6. What is the Flexibility Rule
According to CMS

7. Branzell went on to state: "Now the very future of meaningful use is in question.
The new rule allows eligible providers to use the 2011 Edition of certified EHR technology or a combination of
2011 and 2014 Edition for the 2014 Medicare CEHRT and Medicaid Systems EHR Incentive Programs.
Available
Come 2015, all eligible providers will be required to use the 2014 Edition of For certified use EHR in technology.

By bending the rule a little, more providers would be able to participate and meet important meaningful use
objectives such as drug interaction and drug allergy checks, providing clinical summaries to patients, electronic
prescribing, reporting on key public health data and reporting on quality measures, HHS officials noted in a news
8. What We Have Heard
From CMS
• The CMS Final Ruling expanded on the definition
of “availability” to include whether a provider is
able to “fully implement” the 2014 version. “Full
implementation” as described in the new Final
Rule includes such items as:
• staff training
• system testing and workflow revisions
• update and integration
• software patches or workflow changes
• To me that is a liberal, and most welcome, CMS
interpretation.

9. Final Flexibility Rule
• A provider's ability to fully implement all
of the functionality of 2014 Edition
CEHRT may be limited by the availability
and timing of product installation,
deployment of new processes and
workflows, and employee training

24. What Has CMS Said?
Some Tips
• CMS states that the attestation site will
be ready by October
• This could be mid October
• When we attest how do we notify CMS
we are taking advantage of the Rule?
• You must swear to a specific statement
during attestation
• How should we document why we took
advantage of the Rule?
• Document your reasons – bring in help
• What should we do to prepare for audit?
• Document, Document, Document
25. Effective 10/1/14
Eligible Hospitals
• Full 365 days reporting period regardless of
Stage
• If you were to be Stage 2 Year 1 in 2014
and you take advantage of the Rule — you
will be Stage 2 Year 2 in 2015 (10/1/14 to
9/30/15 and Stage 2 Year 3 in 2016
(10/1/15-9/30/16)
• Ready on 10/1/16 for Stage 3
26. 2014 Edition Release 2
• Under the new rule, ONC will not
require EHR vendors or providers to update
or recertify their systems; however, it gives
vendors the opportunity to make changes
to their products
