MDS 4100 Communication Law Case Study: Privacy CASE STUDY: PRIVACY You are a reporter for WKRN-TV, covering local police activity as part of your beat. Your editor tells you to get over to McGavock High School as quickly as possible. An anonymous caller, saying she lives across the street from the public school, told a news editor she heard four or five gunshots coming from the school building as she was outside walking her dog. Within seconds, she says, students were running outside and screaming. A listen to the police band receiver in the newsroom indicates something is up at the school. You take a videographer and arrive on the scene about 1:30 p.m. Five or six Metro police cars are parked near the school, and an ambulance arrives seconds later as you get out of your car. The entrance to the school building is blocked off and police are guarding the area, admitting no one except authorities into the building. After questioning police, you confirm the fact there has been a shooting, but that’s as far as you get. You begin asking bystanders for more information. A number of McGavock students have remained at the scene. Several tell you a student was shot in a first-floor restroom. A girl who claims to be a friend of the victim says his name is James DeVore, a freshman. She said she thinks he is 14 years old. Another student says DeVore recently turned 15. No one present knows who is responsible for the shooting. Minutes later police escort a young man, handcuffed, from the school building. They place him in a squad car and drive away. You ask people in the crowd if anyone can identify the alleged suspect. At least four tell you he is Brian Samuels, a sophomore. You ask police at the scene to confirm this information, but no one will reply. Your videographer tells you she got footage of the boy being placed in the squad car. While talking to her, you hear screams in the background. You run around the side of the building to the loading dock area. Police have taped off the immediate area but you can see what’s going on. EMTs are wheeling the covered body of the victim to an ambulance waiting near the dock. Some students are crying. The videographer gets shots of the body being placed into the ambulance and close-ups of crying students. You approach several police officers standing near a squad car, hoping to get more facts. Inside the squad car an officer is radioing into police headquarters. You hear him saying “the victim is James DeVore, age 15.” The officer radios that the suspect, Samuels, has admitted to the shooting. You also hear the following: “Samuels said it was it was payback, that DeVore had sexually assaulted Samuels’ 6-year-old sister.” Because you are under deadline, you decide not to interview the officers personally and head back to the station. Corey McMillon was angry. The teen in the camouflage sneakers had disrespected him.
One of McMillon's buddies had asked 17-year-old Jamel Jermaine St. Clair for $5, and Jamel had complied. Then McMillon asked for $1. This time, Jamel said no. A simple no too many, a slap in the face to McMillon.
He left, got his 9 mm semiautomatic handgun and confronted Jamel on a desolate East Baltimore street. After McMillon emptied Jamel's pockets, the teen turned and started to run.
McMillon shot him, then shot again and again and again.
"He was going to teach him a lesson," Tonya M. LaPolla, an assistant state's attorney, would go on to tell a jury. "As he approached the victim with his gun, Mr. St. Clair disrespected him only one more time by running, and you don't run on Corey Mac. Not only did he take his money, he took his life."
For decades, scientists have studied just what makes someone take a life, cross the line from angry person to violent killer. Baltimore has many Corey McMillons who kill brazenly, without remorse. Are they born with something broken or missing in their brains - impulse control, perhaps, or a conscience? What's the influence of their environment, of abusive parents, of dangerous neighborhoods, of violent video games?
"The question of why we as human beings are violent is one of the great unanswered questions about us," said Dr. Debra Niehoff, a Johns Hopkins-trained neurobiologist and author of the book The Biology of Violence: How Understanding the Brain, Behavior, and Environment Can Break the Vicious Circle of Aggression.
Humans are born with the capacity for aggression for survival purposes, an evolutionary need to be able to face down attack from wild animals, or from others invading their territory. "You have to be able to defend yourself," said Dr. Allan Siegel of the New Jersey Medical School, who has studied the neurobiology of aggression and rage for the past 40 years.
As they strive to learn more about the underpinnings of violent behavior, some scientists are researching genetic variations that may be present in those who are prone to violence. In one study, researchers discovered that the same variation in one gene seemed to be found in most of the study subjects who had arrest records.
Other scientists are looking at the brain's neurochemistry to see whether long-term exposure to dangerous situations or abuse throws off the fight-or-flight response system, causing violent overreaction to minor provocations.

