4. Child abuse or maltreatment constitutes all forms of physical and/or emotional ill-treatment, sexual abuse, neglect or
negligent treatment or commercial or other exploitation, resulting in actual or potential harm to the child’s health,
survival, development or dignity in the context of a relationship of responsibility, trust or power.

Failing to meet a child’s needs for nurture and
stimulation, perhaps by ignoring, humiliating,
intimidating or isolating them. It’s often the
most difficult to prove.
Medical neglect
Failing to provide appropriate health care,
including dental care and refusal of care or
ignoring medical recommendations.

9. Protection of Children from Sexual Offence Act 2012. (POCSO)
The Act has come into force with effect from 14th November, 2012 along with the Rules framed thereunder.
• It is a comprehensive law to provide for the protection of children
• From the offences of sexual assault, sexual harassment and pornography.
• To safeguard the interests of the child at every stage of the judicial process.
• For the proper development of the child in view of his/her protection of the right to privacy and
confidentiality
POCSO का पूरा नाम है The Protection Of Children From Sexual Offences Act या +ोटे/शन आफ
3च56ेन 7ाम से/सुअल अफ< सेस ए/ट । ये ?वषेष कानून सरकार ने साल 2012 म< बनाया था। इस
कानून के जIरए नाबाJलग बLचM के साथ होने वाले यौन अपराध और छेड़छाड़ के मामलM म< कारSवाई
कU जाती है।
!कसी ब'चे का यौन शोषण हुआ है तो...
यXद अJभयु/त एक कशोर (ट^नएज) है, तो उसके ऊपर कशोर cयायालय अ3धdनयम म< के स चलाया
जाएगा। इस ए/ट म< ये भी dनयम है क य8द कोई ;यि=त यह जनता है !क !कसी ब'चे के साथ
गलत कृ Cय हुआ तो उसके इसकF GरपोटK नजदLकF थाने मN देनी चा8हए, य8द वो ऐसा नहLं करता है तो
उसे 6 महLने तक कF जेल हो सकती है।

10. Penetrative Sexual Assault (Sec 3) – Not less than seven years which may extend to imprisonment for

Sexual Assault (Sec 7) – Not less than three years which may extend to five years, and fine (Sec 8) तीन

Aggravated Sexual Assault (Sec 9) – Not less than five years which may extend to seven years, and fine
(Sec 10) पांच साल से कम नह+ं जो सात साल तक बढ़ सकती है, और जुमा9ना
Sexual Harassment of the Child (Sec 11) – Three years and fine (Sec 12) तीन साल और जुमा9ना (धारा
12)
Use of Child for Pornographic Purposes (Sec 13) – Five years and fine and in the event of subsequent
conviction, seven years and fine (Sec 14 (1) पांच साल और जुमा9ना और सात साल और जुमा9ना (धारा
