2. Capacity to contract means the legal competence of a person
to enter into a valid contract. Usually the capacity to
contract refers to the capacity to enter into a
legal agreement and the competence to perform some act.
The basic element to enter into a valid contract is that he
must have a sound mind. According to Sec.10: An Agreement
becomes a contract if it is entered into between the parties
who are competent to contract.

6. PERSON OF UNSOUND MIND
A person is said to be of sound mind for the purpose of making a
contract if at the time when he makes it, he is capable of
understanding it and forming a rational judgement as to its upon his
interest .