A high school freshman creates a fake social media account for the purpose of tricking
another student. The fake account is used to show romantic interest in the targeted
teen, and many deceptive techniques are used to make the targeted teen think that the
fake account actually belongs to a real person. The holder of the fake account
eventually reveals the trick, posting screenshots on a popular social media platform of
embarrassing texts and admissions by the targeted teen. A few days later, the targeted
teen waits for the cyberbully outside of school and physically attacks the cyberbully,
sending the cyberbully to the hospital. The parents of the cyberbully want to press
charges against the targeted teen.
Week 3
Before the beginning of a school day, law enforcement arrest a 15-year-old student who
attends the local high school. Students, teachers, and even family members describe
the student as a “loner.” Some students do not even recognize the student, while others
are unaware of his name or refer to him in derogatory terms. The student does have a
small group of fellow students with whom he socializes sometimes during lunch, but it’s
unclear whether these are friendships outside of school. Teachers describe the student
as a good student but quiet. One of the student’s lunchtime acquaintances refers
investigators to a website where the student posts frequently under a screen name,
sharing tips for hacking and also anti-government views.

A 15-year-old holds up a corner convenience store using a gun. Although the offender
threatened the clerk with the gun, no one was injured. The 15-year-old has no prior
record. The offender did run from police when he spotted them coming up the walk to
his house, but once apprehended, he did not resist arrest in any other way.
The father of the offender is currently serving a prison sentence for assault, and he has

Will A Person's Education Level Affect His Possibility of Committing A Crime?
A well-established research on the correlation between education and criminality by Lochner (2020) brings out interesting results on this issue. The researcher examined the changes in the compulsory school learning (CSL) laws that ensure individuals are forced to stay in school longer than they would voluntarily choose to. Also, he examines how policy-induced measures help reduce crime by enhancing awareness creation and focus on education to provide platform for understanding the society in wider perspective. Additionally, he looked into the aspects of wage in the organizations as a direct influence of good lifestyles free from criminal activities. With all these critical points analyzed in the study, it became evident that education helps curb criminality by a substantive amount in the society (Wright et al. 2001).
First, the CSL laws confirmed that education has influence in eradicating criminal activities since the individuals were actively engaged in learning for considerable period of time. Then, they can apply knowledge obtained in school to undertake innovative practices. The innovative practices will provide incomes to them thus opting not to engage in criminal activities. Secondly, in the aspect of classic Becker model of crime, individuals who have secured jobs from education will opt to focus on work to improve their productivity and make their lives better. In this case, they will analyze the cost-benefits of employment and criminality (Cho, 2011). Since employment provides wages that sustains their lives, they opt to avoid criminality since risks include lack of freedom, jail term and death (Brown, 2001). Lastly, engaged individuals in schools learning or in workplace, lacks adequate time to allocate for criminal activities. Thus, it is evident education greatly lowers criminal behaviors (Cook & Kang, 2016).

International relation can be best understood through the various schools of thought or
rather theories. They are significant in giving a comprehensive detail of the constructs that make
international relations. Realism theory still remains one of the most influential tools in
understanding events related to international relations. This is because it provides a pragmatic
approach in examining current events in the sphere of international relations (Maghroori, pg. 17).
Realism is divided into three subdivisions, seeking to explain causes of state conflict. This
include classical realism that argues that the conflict comes from the nature of man, neorealist
which associates conflict the elements of the state, and neoclassical realism which associates it to
both human nature and elements of the state. This school of thought is grounded on some
fundamental principles that make the core of its arguments.
The first assumption in realism is the idea that a country, usually referred to as a state,
serves as the main actor in international relations. It acknowledges the fact that there are other

regard to matters of national interest. In addition, realists believe that the people who make

