3. NYC COOLING TOWER REGULATIONS
THE THE INCREASED REGULATORY RIGOR carries a HEFTY PRICE TAG for building owners and operators.
 LOCAL Law of 77 and newly added Chapter 8 REQUIRES owners of buildings with cooling towers that are in
use to conduct routine inspections by a qualified person prior to seasonal startup and every 90 days.
Legionella testing is a requirement with these inspections.
• Building owners are REQUIRED to respond appropriately to any elevated Legionella culture sampling results.
notify the local health department within 24 hours of getting a Legionella culture sample result
exceeding 1,000 colony-forming units (CFU) per milliliter (mL).
 By law, all cooling towers must be disinfected twice per year. Use only pesticide applicators or technicians
certified by the state Department of Environmental Conservation to apply biocides for disinfection.
 Regulations mandate that all buildings with cooling towers to invest in a cooling tower maintenance program
and plan and to keep this plan updated.
• By Nov. 1 of each year a certification must be obtained from the credentialed inspector that states that each
cooling tower is covered by a maintenance plan, that it has been followed, and that all requirements of the
regulations have been met.
• Owners of buildings with cooling towers must keep the status of their towers updated in a new statewide
electronic system.
VIOLATIONS of these regulations are subject to civil penalties up to $10,000.
Failure to
disinfect towers with increased microbes are classified as misdemeanors,
