2. An Act to make provision for planning the development and use of land in Regions
established for that purpose and for the constitution of Regional Planning Boards
therefor; to make better provisions for the preparation of Development plans with a view
to ensuring that town planning schemes are made in a proper manner and their
execution is made effective; to provide for the creation of new towns by means of
Development Authorities; to make provisions for the compulsory acquisition of land
required for public purposes in respect of the plans; and for purposes connected with
the matters aforesaid.
3. The Bombay Town Planning Act, 1915, first came into existence in the then Bombay
Province in the year 1915. At that time, due to the need of providing public facilities such
as water, roads, electricity, etc. for Mumbai, Pune, and Thane, the Act was enacted and
according to its provisions, it was possible to develop a part of the city through Town
Planning Schemes. But development under this law was not mandatory but voluntary.
After independence, the industrial revolution started in the country and in that respect,
new cities were developed. Development started with the help of five-year plans in the
country and in view of that, the concept of planned development of new cities came into
existence. Thus in 1954, the provisions for the preparation of Development Plan were
included in the Act and in accordance with this provision, it has become mandatory for
the Planning Authority to prepare the Development Plan for the areas under their
jurisdiction.
Background of the Act
4. But with time, development started happening outside the city limits and as there was
no provision to control the development on the fringes, these areas witnessed
uncontrolled development. To curb the same, the concept of comprehensive
development of urban and rural areas came forward. In the year 1960 Maharashtra
State came into existence. In the year 1966, the provisions, for preparation of Regional
Plans and, for new towns were incorporated in the Act. The same Act is in force today,
knows as the Maharashtra Regional and Town Planning Act, 1966.
In the period from 1914 to 1962, the name of this department was ‘Consulting
Surveyor to Government’. ‘Directorate of town planning and valuation’ has been in
existence since 1962 and the head office of the Directorate is at Central Building, Pune.

7. REGIONAL PLAN
The State Government establish any area in the
State, by defining its limits, to be a Region.

9. DEVELOPMENT PLAN
Development plan means a plan for the development or re-
development of the area within the jurisdiction of a
Planning Authority and includes revision of a development
plan and proposals of a special planning Authority for
development of land within its jurisdictions
A Development plan shall generally indicate the manner in
which the use of land in the area of a Planning Authority
shall be regulated, and also indicate the manner in which
the development of land therein shall be carried out.

Allocation of land for different uses.
Reservation of areas for open spaces, recreation etc.
Transport & communication
Public utilities & amenities like water supply, drainage etc.
Service industries, industrial estates etc.
Preservation, conservation & development of areas of natural scenery, forest etc..
Heritage preservation
Proposals for irrigation, water supply, flood control etc.
The filling up or reclamation of low lying, swampy or unhealthy araes, or levelling

11. TOWN PLANNING SCHEMES
A Planning Authority may for the purpose of implementing the proposals in the final
Development plan, prepare one or more town planning schemes for the area within its
jurisdiction, or any part thereof
1. Laying out or re-laying out of land
2. Filling-up or reclamation of low-lying, swampy or unhealthy area, or levelling-up of
land ;
3. Layout of new streets or roads, construction, diversion, extension, alteration,
improvement and closing up of streets and roads and discontinuance of
communications :
4. Construction, alteration and removal of buildings, bridges and other structures
12. 5. Allotment or reservation of land for open spaces, gardens, recreation grounds,
schools, markets, green-belts, dairies, transport facilities and public purposes;
6. Drainage, inclusive of sewerage, surface or sub-soil drainage and sewage disposal;
7. Lighting; water supply; preservation of objects of historical or national intrest or
natural beauty, and of building actually used for religious purposes;
