In 2016, the City Council of Portland, Oregon voted to require Home Energy Scores be provided by sellers in most listings. This presentation delivered at the 2018 annual RESNET conference describes some of the state policy background and details of how the program was implemented, including the auto-population of the scores into MLS listings.

The Portland Policy
As of January 1, 2018 it requires sellers of single-family
homes to incorporate the following practices prior to listing a
home for sale in the City of Portland:
• Obtain a home energy score from a licensed home energy
assessor.
• Provide a copy of the home energy performance report to
all licensed real estate agents working on the seller’s
behalf.
• Include the home energy score and the attached home
energy performance report in any real estate listings.

Compared to national trends both OR and Midwest have held onto more manufacturing jobs. National is 12% down to 6.5%. Oregon is less metropolitan than WA or CA and that creates similar frictions that other states experience. Suburban communities in OR are always in flux politically.
Scoring policy actually dates back to the 1970s, but it’s this latest wave of effort that I’ll focus on.
They want consistency and predictability for their businesses.
Legislation, then Rulemaking and continued advisory group has kept these stakeholders at the table.
This effort is intended to help states take action, learning from the experience of other states like OR and Missouri that have been giving this a try for years.
The policy requires a state approved label be used. The standard HES report does not comply, so Portland has it’s own report.
The handling of the score data has been an issue in Europe. Each nation is still trying to address how to share the data. We’re trying to get ahead of this issue in Portland.