The Myth of Disability as Isolating in Tim Burton’s Edward Scissorhands
Jay Timothy Dolmage discusses the common disability myths that condition our
understanding of disability in his work Disability Rhetoric. He argues that these myths create the
perception that disabled people are “others”, through the portrayal of them as lesser, surplus, or
improper (Dolmage, 31). One of the myths that Dolmage examines is disability as isolating or
individualizing, which is perpetrated through narratives of disabled people living in isolation,
rarely having romantic relationships or friendships, and often being left alone at the end
(Dolmage, 43). This myth can be seen in the film Edward Scissorhands, directed by Tim Burton.
Edward is a human being created by an inventor, yet the inventor’s death before his completion
leaves him with scissor blades for hands. Edward lives in a gothic mansion atop a hill,
completely in isolation until local Avon saleswoman Peg Boggs visits. She is initially frightened
by his appearance, yet decides to take him home with her upon the realization that he is
harmless. Edward’s disability causes his transition into society to be largely unsuccessful, as he
is objectified and used by other people for their benefit, and at the end of the film he is forced to
return to living in isolation after their perception of him turns to one of fear and scorn.
Edward’s isolation from society is symbolically portrayed through many film design
techniques. The mansion in which he lives at the beginning and the end of the film starkly
contrasts the community in which the able-bodied society lives. The mansion is gothic, dark, and
partially in ruins, whereas the rest of the houses are brightly colored in pinks, yellows, and

greens, all with perfectly manicured green lawns. His appearance also separates him from the
rest of society, as he has very pale skin, dark under-eyes, black untamed hair, and wears gothic
industrial clothes. The able-bodied individuals often wear colorful or light clothes and appear
quite “ordinary”. The contrast created between Edward and society through set, clothing,
makeup, and hair design work to portray Edward and his disability as unusual, creepy, and
“other”. Peg even attempts to “normalize” his appearance by giving him different clothes to wear
and attempting to cover his scars with makeup, in the hopes that it will ease his transition into the
community. This film phenomenon is discussed by Martin F. Norden in his book The Cinema of
Isolation: A History of Physical Disabilities in the Movies. He argues that filmmakers will
separate disabled characters from their able-bodied peers not only through the storyline, but also

There are several different reasons why an intervention fails, such as the wrong intervention being selected or trying to solve the wrong problem. It is important that when performing and intervention that every thing have been severely observed and taken into consideration. I worked with an organization that was a travel agency, and they operated off of the commission that was collected from the booking that are processed, but they also provided a discount to the members that was taken out of the commission total. The issue was that when they initially opened the department there was no budget plan done and no guidelines were given, the agents were told to use discretion, and all though the department was a huge success in booking reservations they were still failing, because they were not withholding enough commission for the organization to operate under. Where the intervention process failed is that they never had formal training, which would have been a focus group to define the exact percentage to give to customer and the amount the organization needed to cover their overhead. During the meeting process there should have been definite guidelines to lead employees and managers from the accounting department so that the employees did not need to play the guessing game. Although they had the meeting nothing changed, because the problem was not solved with the employees and managers and was not addressed by the accounting department. The business is now in danger of folding because of the poor communication practices.

Although what I am going to talk about is not my workplace but the place that I volunteer my time to sit on the board of directors for a non profit agency. As a board member we oversee the agency as a whole but we also break down into small committee groups to address needs as they arise. One of the committees that I am on is the planning committee. A change that was implemented by administration, program staff, and the board was all departments would start entering all their own data. At the time the agency had two data entry personal that was entering all agency data. So the change we made was that instead of hiring another data entry person we would require all programs to enter their own data into the collection software. This ended up being a failure that could have been huge had we not pulled reports the first two quarters of the year. What we found was some programs were right on target with getting their information entered with the first quarter. The Executive Director addressed this with staff. When the second quarter reports were pulled the data did not get any better. As an agency this failed due to program staff just did not have the appropriate time to take on more data entry. The agency ended up where we should have to start off, hiring another data entry staff member. I will say with this failure it actually turned into a very positive experience over all.

