Navigating the Planning Regulation 2017 Schedule 10 Part 10 (Koala habitat in SEQ region)
for development applications made from 7 February 2020 [see Planning Regulation section 73 transitional provision]
TRIGGER UNLESS THE DEVELOPMENT IS CATEGORY OF ASSESSMENT ASSESSMENT BENCHMARKS
Development involving interfering with koala habitat in a koala habit area* [see Schedule 24 for definition of interfering with koala habitat]
In a koala priority area*
1. carried out under a development permit given for an
application properly made before 7 February 2020; or
2. consistent with a development approval given for an
application properly made before 7 February 2020; or
3. caught by the extractive industry trigger 3 below; or
4. caught by the identified KBHA trigger 5 below; or
5. ‘exempted development’ in Schedule 24.

and contains a koala habitat area*
1. carried out under a development permit given for an
application properly made before 7 February 2020; or
2. consistent with a development approval given for an
application properly made before 7 February 2020; or
3. results in a development footprint of ≤500m2
; or
4. PDA-related development; or
5. for Schedule 5 infrastructure carried out by or for the
State or a public sector entity (eg. a local government); or
6. a coordinated project; or
7. in a State development area; or
8. in an area of a development control plan to which SPA
section 857 applies; or
9. the subject of an application for which the chief
executive is the prescribed assessment manager.

In Queensland Globe, koala priority area, koala habitat area and identified koala broad-hectare area mapping is available through the Environment – Koala plan layer
and key resource area mapping is available through the Economy – Resources layer.
Property-scale mapping of koala priority areas and koala habitat areas can be obtained through the Queensland Government vegetation management report.

See Schedule 24 for the list of 51 ‘exempted development’ items. Prohibited development Schedule 10 Part 10 Division 2 section 16A Not applicable. Can’t make development application. Outside a koala priority area* Planning Regulation makes it code assessable (min.) Schedule 10 Part 10 Division 3 section 16B Referral to/assessment by SARA against SDAP State code 25: Development in South East Queensland koala habitat areas Development is for extractive industry in a key resource area* 1. carried out under a development permit given for an application properly made before 7 February 2020; or 2. consistent with a development approval given for an application properly made before 7 February 2020; or 3. ‘exempted development’ in Schedule 24. See Schedule 24 for the list of 51 ‘exempted development’ items. Planning Regulation makes it code assessable (min.) Schedule 10 Part 10 Division 4 section 16C Referral to/assessment by SARA against SDAP State code 25: Development in South East Queensland koala habitat areas Development that does not involve interfering with koala habitat in a koala habitat area* [see Schedule 24 for definition of interfering with koala habitat] But the premises is in a koala priority area* and contains a koala habitat area* 1. carried out under a development permit given for an application properly made before 7 February 2020; or 2. consistent with a development approval given for an application properly made before 7 February 2020; or 3. results in a development footprint of ≤500m2 ; or 4. PDA-related development; or 5. for Schedule 5 infrastructure carried out by or for the State or a public sector entity (eg. a local government); or 6. a coordinated project; or 7. in a State development area; or 8. in an area of a development control plan to which SPA section 857 applies; or 9. the subject of an application for which the chief executive is the prescribed assessment manager. Schedule 11 Part 1 Category of assessment stated in the local categorising instrument (LCI) Schedule 10 Part 10 Division 5 The local government must assess against the assessment benchmarks in— Schedule 11 Part 2 + the LCI to the extent it is not inconsistent. Note: Local assessment benchmarks that contain extra requirements in relation to the conservation of koalas are not inconsistent. Development in an identified koala broad- hectare area* Category of assessment stated in the local categorising instrument (LCI) Schedule 10 Part 10 Division 6 The local government must assess against the assessment benchmarks in— Schedule 11 Part 3 + the LCI to the extent it is not inconsistent. Note: Local assessment benchmarks that contain extra requirements in relation to the conservation of koalas are not inconsistent. The development is assessable reconfiguring a lot under the Regulation or assessable development under a planning scheme / TLPI *These are at Coomera, Kinross Road, Oxley Wedge, Palmview, Ripley Valley, Rochedale and South East Thornlands. 3 1 2 4 In Queensland Globe, koala priority area, koala habitat area and identified koala broad-hectare area mapping is available through the Environment – Koala plan layer and key resource area mapping is available through the Economy – Resources layer.
