5. WORKPLACE SEXUAL HARASSMENT
WORK PLACE SEXUAL HARASSMENT IS COMMITTED:
•WHEN THE SEXUAL FAVOR IS MADE AS A CONDITION
FOR EMPLOYMENT
FOR REEMPLOYMENT OR CONTINUED EMPLOYMENT
IN GRANTING FAVORABLE COMPENSATION , TERMS, CONDITIONS,
PROMOTIONS OR PRIVILEGES
6. WORKPLACE SEXUAL HARASSMENT
THE REFUSAL TO GRANT THE SEXUAL FAVOR RESULTS IN:
•LIMITING, SEGREGATING, OR CLASSIFYING THE EMPLOYEE
WHICH IN A WAY WOULD DISCRIMINATE, DEPRIVE, OR
DIMINISH EMPLOYMENT OPPORTUNITIES OR OTHERWISE
ADVERSELY AFFECT THE SAID EMPLOYEE
7. WORKPLACE SEXUAL HARASSMENT
THE ABOVE ACTS WOULD RESULT IN AN INTIMIDATING,
HOSTILE OR OFFENSIVE ENVIRONMENT FOR THE
EMPLOYEE
8. SEXUAL HARASSMENT IN EDUCATION OR TRAINING ENVIRONMENT
EDUCATION OR TRAINING-RELATED SEXUAL HARASSMENT IS COMMITTED:
•AGAINST ONE WHO IS UNDER THE CARE, CUSTODY OR
SUPERVISION OF THE OFFENDER
9. SEXUAL HARASSMENT IN EDUCATION OR TRAINING ENVIRONMENT
EDUCATION OR TRAINING-RELATED SEXUAL HARASSMENT IS COMMITTED:
•WHEN THE SEXUAL FAVOR IS MADE A CONDITION TO THE
GIVING OF A PASSING GRADE
•OR GRANTING OF HONORS AND SCHOLARSHIPS
•OR THE PAYMENT OF THE STIPEND, ALLOWANCE OR
OTHER BENEFITS, PRIVILEGE OR CONSIDERATION
10. SEXUAL HARASSMENT IN EDUCATION OR TRAINING ENVIRONMENT
EDUCATION OR TRAINING-RELATED SEXUAL HARASSMENT IS COMMITTED:
•WHEN THE SEXUAL ADVANCES RESULT IN AN
INTIMIDATING, HOSTILE OR OFFENSIVE ENVIRONMENT
FOR THE STUDENT, TRAINEE OR APPRENTICE.
11. SEXUAL HARASSMENT MAY TAKE PLACE:
•IN THE PREMISES OF THE WORKPLACE OR OFFICE OR OF THE SCHOOL OR
TRAINING INSTITUTION;
•IN ANY PLACE WHERE THE PARTIES WERE FOUND, AS A RESULT OF WORK
OR EDUCATION OR TRAINING RESPONSIBILITIES
•AT WORK OR EDUCATION OR TRAINING-RELATED SOCIAL FUNCTIONS
•WHILE ON OFFICIAL BUSINESS OUTSIDE THE OFFICE OR SCHOOL OR
TRAINING INSTITUTION OR DURING WORK OR SCHOOL OR TRAINING-
RELATED TRAVEL
12. LIABILITY OF THE EMPLOYER, HEAD OF OFFICE IN WORK OR
EDUCATION/TRAINING ENVIRONMENT
•THEY MUST PROVIDE THE PROCEDURES FOR THE RESOLUTION, SETTLEMENT OR
PROSECUTION OF ACTS OF SEXUAL HARASSMENT
•THE EMPLOYER MUST CREATE A COMMITTEE ON DECORUM AND INVESTIGATION OF
CASES ON SEXUAL HARASSMENT
•IN THE CASE OF A WORK-RELATED ENVIRONMENT, THE COMMITTEE SHALL BE
COMPOSED OF AT LEAST ONE (1) REPRESENTATIVE EACH FROM THE MANAGEMENT,
THE UNION, IF ANY, THE EMPLOYEES FROM THE SUPERVISORY RANK, AND FROM THE
RANK-AND-FILE EMPLOYEES.
13. PENALTIES
A PERSON FOUND GUILTY OF SEXUAL HARASSMENT SHALL BE PENALIZED BY
•IMPRISONMENT OF NOT LESS THAN ONE (1) MONTH NOR MORE THAN SIX
(6) MONTHS,
•OR A FINE OF NOT LESS THAN TEN THOUSAND PESOS (P10,000) NOR
MORE THAN TWENTY THOUSAND PESOS (P20,000),
•OR BOTH.
14. MISPLACED SUPERIORITY
•SEXUAL HARASSMENT IS AN IMPOSITION OF MISPLACED SUPERIORITY
WHICH IS ENOUGH TO DAMPEN AN EMPLOYEE’S SPIRIT AND HER
CAPACITY FOR ADVANCEMENT.
•IT AFFECTS HER SENSE OF JUDGMENT; IT CHANGES HER LIFE

15. SEXUAL HARASSMENT IS ABUSE OF POWER
•IT IS NOT NECESSARY THAT THERE WAS AN OFFER FOR SEX FOR THERE TO
BE SEXUAL HARASSMENT AS A SUPERIOR’S CONDUCT WITH SEXUAL
UNDERPINNINGS, WHICH OFFENDS THE VICTIM OR CREATES A HOSTILE
ENVIRONMENT WOULD SUFFICE.

16. SEXUAL HARASSMENT IS ABUSE OF POWER
•THE ESSENCE OF SEXUAL HARASSMENT IS NOT THE VIOLATION OF THE
VICTIM’S SEXUALITY BUT THE ABUSE OF POWER OF THE OFFENDER.
•IN OTHER WORDS, WHAT THE LAW AIMS TO PUNISH IS THE UNDUE
EXERCISE OF POWER AND AUTHORITY MANIFESTED THROUGH SEXUALLY
CHARGED CONDUCT OR ONE FILLED WITH SEXUAL UNDERTONES.
