente nell'esercizio
delle sue mansioni, il datore di lavoro è titolare dei diritti
esclusivi di utilizzazione economica dell'opera.
33. Punti di forza del modello WMFH
• E’ in linea con la teoria economica del copyright
• Assegna in modo chiaro la responsabilità sui
soggetti che controllano il sistema dei Intelligenza
Artificiale
• Consente di mantenere molti dei principi di base
del copyright, limitandosi ad emendare l’attuale
disciplina (quanto meno con riferimento agli USA)
