3. Collective management revolutionized the need for MUSIC USERS
to have to seek permission to use, negotiate and pay for a license
on a PAY ASYOU GO basis.
CMOs became the LIASON between the MUSIC CREATORS (
rights holders) and the MUSIC USER allowing the user to benefit
from a blanket license fee on an annual basis (as opposed to PAYG)
which is cost effective and more efficient.
Collective management allows rights holders to benefit from a
perspective of time and efficiency and they can create, while their
works continue to generate revenue for them through various
uses; Broadcasting, communication to the public/performances in
public places, digital distribution-downloading / streaming, blank
media levies etc.
4. Performers Rights Society of Kenya (PRISK) is a Collective Management
Organisation (CMO) licensed by the Kenya Copyright Board (KECOBO) to
represent performers in sound recordings and audiovisual works.
PRISK is hence a non-profit, performer works licensing company
appointed as a collecting society under Gazette Notice No. 12322 of
2009.
5. PRISK negotiates and sets tariffs with the different users of
sound recordings and audio-visual works. In respect to any
exploitation of works
PRISK collects on behalf of its members, equitable
remuneration from users of sound recordings and audiovisual
works for purposes of broadcasting or other communication to
the public. PRISK is also mandated to enter into agreements
with manufacturers and importers of any audio visual recording
equipment and blank media intended for recording and collect
all royalties levied in respect to the royalties payable to the
performers.
6. PRISK represents musicians and actors.This can
be further classified as follows;
Musicians: Vocalists (in main role and featured role),Track
Producers, BackgroundVocalists and Instrumentalist.
Actors: Performers in recorded films and series in main,
featuring and supporting roles.
7. All three are Collective Management Organizations, but they
separately administer three different classes of rights.
MCSK administers the copyright for authors, composers,
arrangers and music publishers of musical works
KAMP administers the related rights of producers of sound
recordings
PRISK administers the related rights of performers of sound
recording and audiovisual works.
8. Receiving royalty payments when their works
are played on radio,TV and other public places
in Kenya
Access to medical insurance cover to cater for
medical expenses.
Access to the Social and Cultural Fund (This is
subject to the rules and procedures laid out for
the Fund)
9. Receiving royalty payments on international plays of their works from
other Collective Management Organizations once PRISK enters into
reciprocal agreements.
Attending training seminars that PRISK organizes from time to time in
corporation with various stakeholders in the entertainment industry to
sensitize performers on various issues that affect them.
Networking - Upcoming performers get a chance to interact with
already established performers during meetings organized by PRISK
Priority access to opportunities presented to musicians and actors as
and when they arise.
Through PRISK performers have a unified voice to let their concerns and
matters that affect them known to other institutions.
