Reversing Offers
SSONE also gives the opportunity to reverse a secret offer , if not
triggering settlement , without the other party knowing.
This will enable Defendants to make high secret offers on the basis that
an early settlement at a high offer when legal costs are low would be less
costly to them than settling at a lower figure when legal costs are high.
Unlike in open bidding the fact they made a high offer initially is not
known by the Claimant so no damage done.