Cellular respiration refers to all the metabolic processes and chemical reactions that take place in living organisms, particularly at the cellular level. These processes focus on the extraction of energy from nutrients. It is also responsible for converting the biochemical energy into 'adenosine triphosphate' (ATP) by the breakdown of sugars in the cells (Bennet 58). Cellular respiration is also responsible for the process by which cells release chemical energy required for conducting cellular activities. The reactions and processes facilitate the release of waste products from the cells. This experiment seeks to conduct a study of the processes and reactions involved during cellular respiration. The experiment will include several activities, such as having a study on the amount of Carbon dioxide produced during the experiment.
The number of levels of the growth of a yeast medium as a dependent variable will also be monitored during the experiment. There are other several independent variables associated with the experiment. These independent variables include sugar and temperature, among others, and their role in the experiment were also monitored. The experiment design involved the use of airtight balloons capped over reaction chambers that were used to collect the Carbon dioxide produced during the experiment. The reaction chambers contained sugars and yeast medium, which facilitated the reactions. Thermometers and pH scale were used to monitor the changes in temperature and acidity levels during the experiment. The paper involves a lab design that institute steps such as arranging the bottles used on the experiment. Methodology
The actual procedure for experimenting involved taking measurements and recording of all observations made during the experiment. A high school freshman creates a fake social media account for the purpose of tricking
another student. The fake account is used to show romantic interest in the targeted
teen, and many deceptive techniques are used to make the targeted teen think that the
fake account actually belongs to a real person. The holder of the fake account
eventually reveals the trick, posting screenshots on a popular social media platform of
embarrassing texts and admissions by the targeted teen. A few days later, the targeted
teen waits for the cyberbully outside of school and physically attacks the cyberbully,
sending the cyberbully to the hospital. The parents of the cyberbully want to press
charges against the targeted teen.
Week 3
Before the beginning of a school day, law enforcement arrest a 15-year-old student who
attends the local high school. Students, teachers, and even family members describe
the student as a “loner.” Some students do not even recognize the student, while others
are unaware of his name or refer to him in derogatory terms. The student does have a
small group of fellow students with whom he socializes sometimes during lunch, but it’s
unclear whether these are friendships outside of school. Teachers describe the student
as a good student but quiet. One of the student’s lunchtime acquaintances refers
investigators to a website where the student posts frequently under a screen name,
sharing tips for hacking and also anti-government views.
The student is arrested for hacking into multiple government websites, including the
Department of Defense and other highly secure areas.

A 15-year-old holds up a corner convenience store using a gun. Although the offender
threatened the clerk with the gun, no one was injured. The 15-year-old has no prior
record. The offender did run from police when he spotted them coming up the walk to
his house, but once apprehended, he did not resist arrest in any other way.
The father of the offender is currently serving a prison sentence for assault, and he has
a prior arrest for drug possession. The son reports that he recalls his father being

Will A Person's Education Level Affect His Possibility of Committing A Crime?
A well-established research on the correlation between education and criminality by Lochner (2020) brings out interesting results on this issue. The researcher examined the changes in the compulsory school learning (CSL) laws that ensure individuals are forced to stay in school longer than they would voluntarily choose to. Also, he examines how policy-induced measures help reduce crime by enhancing awareness creation and focus on education to provide platform for understanding the society in wider perspective. Additionally, he looked into the aspects of wage in the organizations as a direct influence of good lifestyles free from criminal activities. With all these critical points analyzed in the study, it became evident that education helps curb criminality by a substantive amount in the society (Wright et al. 2001).
First, the CSL laws confirmed that education has influence in eradicating criminal activities since the individuals were actively engaged in learning for considerable period of time. Then, they can apply knowledge obtained in school to undertake innovative practices. The innovative practices will provide incomes to them thus opting not to engage in criminal activities. Secondly, in the aspect of classic Becker model of crime, individuals who have secured jobs from education will opt to focus on work to improve their productivity and make their lives better. In this case, they will analyze the cost-benefits of employment and criminality (Cho, 2011). Since employment provides wages that sustains their lives, they opt to avoid criminality since risks include lack of freedom, jail term and death (Brown, 2001). Lastly, engaged individuals in schools learning or in workplace, lacks adequate time to allocate for criminal activities. Thus, it is evident education greatly lowers criminal behaviors (Cook & Kang, 2016).

