2. Should you pass away without leaving a valid Will, you die Intestate. That means you don’t have control over the
answers to these questions.

your Assets after your death.

Last Will & Testament
PROTECTING YOUR LOVED ONES
“ Leave a Legacy: the most important document that you’ll ever
draft is now simple to put in place... ”
YOUR WILL
Drafting a Will can be an efficient process,
but it requires an in-depth understanding
of your Assets, your Beneficiaries and
your Intentions.
We seek first to understand your
position - then advise you on the
best course of action
Your first step is a discovery session with
a qualified financial planner, so that you
can ask questions and we can understand
your needs.
Q: Who decides what happens to your business, your property and your possessions after your death?
Q: Who should look after your children & other dependents (even your pets) if you died unexpectedly?
Q: Will you be buried or cremated? Who will direct your Funeral? Are you willing to donate organs?
Q: Are your wishes and views the same as those of your Spouse, Partner or your family members?
Q: How much Tax would your loved ones have to pay if you died tomorrow?
Q: Would all your dependents be provided for financially?
3. TRUSTS
Inter-Vivos Trust - set up during your lifetime to
segregate, protect your assets and mitigate tax.
Testamentary Trust - set up by your Will on
your death, to manage assets for minor children
or to protect your Legacy for future generations.

complimentary, face-to-face discovery meeting.

PROFESSIONAL EXECUTORS
An Executor is the person or organisation you
choose to administer your Estate and carry out the
wishes in your Will.
Professional Executors have the necessary expertise
to deal with your Estate: your tax affairs, debts,
distributing property and managing investments.
The costs of any Executor are regulated by
law, and are paid by your Estate. Their duty is
to follow your wishes.
TAX PLANNING
On death, the Government will seek to tax your
assets in several ways.
Botswana’s main ‘death duty’ is Capital Transfer Tax
- levied at 5% on amounts over P500,000.
Foreign governments may also tax overseas assets
on death – and may want to see a valid Will before
transfer is permitted.
It is vital to have a plan to pay Taxes without
having to sell the assets that your
beneficiaries need the most
LIFE INSURANCE
It is important to protect your spouse & children
- and your business interests - with life insurance,
but many over-pay for their protection needs.
