In Support of the Release of Public Information
IN THE LAMAR UNIVERSITY STUDENT GOVERNMENT ASSOCIATION

WHEREAS, Student Government serves as the official voice of the students at Lamar
University,
WHEREAS, Currently, the Lamar University student body and the Lamar University Student
Government Association do not have the access to public information from the university as is
required by state law.
WHEREAS, Section 552.021 of the Texas Government Code states: “Public information is
available to the public at a minimum during the normal business hours of the governmental
body.”
and,
Section 552.002(a) of the Texas Government Code defines “public information” as: information
that is written, produced, collected, assembled, or maintained under a law or ordinance or in
connection with the transaction of official business:
(1) by a governmental body; 

(2) for a governmental body and the governmental body:
(A) owns the information; 

(B) has a right of access to the information; or 

(C) spends or contributes public money for the purpose of writing, producing, collecting,
assembling, or maintaining the information; or
(3) by an individual officer or employee of a governmental body in the officer’s or employee’s
official capacity and the information pertains to official business of the governmental body.
and,
The Public Information Act applies to information of every “governmental body.”
“Governmental body” is defined in section 552.003(1)(A) of the Texas Government Code to
mean:
(i) a board, commission, department, committee, institution, agency, or office that is
within or is created by the executive or legislative branch of state government and that
is directed by one or more elected or appointed members; 

(xii) the part, section, or portion of an organization, corporation, commission, committee,
institution, or agency that spends or that is supported in whole or in part by public
funds[.]
THEREFORE, BE IT RESOLVED that the Student Government Association of Lamar
University supports the full disclosure of public information to be made from Lamar University
to the student body, including the Student Government Association, upon request and in a timely
manner.