International relation can be best understood through the various schools of thought or
rather theories. They are significant in giving a comprehensive detail of the constructs that make
international relations. Realism theory still remains one of the most influential tools in
understanding events related to international relations. This is because it provides a pragmatic
approach in examining current events in the sphere of international relations (Maghroori, pg. 17).
Realism is divided into three subdivisions, seeking to explain causes of state conflict. This
include classical realism that argues that the conflict comes from the nature of man, neorealist
which associates conflict the elements of the state, and neoclassical realism which associates it to
both human nature and elements of the state. This school of thought is grounded on some
fundamental principles that make the core of its arguments.
The first assumption in realism is the idea that a country, usually referred to as a state,

The Myth of Disability as Isolating in Tim Burton’s Edward Scissorhands
Jay Timothy Dolmage discusses the common disability myths that condition our
understanding of disability in his work Disability Rhetoric. He argues that these myths create the
perception that disabled people are “others”, through the portrayal of them as lesser, surplus, or
improper (Dolmage, 31). One of the myths that Dolmage examines is disability as isolating or
individualizing, which is perpetrated through narratives of disabled people living in isolation,
rarely having romantic relationships or friendships, and often being left alone at the end
(Dolmage, 43). This myth can be seen in the film Edward Scissorhands, directed by Tim Burton.
Edward is a human being created by an inventor, yet the inventor’s death before his completion
leaves him with scissor blades for hands. Edward lives in a gothic mansion atop a hill,
completely in isolation until local Avon saleswoman Peg Boggs visits. She is initially frightened
by his appearance, yet decides to take him home with her upon the realization that he is
harmless. Edward’s disability causes his transition into society to be largely unsuccessful, as he
is objectified and used by other people for their benefit, and at the end of the film he is forced to
return to living in isolation after their perception of him turns to one of fear and scorn.
Edward’s isolation from society is symbolically portrayed through many film design
techniques. The mansion in which he lives at the beginning and the end of the film starkly
contrasts the community in which the able-bodied society lives. The mansion is gothic, dark, and
partially in ruins, whereas the rest of the houses are brightly colored in pinks, yellows, and

greens, all with perfectly manicured green lawns. His appearance also separates him from the
rest of society, as he has very pale skin, dark under-eyes, black untamed hair, and wears gothic
industrial clothes. The able-bodied individuals often wear colorful or light clothes and appear
quite “ordinary”. The contrast created between Edward and society through set, clothing,
makeup, and hair design work to portray Edward and his disability as unusual, creepy, and
“other”. Peg even attempts to “normalize” his appearance by giving him different clothes to wear
and attempting to cover his scars with makeup, in the hopes that it will ease his transition into the
community. This film phenomenon is discussed by Martin F. Norden in his book The Cinema of
Isolation: A History of Physical Disabilities in the Movies. He argues that filmmakers will
separate disabled characters from their able-bodied peers not only through the storyline, but also

There are several different reasons why an intervention fails, such as the wrong intervention being selected or trying to solve the wrong problem. It is important that when performing and intervention that every thing have been severely observed and taken into consideration. I worked with an organization that was a travel agency, and they operated off of the commission that was collected from the booking that are processed, but they also provided a discount to the members that was taken out of the commission total. The issue was that when they initially opened the department there was no budget plan done and no guidelines were given, the agents were told to use discretion, and all though the department was a huge success in booking reservations they were still failing, because they were not withholding enough commission for the organization to operate under. Where the intervention process failed is that they never had formal training, which would have been a focus group to define the exact percentage to give to customer and the amount the organization needed to cover their overhead. During the meeting process there should have been definite guidelines to lead employees and managers from the accounting department so that the employees did not need to play the guessing game. Although they had the meeting nothing changed, because the problem was not solved with the employees and managers and was not addressed by the accounting department. The business is now in danger of folding because of the poor communication practices.

Although what I am going to talk about is not my workplace but the place that I volunteer my time to sit on the board of directors for a non profit agency. As a board member we oversee the agency as a whole but we also break down into small committee groups to address needs as they arise. One of the committees that I am on is the planning committee. A change that was implemented by administration, program staff, and the board was all departments would start entering all their own data. At the time the agency had two data entry personal that was entering all agency data. So the change we made was that instead of hiring another data entry person we would require all programs to enter their own data into the collection software. This ended up being a failure that could have been huge had we not pulled reports the first two quarters of the year. What we found was some programs were right on target with getting their information entered with the first quarter. The Executive Director addressed this with staff. When the second quarter reports were pulled the data did not get any better. As an agency this failed due to program staff just did not have the appropriate time to take on more data entry. The agency ended up where we should have to start off, hiring another data entry staff member. I will say with this failure it actually turned into a very positive experience over all.

Introduction
Cellular respiration refers to all the metabolic processes and chemical reactions that take place in living organisms, particularly at the cellular level. These processes focus on the extraction of energy from nutrients. It is also responsible for converting the biochemical energy into 'adenosine triphosphate' (ATP) by the breakdown of sugars in the cells (Bennet 58). Cellular respiration is also responsible for the process by which cells release chemical energy required for conducting cellular activities. The reactions and processes facilitate the release of waste products from the cells. This experiment seeks to conduct a study of the processes and reactions involved during cellular respiration. The experiment will include several activities, such as having a study on the amount of Carbon dioxide produced during the experiment.
The number of levels of the growth of a yeast medium as a dependent variable will also be monitored during the experiment. There are other several independent variables associated with the experiment. These independent variables include sugar and temperature, among others, and their role in the experiment were also monitored. The experiment design involved the use of airtight balloons capped over reaction chambers that were used to collect the Carbon dioxide produced during the experiment. The reaction chambers contained sugars and yeast medium, which facilitated the reactions. Thermometers and pH scale were used to monitor the changes in temperature and acidity levels during the experiment. The paper involves a lab design that institute steps such as arranging the bottles used on the experiment. Notably, a proper arrangement to make sure that all the carbon dioxide released during the respiration process is well tapped in the bottles for correct lab results
Methodology
The actual procedure for experimenting involved taking measurements and recording of all observations made during the experiment. For accurate results, measures were taken three times, and a mean measurement was calculated and recorded. Winzler asserts that the mean obtained from the measurements should be used to calculate the standard deviation, which in turn facilitated the calculation of uncertainty (276). Below are the steps for conducting the experiment. It is essential to read the instructions carefully safety and accuracy during the experiment. Notably, all the lab and experiment results were well observed and thus making sure that there are limited errors in the whole process.
Consequently, all the steps required in the lab report were also clearly followed to help in getting the correct data and even not to affect the whole experiment process. A Strategic Approach: GenAI in Education
Artificial Intelligence (AI) technologies such as Generative AI, Image Generators and Large Language Models have had a dramatic impact on teaching, learning and assessment over the past 18 months. The most immediate threat AI posed was to Academic Integrity with Higher Education Institutes (HEIs) focusing their efforts on combating the use of GenAI in assessment. Guidelines were developed for staff and students, policies put in place too. Innovative educators have forged paths in the use of Generative AI for teaching, learning and assessments leading to pockets of transformation springing up across HEIs, often with little or no top-down guidance, support or direction.
This Gasta posits a strategic approach to integrating AI into HEIs to prepare staff, students and the curriculum for an evolving world and workplace. We will highlight the advantages of working with these technologies beyond the realm of teaching, learning and assessment by considering prompt engineering skills, industry impact, curriculum changes, and the need for staff upskilling. In contrast, not engaging strategically with Generative AI poses risks, including falling behind peers, missed opportunities and failing to ensure our graduates remain employable. The rapid evolution of AI technologies necessitates a proactive and strategic approach if we are to remain relevant.

Published classroom materials form the basis of syllabuses, drive teacher professional development, and have a potentially huge influence on learners, teachers and education systems. All teachers also create their own materials, whether a few sentences on a blackboard, a highly-structured fully-realised online course, or anything in between. Despite this, the knowledge and skills needed to create effective language learning materials are rarely part of teacher training, and are mostly learnt by trial and error.
Knowledge and skills frameworks, generally called competency frameworks, for ELT teachers, trainers and managers have existed for a few years now. However, until I created one for my MA dissertation, there wasn’t one drawing together what we need to know and do to be able to effectively produce language learning materials.
This webinar will introduce you to my framework, highlighting the key competencies I identified from my research. It will also show how anybody involved in language teaching (any language, not just English!), teacher training, managing schools or developing language learning materials can benefit from using the framework.

- 1. MDS 4100 Communication Law Case Study: Privacy CASE STUDY: PRIVACY You are a reporter for WKRN-TV, covering local police activity as part of your beat. Your editor tells you to get over to McGavock High School as quickly as possible. An anonymous caller, saying she lives across the street from the public school, told a news editor she heard four or five gunshots coming from the school building as she was outside walking her dog. Within seconds, she says, students were running outside and screaming. A listen to the police band receiver in the newsroom indicates something is up at the school. You take a videographer and arrive on the scene about 1:30 p.m. Five or six Metro police cars are parked near the school, and an ambulance arrives seconds later as you get out of your car.
- 2. The entrance to the school building is blocked off and police are guarding the area, admitting no one except authorities into the building. After questioning police, you confirm the fact there has been a shooting, but that’s as far as you get. You begin asking bystanders for more information. A number of McGavock students have remained at the scene. Several tell you a student was shot in a first-floor restroom. A girl who claims to be a friend of the victim says his name is James DeVore, a freshman. She said she thinks he is 14 years old. Another student says DeVore recently turned 15. No one present knows who is responsible for the shooting. Minutes later police escort a young man, handcuffed, from the school building. They place him in a squad car and drive away. You ask people in the crowd if anyone can identify the alleged suspect. At least four tell you he is Brian Samuels, a sophomore. You ask police at the scene to confirm this information, but no one will reply.
- 3. Your videographer tells you she got footage of the boy being placed in the squad car. While talking to her, you hear screams in the background. You run around the side of the building to the loading dock area. Police have taped off the immediate area but you can see what’s going on. EMTs are wheeling the covered body of the victim to an ambulance waiting near the dock. Some students are crying. The videographer gets shots of the body being placed into the ambulance and close-ups of crying students. You approach several police officers standing near a squad car, hoping to get more facts. Inside the squad car an officer is radioing into police headquarters. You hear him saying “the victim is James DeVore, age 15.” The officer radios that the suspect, Samuels, has admitted to the shooting. You also hear the following: “Samuels said it was it was payback, that DeVore had sexually assaulted Samuels’ 6-year-old sister.” Because you are under deadline, you decide not to interview the officers personally and head back to the station.
- 4. When you get back to the station, a colleague tells you he covered a story two years ago on another incident at McGavock, and it involved a student named Jeffrey Samuels. You pull out the footage from that broadcast, and the story relates to a drug arrest at the school in which Jeffrey Samuels, then age 18, was charged with felony sale of narcotics. He is now serving the second year of a 10-year sentence in a state prison. You call McGavock and get a guidance counselor still at the school who confirms that Jeffrey and Brian are brothers. Your editor tells you he needs the story for the 5 p.m. newscast. You compile your notes and work with an editor to decide which footage to use to accompany the story. You decide to show the suspect being placed in the squad car, the victim’s covered body being placed in the ambulance, and the tearful reactions of students.

You write the following to accompany the story: “A 15-year-old McGavock High School sophomore, a member of a family with a history of run-ins with the law, admitted to fatally shooting a fellow student this afternoon. Metro police arrested Brian Samuels in connection with the shooting death of McGavock freshman James DeVore. Informed sources say the shooting took place in a school restroom. Police report Samuels shot the victim in retaliation for a sexual assault allegedly made by DeVore on the suspect’s younger sister. Two years ago, the brother of the suspect, Jeffrey Samuels, was convicted of selling narcotics while he was a student at McGavock. He is now serving a 10-year sentence in a state penitentiary.”

ASSIGNMENT: The Samuels family sues for invasion of privacy in the areas of Intrusion, Private Facts and False Light. • What potential legal problems (related to privacy) are contained in the text of the story? • Are there problems with any part of the footage that was aired? • The evening the story runs, you discover from police that Brian Samuels is actually 17 years old and a junior at the high school. What are the consequences, if any, of this reporting error? • How does the suit stand up against the various elements required for each alleged privacy invasion? • Analyze the situation from a legal standpoint. If you believe the media committed an invasion of privacy, make the best case for the Samuels. • If you believe the reporter and videographer did not legally
- 7. invade the family’s privacy, provide a solid defense. Cite appropriate cases and decisions to support your arguments.
